HomeMy WebLinkAboutOrd 236 12/16/1943 ORDINANCE OREATING A ZONING COMMISSION OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY. ILLINOIS. #- ~ BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: Section 1. The President and Board of Trustees shall appoint a Zoning Commission consisting of five (5) members, to serve for such period of time as shall be designated at the time of their appointment. One of the members so appointed shall be designated by the President and Board of Trustees as the Chairman of the Zoning Commission at the time of his appoint- ment and he shall hold his office as such Chairman during the time of his appointment as a member of said commission. Section 2. The Zoning Commission shall conduct public hearings whenever the regulations imposed and the districts created by the zoning ordinance of the Village of Mount Prospect are sought to be amended. At least fifteen (15) days' notice of the time and place of the hearing shall be published in the official paper of or a paper of general circulation in the Vil- lage of Mount Prospect. After such public hearing the proposed amendment of the regulations imposed and the districts created shall be presented by the Zoning Commission to the Board of Trustees. Written protest ag~inst any proposed amendment of the re~ulations or districts, signed and acknowledged by the owners of 20% of the frontage proposed to be altered, or by the owners of 20% of the frontage immediately adjoining or across an alley therefrom, or by the owners of 20% of the frontage directly opposite the frontage proposed to be altered, may be filed with the Clerk of the Village of Mount Prospect at any time before the proposed amendment she.ll be acted upon by the Board of. Trustees, and in such case the amendment shall not be passed except by a favorable vote of two-thirds of all the members of the Board of Trustees. Section 3. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby re- pealed. Prospect and Des Plaines in the one ,and one-half~8s of influence of those communities in county zoning matters. Prospect Village Board, .and the Chairman of the 'l4t. Prospect Planning Commission. It was :agreed at this meeting that the overlapping area in question would be divicied, insofar as Mt. Prospect and Des plaines is concerned, -as follows: starting ata point due south of the s.e. corner of the RQb Roy Golf course aM one and one-half' miles from Des p:Laines City limits, proceed south to that city limits at Central Road, west to It. Prospect Road, south to a. point just south of Northwest Highwq where the limits of Des Plainesud lit. Prospect bave bOUDdary in common; follow this common boundary ,around the angle andapproximate~ one-f'ourth mile west, then fOllow the Des Plaines boundary south to Golf Road; thence westward into t the overlapping area &S far as point due south of' Pit. Prospect.s School street, thence south to the .arc of 14t. Prospect.s one -and one-halt' mile limit. The .a.bove-deacribed dividing-line is marked on map now on file with the City Clerk of the 'City of Des plaines. It is understood that the proper representatives of the City of Des plaines and. of' the Village of lit. Prospect will process plats, etc., cover- ing res1dentiral, or business and residential, areas, on its side of the line, and matters involving industrial or light industri.a.l undertakings in over- lapp1ng territory, ...i.lJ. in all cases be reviewed by the proper representatives of both communities. It is the recommendation of the Municipal Development Committee that the .above outlined arrangement be placed in effect as between the City of Des plaines and the Village of' lit. Prospect.
