AN ORDINANCE REGULATING THE PLANTING OF TREES AND SHRUBBERY
ON THE PARKWAYS OF THE STREETS IN THE VILLAGE OF MOUNT PROSPECT, COO
COUNTY, ILLINOIS.

BE IT ORDAINED by the President and Board of Trustees of the
Village of Mount Prospect, Illino1s:

SECTION 1. That hereafter it shall be unlawful for any
person, including the owner of the premises or lot in front of
which such parkway is located, to plant any other kinds or varities
of shade tree than those kn,o,v.rn as the; ~rican El~, Hard ~,Maple,
Norway Maple or Red Leaf Maple, in'E?U~ parkway; and all shrubbery
planted on any such parkway or any public street of said Village
shall be kept trimmed to a height not to exceed four (4) feet above

or by the successor in title of the lot or premises in fro~t

SECTION 2. That if any property owner or other person
interested shall desire to plant trees upon the parkway of any
of the streets of the Village of Mount Prospect, such person

shall make application to the Village Board for a permit to
plant such trees. Upon the granting of such permit by the President
and the Board o~ Trustees of said Village, said President and Board
of Trustees, through one of the officers or employees of said
Village, shall locate for such applicant the line along which such
tree or trees shall be planted. No trees shall be planted closer
than fifty (50) feet apart, except in instances where the adjoining
lots have a frontage of less than fifty (50) feet. Where 'trees are
planted on the parkway in front of subdivided premises, and where
one tree is to be planted opposite each lot, such tree, whenever
practical, shall be planted opposite the center of such lot. Where
ver it is not practical to plant such tree opposite the center of a
lot, or where more than one tree is planted opposite a lot, no

such tree shall be planted nearer than fifteen (15) feet to the
extension of the side lines of such lot extended, the purpose of
this provision being to pre~ent the location or planting of trees
Ii near lot lines so as to interfere with possible driveways. All
trees planted within any particular block shall be, if possible,
uniform in kind, and no tree shall be less than eight (8) feet
high when planted.
Upon the granting of such permit said Village may furnish
such tree or trees to such applicant free of charge, upon the
condition that said applicant agrees to plant such tree or trees
in proper manner and to take care of and water the same, if
necessary, for their proper growth. The Village, however, shall
not be obliged to furnish such trees.
SECTION 3. No person, firm or corporation shall hereafter
cut down, or trim any tree located on the parkways or streets of
said Village, without first having obtained a permit therefor
from the President and Board of Trustees of said Village, and
the violation of the provisions of this section of this ordinance
shall be a misdemeanor, and upon a conviction of such offense
such person, firm or corporation, shall be subject to a fine of
not less than FIVE DOLLARS ($5.00) nor more than FIFTEEN DOLLARS
($15.00) for each offense.
SECTION 4. Any person, firm or corporation who shall
hereafter plant any tree or trees on the parkway of any of the
public streets of the Village of Mount Prospect, without first
obtaining a permit therefor, as hereinbefore provided, or who
shall after obtaining such permit, plant trees of a different
variety than those specified in the permit, shall,be guilty of
a misdemeanor and upon conviction thereof, be subject to a fine
of not less than FIVE DOLLARS ($5.00) nOr more than FIFTEEN
DOLLARS ($15.00) for each offense.

SECTION 5. This ordinance shall be in full force and
effect from and after its passage and approval and posting, as
required by law, and shall be known as Brdinance No.
