An ORDINANCE Repealing an Ordinance Entitled:

Board on the 7th day of May, A. D. 1929.

WHEREAS, heretofore, the President and Board of
Trustees of this Village passed and approved an ordinance
providing for the construction and installation of a con-
nected system of cast iron water supply pipes including
gate valves, valves boxes, fire hydrants and all necessary
fittings, in portions of the following streets: Centr&
Avenue and Can-Dota Avenue, etc., in the Village of Mount
Prospect, Illinois;
AND WHEREAS, afterwards, on May 25, 1929, there
was filed a petition in the County Court of Cook County for
the levying of special assessment to pay for the cost of the
improvements described in said ordinance, which petition is
still pending in the said County Court of Cook County, en-
titled: In the Matter of the Village of Mount Prospect,
Special Assessment Proceeding No. 51;
AND ~REREAS, afterwards, certain property owners

filed objections to said proceeding and no further steps
were taken in said proceeding for the hearing thereupon,
nor the construction of said improvements;
AND WHEREAS, the desirability and necessity for
said improvement no longer exists, and certain of the pro-

perty owners proposed to be assessed for said improvement
have asked that said proceeding be dismissed;
AND VffiEREAS, the President and the Board of Trustees
of this Village believe it to be for the best interests of the
Village andthe property owners interested that said proceeding
in the County Court be dismissed, and said ordinance for

said improvement repealed;
AND VffiEREAS, said assessment was never confirmed
and no contract was ever let for the construction of said im-
provement, and no part thereof has ever been constructed;
NOW, THEREFORE, be it ordained, by the President
and Board of Trustees of the Village of Mount Prospect, Illinois:
SECTION I: That the ordinance entitled: "An ordi-
nance providing for an improvement consisting of the construct-
ion and installation of a connected system of cast iron water
supply pipes including gate valves, valve boxes, fire hydrants
and all necessary fittings, in portions of the following
streets, to-wit: Central Avenue, Can-Dota Avenue, etc.",

passed by the President and Board of Trustees of the Village
of Mount Prospect, Illinois, on the 7th day of May, A. D. 1929,
and approved by the President of said Village on the said 7th
day of May, A. D. 1929, and known as ordinance No. 51, be and
the same is hereby repealed;
SECTION II: That the attorney for said Village be
instructed and directed to cause all proceedings had and
orders entered in the matter of the petition pending in the
County Court of Cook County for the confirmation of a special
assessment on said ordinance to be vacated and set atde,and

SECTION III: That the repeal of said ordinance and
the dismissal of said petiton in said County Court shall not

be a bar to said Village of Mount Prospect in any proceeding
of the same or a similar nature in the future for the con-
struction of said or a similar improvement.
SECTION IV: This ordinance shall be in full force
and effect from and after its passage and approval.
Passed this 4th day of April, A.D. 1903.
