AN ORDINANCE REGULATING AND CONTROLLING MOTOR VEHICLE
TRAFFIC IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS.
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF MOUNT PROSPECT, COUNTY OF COOK AND STATE OF
ILLINOIS:
SECTION 1. DEFINITIONS. Whenever in this ordinance the

AUTHORIZED IDlERGENCY VEHICLE.
Any vehicle of the Fire
Department, Fire Patrol, Police Department, and any ambulance
and any other emergency vehicle of a governmental agency.
BUSINESS STREET.
The length of any street between street

said street is occupied by buildings in use for retai:L,or whole-
sale business, by hotels, banks, or office buildings, by railway
stations, or by public buildings excepting schools.
CROSSWPXK. That portion of a roadway ordinarily included
within the prolongation or connection of sidewalk lines at
intersections, or any other portion of a roadway clearly indi-
cated for pedestrian crossing by markings on the surface.
INTERSECTION. The ar~a embraced within the prolongation
or connection of the property lines of two or more streets which
join at an angle, whether or not one such street crosses the
other.
LOADING ZONE. The space adjacent to a curb reserved for
the exclusive use of vehicles during the loading or unloading of
passengers or materials.
I MOTOR VEHICLE. Every vehicle, as herein defined, which

with this ordinance, placed or erected by authority of the
Commissioner of pUblic Works or a public body or official having

PARKING. The standing of a vehicle, whether occupied or I

not, upon a roadway, otherwise than temporarily for the purpose I
of and while actually engaged in loading or unloading, or in I

obedience to traffic regulations or traffic signs and signals. i

PROPERTY LINE.

RIGHT OF WAY. The privilege of the immediate use of the
street or highway.
ROADWAY. That portion of a street or highway between the
regularly established curb lines or that part improved and in-
tended to be used for vehicular travel.
SAFETY ZONE. The area or space officially set~part with-
in a roadway for the exclusive use of pedestrians and which is

I protected or is so marked or indicated by adequate signs as to be
I

I plainly visible at all times while set apart as a safety zone.

lines and the adjacent property lines.
STREET OR HIGHWAY. Every way or place of Whatever nature

For the purpose of this ordinance a bicycle shall be deemed a
vehicle.
PARKWAY.
That portion of the public way lying between
the regularly established curb line and the adjacent sidewalk
line on the roadway side.

SECTION 2. AUTHORITY OF POLICE. COMPLY WITH DIRECTIONS.
Operators of all vehicles must at all times comply with any
direction, by sign or otherwise, of any police officer, as to
placing, stopping, starting, approaching or departing from any
place; the manner of taking up or setting down passengers, and
loading goods in any place. Any operator violating any of the
provisions of this section shall be fined in asum not exceeding
$200.00.
SECTION 3. CHAIRMAN OF THE POLICE COWUTTEE AUTHORIZED
TO ADOPT REQULATIONS. The Chairman of the Police Co~~ittee is
hereby empowered to make and enforce temporary regulations to
cover emergencies or special conditions.
SECTION 4. POBLIC EMPLOYEES TO OBEY TRAFFIC REGULATIONS.
The provisions of this ordinance shall apply to the operator of
any vehicle owned by or used in the service of any governmental
agency, and it shall be unlawful for any said operator to violate
any of the provisions of this ordinance, except as otherwise

SECTION 5.
EXEMPTION TO AUTHORIZED EMERGENCY VEHICLES.
The provisions of this ordinance regulating the movement, parking
a.nd standing of vehicles shall not apply to authorized emergency
vehicles as defined in this ordinance while the operator of such
vehicle is operating the same in an emergency in the necessary
performance of public duties.
This exemption shall not, however,
protect the operator of any such vehicle from the consequences
of reckless disregard for the safety of others.
SECTION 6.
STOPPING AND TURNING.
No operator of a
vehicle shall suddenly stop, slow down or attempt to turn without
first signalling his intention so to do with outstretched arm

violating any of the provisions of this section shall, on con-
viction, be fined in a sum not exceeding $100.00.
SECTION 7. COMPLY WITH SIGNS. Any operator of a vehicle,
or other conveyance, who shall fail or neglect to comply with any
sign, light, signal, signal device or reflector for the regula-

; tion and direction of traffic in the Village of .aunt Prospect,
shall be fined not less than $1.00 and not more than $200.00 for
each offense.
SECTION 8. SIGNS AND SIGNALS. The Chairman of the
Police Committee, by and with the consent of the Board of Trustees,
shall determine and designate the character of all official signs
and signals and to make regulations necessary to make effective

I provisions of this ordinance except as provided in Section 5
hereof.

SECTION 10. TRAFFIC SIGNAL LEGEND. Vfuenever traffic at
any intersection is regulated by an official traffic signal, the
following colors shall be used and none other, and the colors

SECTION 11. DISPLAY OR UNAUTHORIZED SIGNS PROHIBITED.
It shall be unlawful for any person to place or maintain or to
display any device upon or in view of any street, if such device
purports to be, or is an imitation of, or resembles, an official
traffic sign or signal, or directs or purports to direct the
movement of traffic, or which hides from view or interferes with
the effectiveness of any official traffic sign or signal, except-
ing such signs for which permits have been obtained from the
Chairman of the Police Committee. The Chairman of the Police
Committee is hereby authorized to issue such permits and to
prescribe the conditions thereof. Any such prohibited device is
hereby declared to be a public nuisance and the Chairman of the
Police Committee may remove it or cause it to be removed,without
, notice.
SECTION 12. INTEfitERENCE WITH OFFICIAL TRAFFIC SIGNS AND
SIGNALS PROHIBITED. It shall be unlawful for any person wilfully
to deface, injure, move or interfere with any official sign or
signal.
SECTION 13. CROSSWALKS AUTHORIZED. The Chairman of the
Police eommittee is hereby authorized to establish and maintain

crossing the roadway.
SECTION 14.
SAFETY ZONES AUTHORIZED.
The Chairman of
the Police COmIni ttee by and wi th the consent of the Board of
Trustees, 1s hereby authorized to establish and maintain signs,
paint marks or other material, safety zones at such street car
stops and other places as may in his discretion require such
safety zones.

SECTION 15. TRAFFIC LANES AUTHORIZED. The Chairman of
the police Committee, by and with the consent of the Board of
Trustees, is hereby authorized to mark traffic lanes upon the
roadway where a regular alignment of traffic is necessary. Vfuere
such lanes have been marked and signs have been erected instruct-
ing operators to keep in line, it shall be unlawful for any
operator to fail or refuse to keep his vehicle within the desig-
nated boundaries.
SECTION 16. PEDESTRIANSt RIGHT OF WAY. (a) The operator
of any vehicle shall yield the right of way to a pedestrian
crossing the roadway within any marked crosswalk or within any
unmarked crosswalk at the end of a block, except at intersections
where the movement of traffic is being regulated by police
officers or traffic control signals, or at any point where a
pedestrian tunnel or overhead crossing has been provided.
(b) Whenever any vehicle has stopped at any crosswalk
to permit a pedestrian to cross the roadway, it shall be unlaw-
ful for the operator of any other vehicle approaching from the
rear to overtake and pass such stopped vehicle.
(c) Any pedestrian crossing a roadway at any point
other thanwlthin a crosswalk shall yield the right of way to
vehicles upon the roadway.
(d) The provision of this section shall not relieve an I
operator of a vehicle or a pedestrian from the duty ~o exercise
due care.
SECTION 17. PEDESTRIANSt RIGHTS AND DUTIES AT CONTROLL D
INTERSECTIONS. At intersections where traffic is controlled by
official traffic signals or by police officers, operators of
vehicles shall yield the right of way to pedestrians crossing or
those who have started to crosS the roadway on a green or "Go"

Ii signal, and in all other cases pedestrians shall yield the right

I It shall be unlawful for any person to stand in a roadway for

I SECTION 19. APPROACHING PERSON OR ANIMAL. Opon approach-

I ing a person waIting upon or along a street, or a horse or horses,

I or other draft or domestic animal or animals being ridden, led

lor driven thereon, the operator of a vehicle shall give reason-

Ii able warning of his approach and use every reasonable precaution
II to avoid injuring such person, or frightening or injuring such
J horse, horses, or other draft or domestic animal, or animals, and,

SECTION 18.
PEDESTRIANS SOLICITING RIDES OR EMPLOYMENT.
if necessary, stop his said vehicle until he can safely proceed,
and in case of any injury to a person or property on the street
due to the presence or op;eration of a vehicle, the operator of
such vehicle shall stop and, upon the request of a person 1n-
I jured or any person present, give his name and address, and, if

II SECTION 20:" STOPPING, STANDING AND PARKING. STANDING
II FOR LOADING OR UNLOADING ONLY IN CERTAIN PLACES. (a) The

It shall be unlawful for the operator of a vehicle

ing of passengers and in no case for a period longer than three
minutes.
(c) It shall be unlawful for the operator of a vehicle
to stoPt stand or park said vehicle in any place marked as a
loading zone other than for the expeditious loading or unloading
. of passengers, or for the unloading and delivery or pick-Up and

i loading of materials and in no case shall the stop for loading

I and for unloading of materials exceed thirty (30) minutes.

I The Chairman of the police Committee shall designate
loading zones and passenger zones by placing and maintaining
suitable signs or markings.
SECTION 21. STOPPING PROHIBITED IN SPECIFIED PLACES. It

(4) within twenty-five (25) feet of an official traffic
signal or a through street sign on the approaching side;
(5) Within twenty-five feet from the intersection of
curb line, or, if none, then within fifteen feet of the inter-
section of ~roperty lines at an intersection, except at alleys;
(6 At any curb within fif'teen feet of a fire hydrant;
(7 At any place within twenty (20) feet of the entrance
to any fire station, and on the side of any street opposite the
entrance to any fire station within seventy-five (75) feet of
said entrance;
(8) At any place where the standing of any vehicle will
block the use of any driveway;
19) On any sidewalk;
{lO) Alongside or opposite any street excavation or ob-
structions when such stopping, standing or parking would obstruct
traffic;
(11) On the roadway side of any vehicle stopped or parke
at the ed~e or curb of a street;
t12) At any place where official traffic signs have been
erected prohibiting stopping, standing and parking;

(13) Within fifty (50) feet of the nearest rail of a
interurban railway crossing;
(14) On any pa.rkway; or to use said parkway, or any
thereon, for turning purposes or as an aid thereto.
SECTION 22. OTHER VEHICLES PROHIBITED FROM PARKING IN BOS
OR TAXICAB STANDS. It shall be unlawful for the operator of any
steam or
vehicle other than a bus to stand or park in a bus stand estab-
lished in accordance with the terms of this ordinance, or for
any vehicle other than a taxicab to stand or park in a taxicab
stand established in accordance with the terms of this ordinance,

except that the operator of any passenger vehicle may te~porarily
stop in any such stand for the purpose of and while actually
engaged in the loading or unloading of passengers.
SECTION 23. BOSES AND TAXICABS PROHIBITED FROM PARKING
EXCEPT IN DESIGNATED STANDS. It shall be unlawful for the
operator of any bus or taxicab to stand or park upon any street
in any business district at any place other than at a bus stand
or taxicab stand, except that this provision shall not prevent
the operator of any such vehicle from temporarily stopping in
accordance with other stopping or parking regulations at any
place for the p~rpose of and while actually engaged in loading
or unloading passengers.
SECTION 24. PARKING PROHIBITED IN CERTAIN PLACES. It

shall be unlawful for the operator to stop, stand or park any
vehicle upon a street other than an alley, in such a manner or
under such conditions as to leave available less than ten (10)
feet of the width of the roadway for free movement of vehicular
traffic, eXcept upon anyone-way street and further, except that
an operator may stop temporarily during the actual loading or I
unloading of passengers or when necessary in obedience to traffic

regul8tions or official traffic signs or signals or a police
officer.

side wheels of the vehicle within six inches of the edge of the
roadway, except as provided in the following paragraphs:
(b) In places where, and at hours when, standing for th
loading or unloading of merchandise or materials is permitted,
vechiles used for the transportation of merchandise or materials
may back into the curb to take on or discharge loads, when the
owner of such vehicle holds a permit granting him such special
privilege, and provided further that such permit shall be either
in the possession of the operator or on the vehicle at the time
such vehicle is ba~~ed against the curb to take on or discharge
a load, and it shall be unlawful for any owner or operator to
violate any of the special terms or conditions of any such special
permit.

\(c) The Cbairman of the Police Committee is hereby
authorized to issue, to any owner of a vehicle used to transport
merchandise or materials, a special permit, renewable annually,
and to state therein the terms and conditions thereof, allowing
the operator of such vehicle the privilege of loading and un-
loading while the vehicle is backed against the curb, if in the
opinion of the Chairman of the Police Committee such privilege
is reasonably necessary in the conduct of the owners' business
and will not seriously interfere with traffic.

No person, firm or corporation, controlling, driving or operating
any vehicle, shall cause or permit any such vehicle to stand or

in front of the entrance of any hotel, nor within a space of
fifty feet immediately in front of the entrance of any theatre
during hours when such theatre is open for business, unless
otherwise specified by official signs.

SECTION 30.
DRIVING ALONG PARKWAY OR SIDEWALKS PRO-
HIBITED. It shall be unlawful to drive any vehicle or bicycle
over or along any parkway, curb or sidewalk in this city.
SECTION 31. OPERATION OF VEHICLES. TURNING AT INTER-
SECTIONS. The operator of a vehicle intending to turn at an
intersection shall do so as follows:
(a)

(b) Approach for a left turn shall be made in the lane

of such center line where it enters the intersection, and upon
leaving the intersection by passing to the right of the center
line of the roadway then entered, unless otherwise directed by

SECTION 33.
OPERATORS' SIGNALS.
No operator of a
vehicle shall suddenly leave a parking space, slow down, stop or I

attempt to turn without first giving a signal with outstretched a~

affected by his action, of his intention so to do.

SECTION 34. DRIVING FROM ALLEYS, DRIVEWAYS OR GARAGES. I
The operator of a vehicle emerging from an alley, driveway or
garage shall stop such vehicle immediately prior to driving on tol

a sidewalk, or across a sidewalk line projected across such alley

in driving upon said sidewalk or across such line.
SECTION 35. THROUGH STREETS. The following streets and
parts of streets are hereby declared to constitute through streets
for the purpose of this section:
MAIN STREET, also known as ELMHURST ROAD, and
NORTHWEST HIGHWAY.
Every operator of a vehicle or other conveyance, travel-
ing upon any street where stop signs have been erected at or near
the intersection of any other street, shall stop such vehicle or
other conveyance at the place where such street meets the prolong-
ation of the nearest property line of such intersecting street
before entering upon or crossing such intersecting street, subject,
however, to the direction of any traffic control sign or signal
or any police officer at such intersection.
SECTION 36. (a) ESTABLISHING STOP SIGNS AND THROOGH
STREET DEVICES. The Chairman of the Police Committee, by and
with the consent of the Board of Trustees, is hereby authorized
and required to place and maintain or cause to be placed and
maintained at each and every street intersection of through and
stop streets and at or near the property line of each through and
stop street, appropriate signs upon the street (and in addition
thereto may place and maintain any proper devices or marks in the

roadway) such signs, devices or marks to bear the word "Stop"
and to be located in such a position and to be provided with
letters o~ a size to be clearly legible along the street inter-
secting the through or stop street.
All such signs shall be

illuminated at night or so placed as to be illuminated by the
headlights of an approaching vehicle or by street lights.
(b) The Chairman of the Police Committee, by and with the
consent of the Board of ~~stees, is hereby authorized to place
and maintain or cause to be placed and maintained, stop signs
conforming with the specifications of sub-section (a) of this
section, at the approaches to such intersections as it may deem
sufficiently dangerous to warrant requiring all vehicles from
this direction to stop before entering such intersections and it
shall be unlawful for the operator of any vehicle to fail to
comply with such stop requirements.
SECTION 37. VEHICLES NOT TO BE DRIVE~ ON SIDEWALKS OR
PARKWAYS. No operator of a vehicle shall drive within any side-
walk area or parl{way except at a permanent or temporary driveway.
SECTION 38. RIGHT OF WAY. (1) In making a left turn at
intersections of highways, motor vehicles shall give the right
I of way to motor vehicles approaching from the opposite direction.
i (2) Except as hereinafter provided, motor vehicles

I traveling upon streets of this village shall give the right of way

(3) Vehicles entering a through highway. The operator of

down on any street, private driveway, to be used at any fire or

SECTION 47. OSE OF COASTERS, SLEDS .AND SIMILAR DEVICES.
It shall be unlawful for any person, upon skates, or riding in or
by means of a coaster, sled, or toy vehicle, to go upon any
roadway other than at a crosswalk.
SECTION 48. MOTOR VEHICLES ONATTENDED. No vehicle shall
be left unattended while the motor of said vehicle is running, and
when standing upon a perceptible grade without turning the wheels
of such vehicle to the curb or the side of the street or highway.
SECTION 49. POSITION OF SLOW VEHICLES. Slow moving
vehicles and all vehicles designed and used for the pulling or
hauling of freight and all vehicles designed and used for the
carrying of more than seven passengers, and all bicycles, must be
. operated as close to the right-hand side of the roadway as con-
ditions of traffic permit.
SECTION 50. OVERTAKING A VEHICLE. Except as otherwise
provided in this ordinance, the following rules shall govem the

operated upon any street unless the same is provided with a
muffler in efficient and actual working condition and the use of
a cutout is forbidden.
SECTION 66.

It shall be unlawful to operate any
motor vehicle upon any street unless said vehicle is equipped
with good and sufficient brakes in efficient working condition,
or to operate any vehicle which is so loaded that the operator
does not have ready access to the mechanism operating the brakes
of said vehicle.
SECTION 67.
LIGHTS.
When upon any street in this village

SECTION 72. PROJECTING LOADS. No vehicle shall have any
part of its load projecting beyond the front end of said vehicle
nor projecting more than thirteen feet beyond the center line of
the rear axle of sa! d. vehicle, and no load shall proj ect beyond
the rear end of the bed or body of any vehicle, exclusive of the
tail gate when lowered, a greater distance than three-fifths of
the total length of such bed or body.
SECTION 73. WARNING ON PROJECTING LOADS. Any vehicle
having a load projecting more than four (4) feet beyond the rear
of the body of said vehicle, between the hour of sunrise and the
hour of sunset, must have firmly attached to the extreme rear

drive the same over or through a safety zone as defined in this
ordinance.

SECTION 82. PARTIAL INVALIDITY. The invalidity of any
portion or section of this Ordinance shall no~ affect the

ordinances which are in conflict with or contrary to the provision$
of this ordinance are hereby repealed.
SECTION 84. This Ordinance shall be of effect from and
after the date of its passage and due publication.
