AN ORDINANCE AMENDING CHAPTERS
3, 6, 8 and 9 of THE MOUNT
PROSPECT BUILDING CODE OF 1938.

BE IT ORDAINED by the President and Board of Trustees
of the Village of Mount Prospect, Cook County, Illinois:
SECTION 1. That Chapter :3 of the Mount Prospect Building
Code of 1938 (Ordinance No. 225), be and the same is hereby
amended by adding thereto Section 5.1, to read as follows:
5.1 In no case may a building permit be grant-
ed for the construction of any auxilia~y ~lding
such as a garage or shed on any lot until the
principal building is under construction. No per-
mit shall be granted for so-called ushell or skeleton"
buildings which are hereby defined to mean bUildings
or structures which are not completed or finished ~
at the time of occupancy.
SECTION 2. That Chapter 3 of the Mount Prospect Building
Code of 1938 (Ordinance No. 225), be and the same is hereby
amended by adding thereto Section 6.1, to read as follows:
6.1. It shall be unlawful for any contractor
or bu11der to construct more than four (4) residen-
tial buildings of the same exterior design facing
on the same street in anyone block of the Village.
SECTION 3. That Chapter 6 of the Mount Prospect Building
Code of 1938 (Ordinance No. 225), be and the same is hereby
amended by adding thereto Section 16.1, to read as follows:
16.1. Habitable rooms in a single dwelling
shall have a minimum floor area of not less than
100 square feet, provided, however, that kitchgns
for COOking purposes only, or a third bed roomlor
den may have a finished floor area of 80 square
feet. Vestibules, closets, halls and alcoves shall
not be counted as floor area of any habitable room.
Every dwelling containing a cooking stove,
sink or other equipment to prepare food by use of
heat from any source, shall contain at least one
hab~table room with a floor area of not less than
175 square feet, prOViding there is a separate din-
ing room or the kitchen contains at least 120 square
feet. If there is no separate dining room, and the

floor area of the kitchen is less than 120 square
feet, then at least one habitable room shall mea-
sure not less than 220 square feet.
A single family dwelling of one and one
half stories shall (jo{ltain a finished f19.9.1... area./ qbove
equivalent to four l4) of the habitable~~edfand
shall have a ground floor area of not l'ss than 900
square feet for a one story dwelling and 750 square
feet for a one and one-half story building and 575
square feet for a two story bUilding.
SECTION 4. That Section 17 of Chapter 6 of the Mount
Prospect Building Code of 1938 (Ordinance No. 225), be and the
same is hereby amended to read as follows:
17. Habitable rooms Shall have a ceiling height
of not less than eight (8) feet. The ceiling height
for a second story must be eight (8) feet clear;
except under sloping roofs it may be 7 feet six inches
clear for 60% of the floor area having five c.D feet
or more head room.
SECTION 5. That Section 19 ,of Chapter 6 of the Mount
Prospect Building Code of 1938 (Ordinance No. 225), be and the
same is hereby amended to read as follows:
19. Habitable rooms may not be located in a
basement of a single dwelling except recreation or
play rooms.
SECTION 6. That Section 39 of Chapter 6 of the Mount
Prospect Building Code of 1938 (Ordinance No. 225), be and the
same is hereby amended by adding thereto the following:
In no case shall a septic tank smaller than 500
gallons capacity be used in conjunction with a
garbage disposal unit. No septic tanks shall be
permitted inside of a bUilding.
SECTION 7. That Section 28 of Chapter 8 of the Mount
Prospect Building Code of 1938 (Ordinance No. 225), be and the
same is hereby amended by adding thereto the following:
Cement or concrete blocks shall not be permitted
for the construction of exterior outside walls un-
less they are painted, plastered, stuccoed, or brick
veneered.
SECTION 8. That Chapter 9 of the Mount Prospect Building

Code of 1938 (Ordinance No. 225), be and the same is hereby
amended by adding thereto Section 23.1, to read as follows:
23.1. All garages must be 10cated on the north
side of a building. Detached garages must be set
back 70 feet from the lot line and shall not be
closer than 2 feet to the dividing lot line. At-
tached garages must be 30 feet back from the lot
line and shall not be closer to the dividing lot
line than 10% of the width of the lot.
SECTION 9. All Ordinances or parts of Ordnances in con-
flict herewith be and the same are hereby repealed.
SECTION 10. Any person who shall violate any provision
of this Ordinance or fails to comply with any of the requirements
thereof, or who shall erect, construct, alter or repair a build-
ing or structure in violation thereof, shall be guilty of misde~
meanor ptin~shab1e by a fine of not less than $25.00 and not more
than $200.00, and each day such violation is permitted to exist
shall constitute a separate offense.
SECTION 11. That this Ordinance shall be in full force
and effect from and after its passage, approval and pUblication,
according to law.
