ACCEPTANCE OF MINUTES OF THE COMMITTEE OF THE WHOLE AUGUST 11, 2009 III. CITIZENS TO BE HEARD IV. BOARD OF FIRE AND POLICE COMMISSIONERS' ANNUAL REPORT Chapter 5, Article III of the Municipal Code governs the duties of the Mount Prospect Board of Fire and Police Commissioners. Each year the BOFPC is required to report on its activities to the Village Board. Chairman George K. Busse will be present at the meeting to file his report. V. VIDEO GAMING DISCUSSION Earlier this summer, Governor Pat Quinn signed into law House Bill 255 also known as the Video Gaming Act. This Act allows certain liquor eslablishments to legally operate up to five video gaming terminals whereby a patron of the establishment can place up to a $2.00 wager and receive a maximum $500.00 payout. Only establishments that serve liquor by the drink are eligible to operate the terminals. There are also certain geographic and interior physical limitations contained in the Act that would render otherwise eligible establishments ineligible to operate the terminals. Of the 63 total liquor licenses (including package goods licenses) approximately 35 establishments might meet the requirements of the Act. The Act provides that municipalities, who sanction video gaming terminals, may share in a portion of the "tax" imposed by the State on net terminal income, in proportion to the tax revenue generated within the municipality. The Act also allows a municipality to prohibit video gaming terminals, either by ordinance or referendum; in which case there is no revenue sharing. A copy of the Act along with other pertinent material is provided. Appropriate staff will be available to answer questions and facilitate discussion. 1 VI. BOUTIQUE ELECTION DISCUSSION Continuation of the May 26,2009 COW discussion. The final amended copy of the 2009 Candidate's Gui::le was released September 29,2008. The revisions to the 2009 Candidate's Guide which appeared to be in conflict with the Village of Mount Prospect's long-standing election process created a number of concerns regarding the Village's election process. While the Village made the final determination to follow the revised procedures set forth by the State Board of Elections for the 2009 Elections, the disparity generated by the procedural changes warranted further review of the Village's policy and practice relative to the election process including nomination petitions and the role of the "local election official"; the Village Clerk is the "local election office" for the Village of Mount Prospect. At this time, the Village Clerks office is seeking direction from the Village Board regarding the scope of responsibilities beyond those established by the Illinois Election Code of the "local election official" in the election process. As the Candidate's Guide directs potential candidates to the Village Clerk for additional information, it would seem appropriate to establish specific policies and practices for the Village Clerk as the "local election official." While there are several options the Village Board may want to consider, the most essential criteria will be the consistent application once the guidelines are in place.
