AN ORDINANCE REGULATING TAXI
CABS

BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
ARTICLE I.
BUSINESS LICENSE

It shall be unlawful.. to'
engage in the business of operating a taxi cab in the municipality
without first having secured a license therefor. Applications
for such licenses shall be made in writing to the Clerk, and shall
state thereon the name of the applicant, the intended place of
business and the number of eabs to be operated. If the applicant
is a corporation, the names and addresses of the President and
Secretary thereof shall be given.
SECTION 2. Definition.
The term Utaxi cabtf as used in
this Ordinance shall mean and include any vehicle used to carry
passengers for hire but not operating on a fixed route.
SECTION 3. Character of a'PPlicant. No such l.icense shall
be issued to or held by any person who is not a person of good
character or who has been convicted of a felony; nor shall such
license be issued to or held by any corporation if any officer
thereof would be ineligible for a license under the foregoing
conditions.
SECTION 4. ~ 'The annual fee, payable in advance, for
such licenses shall be Ten Dollars <$10.00), for each taxi cab
operated.
The Clerk shall issue suitable tags or stickers for the
number of cabs covered by each license. Such tag or sticker shall
be displayed in a prominent pla4e on each taxi cab while it is in

use, and may be transferred to any taxi cab put into service to
replace one withdrawn from service.
The licensee shall notify the Clerk of the motor number
and state license number of each cab operated and of the corre-
sponding municipal tag or sticker number.
SECTION 5. Veb!c;J.es. No taxi cab shall be operated un-
less it bears a state license duly issued; and no such cab shall
be operated unless it is equipped with proper brakes, lights,
tires, horn, muffler, rear vision mirror, and windshield wiper
in good condition. It shall be the duty of the Chief of Police
to inspect every taxi cab so often as may be necessary to see to
the enforcement of the provisions of this section.
Each taxi cab, while operated, shall have on each side
in letters readable from a distance of twenty feet, the name of
the licensee operating it. If more than one cab is operated by
a licensee, each cab shall be designated by a different number,
and such number shall also so appear on each side of such cab.
SECTION 6. Drivers. No person shall drive a taxi cab
or be hired or permitted to do so, unless he is duly licensed as
a chauffeur.
It shall be unlawful for any driver of a taxi cab while
on duty to drink any intoxicating liquor, or to use any profane
or obscene language, to shout or call to prospective passengers,
or to disturb the peace in any way.
SECTION 7. Insurance. No taxi cab shall be operated
unless it is covered by a bond or public liability policy as re-
quired by statute.
SECTION 8..... Traffic rules. It shall be the duty of every
driver of a taxi cab to obey all traffic rules established by
statute or ordinance.

SECTION 9. Unlawful use~ It shall be 1.IDlawful to know-
ingly permit any taxi cab to be used in the perpetration of a
crime or misdemeanor.
~EC~ION 10. Passenliters. It shall be the duty of the
driver of any taxi cab to accept as a passenger any person Who
seeks to so use the taxi cab, provided such person is not in-
toxicated and conducts himself in an orderly manner. No person
shall be admitted to a taxi cab occupied by a passenger without
the consent of the passenger.
The driver shall take his passenger to his destination
by the most direct available route from the place Where the pas-
senger enters the cab.
SECTION 11. Rates of Fare. The prices or rates of
fare to be asked or demanded by the operator or owner of any such
vehicle shall not exceed the following:
For the first one-half (1/2) mile or frac-
tion thereof, twenty-five Cents (25,);
For each additional one-half (1/2) mile or
fraction thereof Ten Cents (101);
For each three (3) minutes of waiting, Ten
Cen ts (101);
For each additional passenger Five Cents

Each public vehicle for transportation of passengers
shall be equipped With a suitable meter or register which shall
be so affixed to said vehicle as to show clearly to the passen-
ger therein the rate or charge for such service.
It is hereby made the duty of the Chief of Police to
make an inspection of each such meter or register at least once
in each six months, and as often as complaintsmay be made.
There shall be affixed on the inside of each vehicle in
a conspicuous place and in such manner that the same may be
easily and convenientlY read by any person riding in such vehi-

c1e~ a card upon which shall be printed in plai:;>., legible type,
the rates of fare provided for in this prdinance.
No charge shall be made for the carriage of any child
or children under the age of twelve (12) years when accompanied
by an adult.
Any passenger shall be allowed to have conveyed upon
any of the vehicles aforesaid, without charge, his ordinary bag-
gage; provided that ordinary hand baggage shall not be construed
to mean trunks or sample cases.
It shall be unlawful for a passenger to fail or refuse
to pay the lawful fare at the termination of a trip.
SECTION 12. Cabstands~ No unemployed taxi cab shall
stand or be permi tted to stand upon any portion of the public
streets or alleys or public ways of this Village, except for
such time as is necessary to load or unJ.,.aad passengers, excepting
in such portions of the public streets, alleys, or other public
yays of this Village as shall be from time to time de signa ted by
the President and Board of Trustees as taxi cab stands and allot-
ted to the particular licensee in question.
SECTION~" Loitering Prohib1ll.ted. It shall. be u.nl.aw-
ful for any person not the driver or operator of a public pas-
senger vehicle to sit in the front seat of any such vehicle,
with or without the presence of such driver or' operator whll.e
any such vehicle is parked at any designated cab stand.
It shall be unlawful for any person not the owner or
operator of a public passenger vehicle to ride in the front seat
of any such vehicle, except a passenger for hire, while in or
during the course of transporting a passenger to a designated
destination.

public passenger vehicle to permit any person, a passenger for
hire excepted, to sit in the front seat while at a cab stand
or to ride in the front seat with the driver while a passenger
for hire is being transported.

S~CXION 14~ No person shall drive a taxi cab Unless he
shall have secured a license therefor as herein provided.
· SECTION 15. Fee. The annual fee for a taxi cab driver's
license shall be One Dollar.
SECTION l6~ .Qualifications. Ho such license shall be
issued to any person who is not competent to operate a motor ve-
hicle or who is not familiar with the traffic laws and ordinances.
The Chief of Police shall examine each applicant for a taxi cab
driver's license to determine the competency of the applicant,
and no such license shall be issued excepting on certificate of
the Chief that the applicant has demonstrated his abmty to
operate a motor vehicle as required herein.
SECTION 17. The President may revoke any taxi cab
driver's license for repeated violations of traffic laws or or-
dinances, or of any ordinance provisions regulating the conduct
of such drivers.
ARTICLE IIJ.
CERTIFICATE
~ECTION 18. Public Vehicle Commission. There is hereby
established a public vehicles oommission which shall consist of
the President and the Board of Trustees. The President shall be
Chairman thereof.

The Public Vehicles Commission shall meet on the call of
the Chairman or of two members thereof, at such times as ma.y be
necessary to transact its business.
, SECTION 18. Certif!cate reauired~ No license to oper-
ate a taxi cab in the Municipality shall be issued unless and
until the public vehicles commission shall certify that the
public need for taxi cab service requires the additional service
to be rendered by the applicant. In deciding this question, the
commission shall consider the need of the public for taxi cab
service, the number of cabs in operation, and the anticipated
future demands.
SECTION 20. Existing Service. No such certificate shall
be required for the renewal of any operator's license.
SECTION 21. Number of Cabs. The number of taxi cabs
for which licenses may be issued to operate within the Village of
Mount Prospect, is hereby determined to be two (2).
SECTION 22. Abandonment. If any licensee on whose be-
half such a certificate has been issued shall fail to operate
all or any of the taxi cabs covered by such certificate for a
period of six consecutive days, the certificate may be revoked
or modified by the commission so as to cover and authorize only
the number of cabs actually operated.
SECTION 25. Penalty. Any person, firm or corporation
vio1ating any provisions of this ordinance shall be fined not
less than One Dollar nor more than One Hundred Dollars for each
offense; and a separate offense shall be deemed committed on each
day during or on which a vioJ.ation occurs or continues.
SECTION 24. This ordinance shall be in fullforce and ef-
fect from and after its passage, approval and pubJ.ication as
