An ORDINANCE Repealing an Ordinance Entitled:

proving portions of the following streets, to-wit: Central

Evergreen Avenue, and Busse Avenue", Passed by the Board of
Trustees of the Village of Mount Prospect, Illinois, on
the 7th day of May, A.D. 1929, and Approved by the President
of said Board on the 7th day of May, A.D. 1929.
~~REAS, heretofore, the President and Board of
Trustees of thisVillage passed and approved an ordinance
providing for grading, paving,curbing and draining Central

Avenue and other streets and avenues in theVillage of Mount
Prospect, Illinois;
AND WHEREAS, afterwards, on May 25, 1929, there
was filed a petition in the County Court of Cook County for
the levying of special assessment to pay for the cost of the

improvements described in said ordinance, which petition is
still pending in the said County Court of Cook County, en-
titled: In the Matter of the Village of Mount Prospect,
Special Assessment Proceeding No. 49;
AND WHEREAS, afterwards, certain property Owners
filed objections to said proceeding and no further steps were
taken in sa.id proceeding for the hearing thereupon, nor the
cQnstruction of said improvement;
AND WHEREAS, the desirability and necessity for

said improvement no longer exists, and certain of the pro-

party owners proposed to be assessed for said improvement
have asked that said proceedings be dismissed;
AND WHEREAS, the President and the Board of Trustees
of this Village believe it to be for the best interests of the
Village and the property owners interested that said proceedings

in the County Court be dismissed, and said ordinance for
said improvement repealed;
AND WHEREAS, said assessment was only confirmed
against the portion of said property involved, and no con-
tract was ever let for the construction of said improvement,

and no part thereof has ever been constructed;
NOW, THEREFORE, be it ordained, by the President
and Board of Trustees of the Village of Mount Prospect,
Illinois:
SECTION I: That the erdinance entitled: "An
Ordinance providing for an improvement consisting of the
grading, paving, curbing, draining and otherwise improving
portions of the following streets, to-wit: Central Avenue,
Can-Dota Avenue, Lincoln Avenue, Milburn Avenue, Evergreen
Avenue,and Busse Avenue", passed by the President and Board

of Trustees of the Village of Mount Prospect, Illinois, on
the7th day of May, A. D. 1929, and approved by the President
of saidVillage on mhesaid 7th day of May, A. D. 1929, and
known as ordinance No. 49, be and the same is hereby repealed.
SECTION II: That the attorney for said Vil~ge
be instructed and directed to cause all proceedings had and
orders entered in the matter of the petition pending in the
County Court of Cook County for the confirmation of a
special assessment on said ordinance to be vacated and set
aside, and said petition dismissed.
SECTION III: That the repeal of said ordinance and
the dismissal of said petition in said County Court shall not
be a bar to said Village of Mount Prospect in any proceeding
of the same or a similar nature in the future for the con-
