AN ORDINANCE granting a variation
from the provisions of the Mount
Prospect Zoning Ordinance.
WHEREAS, the Zoning Commission of the Village of Mount
Prospect at a public hearing duly called and held according to law
considered the request of Ethel Busse for a variation to permit the
operation of an off-street parking lot in the R-1 Residence District
on the real estate hereinafter described; and
WHEREAS, the President and Board of Trustees having considered
the recommendation of the said Zoning Commission to grant a variation
subject to conditions as hereinafter set forth, and this Board finds and
believes that the public interest will be served by such variation~
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT
AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT,
COOK COUNTY, ILLINOIS:
Section 1 r That a variation of the provisions of an ordinance
entitled ttAn Ordinance classifying, regulating and restricting the
location of trades and industries and the location of buildings designed
for specified uses; regulating and limiting the height and bulk of buildings
hereafter erected or altered, regulating and limiting the intensity of the
use of lot areas and regulating and determining the area of yards, courts
and other open sapces within and surrounding such buildings; establishing
the boundaries of districts for the said purposes and prescribing penalties
for the violation of its provisions", passed and approved December 4,
1923, known as Ordinance No. 52, as amended, be granted in the R-1

District on the following real estate:
That part of the East Half (1/2) of the Northwest Quarter
(1/4) of Section 12, Town 41 North, Range 11, East of
the Third Principal Meridian described as follows:
Beginning at a point on the South line of the East Half (1/2)
of said Northwest Quarter (1/4) 379-4/10 feet East of the
South West corner of said East Half (1/2) thence East along
said South line to a point 754-85/100 feet West of the South
East corner of said East Half (1/2) thence North parallel
with the East line of said East Half (1/2) to the South line
of the right of way of the C & N. W. Ry. Co. thence North-
westerly along said South line of Right of Way to a point
North of the place of beginning and thence South parallel
with the West line of said East Half (1/2) to the place of
beginning containing Four and Forty-three one hundred
(4-43/100) acres more or less in aforesaid Section 12,
Town 41 North, Range 11, East of the Third Principal
Meridian, excepting from above described premises the
South thirty-three (33) feet of the West 190.25 feet thereof
dedicated for public street by Plat of Friedrich Schafer1s
Addition to Mount Prospect registered as Document No.
339239; also except that part thereof described as follows:
Commencing at a point in the South line of the East Half
(1/2) of said Northwest Quarter (1/4) that is 379.40 feet East
of the South West corner of said East Half (1/2), running
thence North parallel with the West line of said East Half
(1/2) a distance of 830. 15 feet to a point of beginning; thence
continuing North along said parallel line a distance of 181.06
feet to a point in the Southwesterly line of Prospect Avenue,
said line being 50 feet Southwesterly of and parallel with the
Southwesterly right of way line of the Chicago & Northwestern
Railway; thence Southeasterly along said Southwesterly line
of Prospect Avenue, a distance of 58. 63(i) Feet thence South,
parallel with the West line of aforesaid East Half (1/2) of
North West Quarter (1/4), a distance of 150.44 feet; thence
West 50 feet to the point of beginning.
for use as an off-street parking lot on condition that the owner of said
premise s provide and dedicate a strip 33 feet wide for use as a public
street in Maple Street from Prospect Avenue to the Southerly boundary of
Lot 1 in Weber's Subdivision.
Section 2. That said real estate shall be subject to all limitations
and conditions placed upon properties designated as non-conforming uses
as defined in said ordinance heretofore mentioned.

Section 3. Any person, firm or corporation who violates,
disobeys, omits, neglects or refuses to comply with or who resists
the enforcement of any of the provisions of this Ordinance shall be
fined not less than Ten Dollars ($10.00) nor more than Qne Hundred ($100.00)
Dolla.rs for each offense, each day that a violation is permitted to exist
shall constitute a separate offense.
Section 4. That this ordinance shall be in full force and effect
from and after its passage, approval and publication according to law.
