Be it Ordained by the President and Bo~d of Trustees of the
Village of Mount Prospect, Illinois:
SECTION 1. No person,firm or corporation shall conduct any
business, occupation, calling or employment hereinafter specified with-
in the Village of Mount Prospect, without first having secured a
license do to do.
SECTION 2. All persons, firms or corporations conducting or
engaging in any of the following businesses, occupations, callings or
employments, are hereby required to obtain a license and pay in ad-
vance to the Village Clerk therefor, the amounts set opposite thereto,
for the periods hereinafter specified, to-wit:-provided, however, that
no person, firm or corporation aforesaid, except auctioneers, and own-
ers and operators of public dance halls, theaters, moving picture or
otherwise, and other shows and amusements~ shall be required to pay
an amount exceeding Sixty Dollars ($60.00) per year for its license
or licenses hereunder. License License

Village President to Grant and May Revoke
SECTION 3. In all cases where licenses are required to be pro-
cured,such license shall be granted by the Village President,and at-
tested by the Village Clerk, except where provision is expressly made
for the granting of licenses by some other ofricer in the Village.
The Village President shall also have power to revoke ror cause, any
license granted by him.
Subject to Ordinances
SECTION 4. All licenses shall be subject to all the ordinances
which may be in force at the time of issuing thereor, and all which
may be subsequently passed by the Village Board.
Application-Arfidavits
Section 5. All licenses authorized to be issued and required
to be procured in and by this ordinance, which are granted by the Vil-
lage P~esident, shall be issued by the Village Clerk upon instruction
or direct~pn rrom the Village President so to do. Written application
ror s~ch J.icense shall be made to the Village Clerkin each ca.se upon
blanks rurnished by him,except where otherwise specirically pro-
vided for,and a new application shall be made upon the expiration

of any license iS~d,before a new license sha~ be issued. In case the
ordinances of the Village,or in. absence thereof,the Village President
requires an investigation on ~ceipt of the application, the Village Clerk
shall, at once, proceed to make such investigation of the applicant,as is
required by the ordinance of the Village of Mount Prospect or shall
, transmi1 .such application to the proper department for such investi-
gation. f such report recommends the granting of the license, the Vil-
lage Clerk shall notify the applicant and upon payment of the li-
cense fee and the filing of a bond in accordance with the ordinance
of the Village of Mount Prospect when bond is re~ired, the ~illage
Clerk, if authorized to do so by the Village President, shall issue to
the applicant a license bearing the seal of the Village of Mount Pros-
pect for the period for which payment is made.
Term of License
SECTION 6. No license shall be granted for a less period nor for
a longer period than one year, except where otherwise specifically pro-
vided herein, and every license shall expire on the 9th day of May,fol-
lowing the date. of .its issuance. No license shall be issued for any peri-
od of time less tWin the unexpired year and at the pro rata amount of
the full. annual lic:an~e fee,except otherwise fJ-pecifically provided. The
fee for srtch license issued shall be collected in full at the time of the
issuance and delivery thereof.
No Rebate
SECTION 7. In no event shall any rebate or refund be made of
any license fee or part thereof, by reason of the death of the licensee,
or by reasOn of non-user of the license or by reason of a change of
location or occupation of such licensee.
Notice of Termination.
SECTION 8. If a license extend beyond one month,it shall be the
duty of the Village Clerk from ten to twenty days prior to the term-
inatiOn of the license period to cause a written notice to be mailed
to each licensee, directing the attention of such licensee to the fact
that a new license ~ll be required on the day following the expiration
ofMs existing license, and directing his attention also to the amount
of the license fee and to the penalty for failure to procure a license
in accordance with the provisions of the ordinance of the Village gov-
erning the issuance of such license; provided, however, that failure on
the part of the Village Clerk to cause suCh notice to be mailed to
each licensee shall not be deemed a defense to a suit brought by the
Village of Mount Prospect to recover the penalty for a violation of
the ordinance under which the license is required to be secured.
No License or Permit to Any
Person Indebted to Village
SECTION 9. Hereafter no license or permit shall be issued to
any person, firm or corporation unless such person, firm or corpora-
tion discharges and pays to the Village of Mount Prospect all indebt-
edness then due from such person,firm or corporation.
SECTION 10. The Village Clerk shall procure and keep a book to
be called the license register of the Village of Mount Prospect, in which
book he shall enter the name and location of eaah licensee, the nature
of the license granted, the date of issuance of said license,and the
date of expiration thereof, together with the amount of license fee
collected, and he shall prepare and transmit to the Village Board
monthly, a report containing said information.
Transfer of License
SECTION 11. No license granted under this ordinance shall be
assigned or transferred, except as hereinaft~r provided, nor shall any
such license authorize any person to do business or act under it but
.the person named therein. Any person to whom any license shall
. have been issued may, with the permission of the Village President,
assign and transfer the same to any other person, and the person to
whom such license issued or the assignee of such license may have a
new license issued for the unexpired term of the old license authoriz-
ing the assignee or transferee of such license to carryon the same

business or occupation at such place as may be named in such new li-
cense; provided, however, that nothing herein contained shall be held
to authorize the assignment or transfer of auctioneer's or runners'
licenses; such licenses shall be non-assignable and non-transferable.
License - Bond - Approval of
SECTION 12. Any bond given by any person or corporation to
the Village where such license bond is required under this ordinance
shall, before a license is grahted, be approved by the Village Clerk,
except where otherwise provided, and the Village Clerk shall thor-
oughly investigate the sureties on any license bond,and if satisfied
that the same are good, he shall approve such bond.
Change of Location - Notice to
Village Clerk.
SECTION 13. If any person or corporation licensed by the Village
to carEy on, engage in, or conduct any business or occupation required
to be licensed by this ordiance, and having designated to his or its li-
cense a particular place in which business so licensed is to be carried
on, engaged in, or conducted, shall,before the expiration of such li-
cense, change the location of such place of business, he or it shall
forthwith notify the Village Clerk of such fact, and no business shall
be carried on engaged in, or conducted, under the authority of such

license at such new location, until notice of such change has been giv-
en as herein provided.
License To Be Posted. '
SECTION 14. Every license granted by the Village President
for the purpose of conducting any business or occupation required by
this ordinance to be licensed, and having designated therein the par-
ticular room, store, office or place in which such business so licensed
is to be conducted, shall be posted, and at all times in a conspicuous
place, so that the same may be easily seen, upon the wall of the
principal room or office of the store or pl~ce in which such licensed
business or occupation is carried on;and when such license shall have
expired, it shall be removed from such place in which it has been
posted and no license which is not in force and effect shall be
permi tted to remain posted upon the wal~ or upon any part of any
room, store, office or place of business, after the period of such li-
cense has expired.
Contents of Package To Be
Uniform
SECTION 15. No person or corporation shall, within the Village,
sell or offer for sale, or have in his possession for the purpose of sell-
ing or offering for sale, any basket,box,barrel,bag or other package
of fruit, berries or vegetables of any kind, the contents of which are
not of uniform quality and size throughout.
Sales In Bulk Excepted
SECTION 16. This ordinance shall not apply to sales in bulk,
either by the carload, by the bushel or otherwise,where such fruits
or vegetables are not sold in boxes,bags,or other packages or parcels.
Detection of Offenders
SECTION 17. Any person who shall have purchased any fruits,
vegetables or berries sold in violation of the provisions of this or-
diBRnce may produce the package or parcel containing the s~e at
the;' office of the department of health and furnish therewith an

affidavit duly subscribed and sworn to showing that said parcel was
purchased wi thin twenty-four hours from the time it is so produced and
showing that the parcel as produced contains all of the fruit, berries or
vegetables and none other, which it contained at the time of its pur-
chase;and if the department of health shall find by measuring,
weighing or inspecting the s~e that it is short in quantity or

weight, or that the same is not of uniform quantity, or
was otherwise sold in violation of the provisions of this ordinance,
it shall be and it is hereby made the duty of the department of heal th
to cause the arrest of the person so violating this ordinance or begin
suit against such vendor to recover the penalty herein provided for
such violation.
Unwholesome Vegetables and
Frui t.
SECTION 18. No person or corporation shall bring or cause to
be brought into the Village any decayed or unwholeson~ vegetables or
fruit intended to be consumed or sold or offer'd for sale for human
food, nor shall any person or corporation keep or store in the Village
any decayed or unwholesome vegetables or fruit.
Impure or Adulterated Water,
Drugs or Food
SECTION 19. No person or corporation, or any agent or employe:
tbereof, shall keep for sale, offer for sale, or exchange or shall
sell, or deliver, or expose for sale, any drugs not conforming to the
rules and standards of United States pharmacopaeia, or any water
or liquids or foods which shall be impure, unwholesome or adulterated
or to which any harmful or injurious foreign substance has been added.
SECTION 20. Every person who is the owner, lessee, or occu-
pant of any room, stall or place where any meat fish or vegetable
designed or held for human food shall be stored or kept or shall be
held or offered for sale shall put and keep such room, stall or place
and its appurtenances in a clean and wholesome condition.
Bread To Be Made of Wholesome
Ma terial.
SECTION 21. All bread made or procured for the purpose of sale,
sold or offered for sale in the village shall be made in a clean and
sanitary place, of good and wholesome flour or meal, and shall contain
no deleterious substance or material.
Foods To Be Kept Sanitary.
SECTION 22. Any and all food stuffs served in any bakery, deli-
catessen store or other establishrrlent shall be prepared of materials
which are wholesome and free from decomposition or contamination, and
any and all places where such food stuffs are displayed, offered, pre-
pared, cooked or served as food shall be protected from dust, flies,
rodents or other contamination and shall be kept clean and sanitary.
The room or rooms shall be light and well ventilated, and the floors,
walls, ceilings and tables shall be smooth and f rea from contaminating
surroundings.
Dishes To Be Cleaned.
SECTION 23. Every glass, cup, dish and other eating or drinking
vessel or utensil, used in OT' at any hotel, restaurant, drug store, soda
fountain or other place of public refreshment in the village shall be
thoroughly cleansed in running water, or in clesn water, after each and
every use thereof by a patron, and before any further use thereof in
eating or drinking by any other patron, no such glass, cup, dish or
other eatircg or drinking vessel or utensil, after use by one patron in
eating or drinking, shall be offered or permitted to be used by any
other patron without such glass, cup, dish or other eating or drinking
vessel or utensil, having been first thoroughly cleansed in running
wa ter or cle an water. .
Necessary Protection For Food
SECTION 24. It shall be unlawful for any person, firm or corpora-
tion to store or keep for the purpose of selling, or to expose or offer
for sale, or to transport, conveyor carry from one place to another
any food for human consumption or other food sold or produced for the

purpose of selling, offering or exposing the same for sale in the village,
unless such food is protected from dust, dirt, flies, vermin, rats
mice, dogs, cats, promiscuous handling and other contamination.
Market, Stables, Etc., Must Be Kept Clean.
SECTION 25 . Every keeper of a meat market or dealer in meats,
and every person owning, leasing or keeping any place, room or building,
for handling meat, shall keep such place, room, building, stall or
market, and the yards and appurtenances to be thoroughly cleansed and
purified, and all offal, blood, fat, garbage, refuse and unwholesome or
offensive matter to be therefrom removed at least once every twenty-four
hours after the use thereof for any of the purposes herein referred to
and shall also, at all times, keep all woodwork, save floors and counters
in any building, place or premises aforesaid, thoroughly painted or
whi tewashe d.
Dogs in stores Prohibited.
SECTION 26. It shall be unlawful for the owner of, or the person
having the care or custody of a dog, to suffer or permit such dog to
enter any store, meat market, bakery or other place, where food stuffs
are sold, or on display, provided that the person owning or operating
such store or place may permit a watch dog to remain therein, if chained
or bound in such a way that such dog cannot come in contact with any of
said food stuffs.
THE SALE OF UNWHOLESOME FOODS PROHIBITED
SECTION 27. It shall be unlawful for any person, fQrm or cor-
poration to use in any food establishment, or to bring into or keep
in the same, with the intention of selling any food, condiment, con-
fection or drink, which is unclean, unwholesome, tainted, putrid, de-
cayed, adulterated, poisoned, infected or in any other manner rendered
unsafe or unwholesome for human food. For the purposes of this section,
such foods shall be deemed unwhole some for human food, if the same
have been contaminated by flies, or other insects, vermin, dust, dirt,
or other foreign contamination, or if they contain any poisoned or
injurious ingredients in kind and quantities so as to render such
articles injurious or detrimental to health, or if such articles are,
or have been, submerged in brine or ether solutions, which are unclean,
sour, putrid, spoiled or contaminated.
Misrepresentation of Kind or Quality of
Food.
SECTION 28. No meat, fish, vegetables or milk or other article
of human food or drink shall knowingly be bought, sold, held, offered
for sale, labeled, or any representation made in respect thereof, under
a false name or quality, or under any false representation whatsoever,
respecting its or their wholesomeness, soundness or safety for food or
drink.
Sanitary Conditions of Food Establishments.
SECTION 29. All food establishments shall be kept in a clean
and wholesome condition, dry and adequately ventilated, so as to in-
sure a free circulation of fresh air at all times. Where natural
ventilation is used, it shall be furnished by means of windows, doors
and apertures opening to the outer air at places sufficiently removed
from other openings, so that no odors, exhalations, moistures or other
impurities will contaminate the air required for ventilating purposes
in such food establishments. Where artificial or mechanical means of
ventilation are used, the same shall be subject to the approval of the
Department of Health and shall be maintained and subject to periodical
inspections by the Department of Health, in order to determine that
the same is kept in proper operating conditions, and so operated at
all times. Such places shall be kept free from rats, mice, flies and
other insects and vermin.

Sanitary Requirements for Barber Shops
and Beauty Parlors.
SECTION 30. It shall be the duty of every person, firm or cor-
poration, licensed to conduct a barber shop or beauty shop, to at all
times keep the premises where such establishment is conducted, in a
clean and proper sanitary condition. All necessary measures shall be
taken to properly safeguard the life and health of all patrons and of
all persons employed therein, against communicable and contagious diseases
Ventilation of Places of Business.
SECTION 31. No person owning or operating any of the businesses
mentioned in Section 2 hereof, or pursuing any of the occupations, callin83
and employments mentioned in section 2 hereof, shall cause, permit or allow
the same, or any portion or' part thereof, or any room wi thin which said
business is conducted, or occupation, calling or employment is pursued
to be overcrowded, inadequate, faulty or insufficient, in respect to
light, ventilation, heat and cleanliness; and in every building, or
apartment or room in any building, in which such business is conducted,
or occupation, calling or employment is pursued where one or more
persons are employed at least five hundred cubic feet of air space
shall be allowed for each and every person employed therein, and fresh
air shall be supplied by ventilation at the rate of four complete
changes of air per hour, during the hours of employment. No part of
such air supply shall be taken from any cellar or basement.
Inspection of Establishrnents.
SECTION 32. Every person, individual, or corporation conducting
any of the businesses mentioned in Section 2 hereof, or pursuing any
of the occupations, callings and employments mentioned in Section 2
hereof, shall allow the Department of Health and its duly authorized
employees to freely and fully inspect the place, in which such business
is carried on, or such occupation, calling or employment is pursued,and
shall answerall reasonable and proper questions asked by such officers,
relative to the condition thereof and the manner of conducting said
business or pursuing said occupation, calling or employment.
Duty of Inspectors.
SECTION 33. It shall be the duty of the Department of Health
or its duly authorized agents .or employees to enter any or all
premises used in conducting any of the businesses mentioned in Sec-
tion 2 hereof, or used in pursuing any of the occupations, callings or
employmen ts mentioned in section 2 hereof, f or the purpose of inspec ting
the sanitary conditions, under which such business is conducted or such
occupation, calling or employment is pursued, and for the purpose of
determining whether or not the regulations in this ordinance contained
are being complied with, and if upon inspection, it is determined that
any of the provisions of this ordinance have been, or are being violated,
such violation shall be reported to the proper officers for the institu-
tion of proper proceedings against such offender, or offenders.
SECTION 34. If any clause, sentence, paragraph, or part of this
ordinance shall for any reason be adjudged by any court of competent
jurisdiction to be invalid, such judgment shall not affect, impair,
or invalidate the remainder of this ordinance, but shall be confined in
its operation to the clause, sentence, paragraph or part thereof di-
rectly involved in the controversy in which such judgment shall have
been rendered.
SECTION 35. Any person, firm or corporation who shall violate
any of the terms or provisions of this ordinance, or who shall~ail,
neglect or refuse to comply with any of the foregoing provisions of
this ordinance shall~ on conviction,be fined in a sum not less than
three dollars ($3.00j nor more then two hundred dollars ($200.00)
for each and every offense.

SECTION 36. All ordinances.. or parts of ordinances conflicting
with the provisions of this ordinance are hereby repealed so far as
they conflict here~ the
SECTION 37. This ordinance shall be in full force and effect
and after its passage, approval and publication according to law.i
SECTION 38. This ordinance shall be known as Ordinance NO.15~.
