HomeMy WebLinkAboutOrd 342 04/10/1951 FlVIO* AGH 1&5c 4/9/51 ORDINANCE NO. ~~~ AN ORDINANCE LICENSING AND REGULAT- ING THE BUSINESS OF ERECTING AND MAINTAINING BILLBOARDS AND SIGNBOARDS * * * * * * BE IT ORDAINED By the President and Board of Trustees of the Village of Mount Prospect, Cook County, Illinois. SECTION 1. Definitions. "Bill Posters and Sign Painters" within the meaning of this Ordinance is hereby defined as all persons, firms or corporations engaged in the business or occupation of posting by tacking, pasting, painting, demonstrat- ing or otherwise distributing upon the public ways any advertis- ing matter, bills, posters, pictures, or any other matter or device whatever which advertises the business of any person, whether that of merchant, manufacturer, publisher, or persons engaged in any bUsiness or industrial pursuit or any operas, theaters, shows, circuses, or other exhibitions, excepting those intended for charitable purposes; provided, however, that nothing I herein contained shall be considered to apply to the painting of a store or office sign by sign painters, or to posting of legal notices by public officers or attorneys in the manner and in the places prescribed by law, or to persons who are in the business of circulating and distributing circulars, handbills or business cards by placing them inside of the doors of dwellings or build- ings within the Village limits. A "BilItboard or Poster-board" is hereb~l de- fined as a structure with a ~ertical~ or nearly vertical surface erected for the outdoor display of posters. A "Signboard" is hereb7i~ defined as a struc- ture with a vertical or nearly vertical surface, erected for the display of notices of any kind, other than posters. -2- "Exceptions" ~ The faces of the w'all or the I flat surface of the roof of a buildine or other structures used for display or pther notices, painted thereon, shall not be in- terpreted as a billboard, posterboard or signboard. SECTION 2. License Required. No person, firm or cor- poration shall engage in the business of erecting or maintaining i billboards, posterboards, signboards or signs for the purpose of display advertising within the Village of Mount Prospect without first having obtained a license therefor. SECTION 3. Boitd Required. No person, firm or corpor- ation shall hereafter erect, construct, move or a~ter or main- tain any sign or any other advertising device within the Village of Mount Prospect, unless he shall have first filed with the Village a surety bond in the sum of Ten Thousand Dollars ($10,000.00), conditioned that such p~rson, firm or corporation shall faithfully con~ly with the ordinances of the Village of Mount Prospect with reference to construction, alterations, main- tenance and safety of such billboards, posterboards, signboards and signs, and for the payment of such fees as are provided to be paid by the ordinances of the Village, and, further, to save and keep harmless the said Village and its officials from all damages, liability, losses or judgments which may be claimed or recovered by any person against said Village by reason of the erection, maintenance, removal or repair of such posterboard, billboard, signboard or sign. SECTION 4. License Fee. The annual license fee for engaging in the business or occupation of erecting or maintaining billboards, posterboards, signboards or signs shall be One Hundred Fifty Dollars ($150.00), and shall be paid in advance. Such license shall expire at the end of the fiscal year for which -3- it was issued, provided, however, that license fees shall be prorated for any portion of a fiscal year, but shall in no case be less than for a six (6) months period; provided, further, that where such work is done upon property by the owner or lessee thereof or one of his regular employees then in that event, no license shall be required, but the provisions as to bond shall not be excused. SECTION 5. Penalty. Any person, firm or corporation, violating any of the provisions hereof, shall be fined not more than One Hundred Dollars ($100.00). SECTION 6. That this Ordinance shall be in full force and effect from and after its passage, approval and publication, according to law.
