AN ORDINANCE FOR THE IMPROVE-
MENT OF ELMHURST ROAD AND
OTHER STREETS WITHIN THE VILLAGE
OF MOUNT PROSPECT, COOK COUNTY,
ILLINOIS, BY GRADING, CURBING AND
PAVING, ETC., INCLUDING THE COST
OF FURNISHING ALL LABOR, EQUIPMENT
AND MATERIALS.
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TR USTEES OF THE VILLAGE OF MOUNT PROSPECT, COUNTY OF
COOK AND STATE OF ILLINOIS:
SECTION 1. That a local improvement shall be made within the
Village of Mount Prospect, the nature, character, locality and description
of which improvement is as follows:
That the roadway of Elmhurst Road from the
north street line of Memory Lane to the existing pavement fifty-five (55)
feet, more or less, south of the south street line of Gregory Street;
And the roadway of Russel Street from the south edge of an exist-
ing pavement ten (10) feet, more or less, north of the north street line
of Memory Lane to the existing pavement fifty-five (55) feet, more or
less, south of the south street line of Gregory Street;
And the roadway of Gregory Street from the existing pavement
located one hundred and thirty-two (132) feet, more or less, west of the
west street line of Elmhurst Road, to a point one hundred and thirty-two
(132) feet, more or less, east of the east street line of Russel Street,
except those areas lying within the roadways of Elmhurst Road and Russel
Streets;
Be improved by grading, curbing and paving, and by constructing
all neces sary storm water inlets, catch basins, and connecting pipes to
existing storm drains, together with all necessary adjustments and
appurtenances.
Details of the limits of the improvements, dimensions, positions
and elevations of the various units of construction are shown on the draw-
ings attached hereto and by reference made a part hereof.
The width of roadways to be constructed shall be twenty-seven (27)
feet measured from back of curb to back of curb except as hereinafter
set forth.
The width of roadways to be constructed in Elmhurst Road from
the south street line of Gregory Street to the existing pavement located
fifty-five (55) feet, more or less, south of the south street line of
Gregory Street and in Gregory Street from the east street line of Elmhurst
Road to a point one hundred thirty-two (132) feet, more or less, east of
the east street line of Russel Street, shall be twenty-six (26) feet measured
from back of curb to back of curb.
The width of roadway to be constructed in Gregory Street from
the west street line of Elmhurst Road to the existing pavement located one
hundred thirty-two (132) feet, more or less, west of the west street line
of Elmhurst Road, shall be twenty-five (25) feet, measured from back
of curb to back of curb.
Portland cement concrete crosswalks shall be constructed at the
intersections of streets with roadways enumerated above, as shown on the
attached plans.
A transverse section of the finished surface of the pavement shall be
an arc of a circle passing one -quarter inch above the upper roadway edges
of the gutter flag and the elevations of the crown line of said finished roadway
at every point of the roadways of said streets between said termini.

At street intersections the grade of said top surfact shall be
modified in such a degree only as is necessary to make the top surfact
of said intersecting roadways conform to each other and to produce a
smooth, even surface.
The pavement shall be constructed on the prepared subgrade
between the curb and gutters.
The subgrade shall be prepared by shaping, compacting and trimming
the road bed after the excavation and embankment operations have been
carried out such that the subgrade will be true to the lines, grandes and cross-
sections shown on the attached drawings.
All organic matter shall be entirely removed from the subgrade and
the space filled with gravel, broken stone or other suitable materials.
All paving improvements and drainage appurtenances, such as storm
water inlets, catch basins, connecting pipes, are to be installed as shown in
detail on the attached drawings.
The pavement shall consist of a waterbound base course of crushed
stone and stone screenings, of a compacted thickness of seven (7) inches
constructed on a cushion of sand or stone screenings, and a sumce course,
consisting of mineral filler and asphalt cement, having a compacted thickness
of two (2) inche s.
On each side of the roadways to be improved, there shall be constructed
a Portland cement concrete combined curb and gutter.
The gutter shall be ten (10) inches in width and the curb shall be
eight (8) inches in width.
The curb face shall be connected to gutter line by a curve of four
(4) inch radius, shall extend in height three (3) inches above the flow line of

the gutter, except where noted otherwise on the attached drawings, and shall
be connected to the top of the curb by a curve having a four (4) inch radius.
The vertical thickness shall be ten (10) inches at the roadway face,
and nine (9) inches at the back face of the curb.
Construction joints shall be installed in said curb and gutter at
twenty (20) feet intervals. The joints shall be formed by steel templates
1/8 inch in thickness, of a length equal to the width of the combined curb and
gutter, and with a depth of at least two (2) inches greater than the depth of
the curb and gutter. These templates shall be left in place until the concrete
has set sufficiently to hold its shape but shall be removed while the forms
are still in place.
Concrete for the combined curb and gutter shall be composed of one (1)
part Portland cement, two )2) parts of fine aggregate and three and one-half
(3-1/2) parts of coarse aggregate with only enough water added to make a
workable mix.
The cement used in the construction of the Portland cement concrete
to be used in this improvement shall be of the best quality of Portland cement
which shall be a product resulting from the calcination to incipient fusion of
an intimate mixture of properly proportioned argillaceious and calcareous
materials and to which no additions greater than three percent (30/0) has been
made subsequent to calcination. The resultant clinker shall be so ground as
to produce a cement so fine that at least seventy-eight per cent (780/0) of the
volume will pass through a sieve having a forty thousand (40,000) meshes to
the square inch and be so seasoned as to produce initial set in not less than
forty-five (45) minutes.
Fine aggregate shall consist of sand having clean, hard, durable,

uncoated grains, free from deleterious substances. One hundred per cent (1000/0)
shall pass a one-fourth (1/4) inch screen and ninety-five percent (950/0) shall
be retained on a 100 mesh screen. Not more than twenty percent (200/0) shall
pass a 50 mesh screen. It shall be well graded from coarse to fine, and
shall not contain more than five percent (50/0) in weight of clay or loam,
none of which shall be in lumps.
When the fine aggregate is mixed with Portland cement in the proportions
of one (1) part cement to two (2) parts fine aggregate by weight, according to
the standard method of making briquettes, the resultant mortar at the age of
7 and 28 days shall have a tensile strength of at least equal to that developed
in the same time by mortar of the proportions and consistency,made of the
same cement and standard Ottawa sand.
Coarse aggregate may be broken stone or gravel. The broken stone or
gravel shall be clean, hard, durable, uncombed rock. It shall contain no
or ganic or other deleterious matter and shall be free from soft, thin, elon-
gated or laminated piece s.
One hundred percent (1000/0) of the coarse aggregate shall pass a one
and one -half (1-1/2) inch screen, and at least ninety-five percent (950/0) shall
be retained on a one -fourth (1/4) inch screen, with all intermediate sizes
retained.
These ingredients shall be mixed in a batch mixer, and the mixing shall
continue until the same are uniformly distributed and the concrete is uniform
in color and homogeneous, and sufficient water shall be added so as to produce
concrete which can be spread into position with a template, but the amount of
water used shan not be sufficient to cause a separation of the coarse aggregate
from the mortar in handling the concrete, and said concrete shall be of a con-

sistency such that the mort ar will flush to the surface under light tamping.
The mixing of said concrete shall continue:in the drum of the mixer not less
than one (1) minute, and the drum shall be completely emptied before receiving
material for the succeding batch. The drum shall revolve at a rate of speed
not less than twelve (12) revolutions per minute.
The method of measurei ng the materials for concrete, including water,
shall be one which will insure :Uniform proportion of each of the materials at
all times.
The base course shall be constructed between the combined curb and
gutters on each side of the street roadway to be improve, by first spreading
and compacting a one (1) inch thick layer of stone screenings and then spreading.
rolling and compacting crushed stone and stone screenings to a seven (7) inch
compactedthickness, constructed in two (2) separate layers, each three and
one-half (3-1/2) inches in thickness.
The top surface of each three and one-half (3-1/2) inch layer of the
macadam base course shall be waterbound by saturating with water, adding
screenings and rolling until all surface voids are completely filled, and the
top surface of the base presents a rough, tight, granular surface.
The crushed stone shall be of good quality limestone graded in size so
that the maximum size of crushed stone fragments used for the construction of
the waterbound base course shall pass a three (3) inch opening, and not over
five (5) per cent of crushed stone fragments shall pass a three -quarter (3/4)
inch opening. The percentage of wear as determined by the Los Angeles
abrasion method shall not exceed 35.
The stone screenings shall be of good quality limestone and shall pass
a three-eights (3/8) inch opening. Not more than thirty (30) per cent or less

than ten (10) percent shall pass a sieve having one hundred (100) meshes per
lineal inch.
The finished surfact of said macadam base course shall be two (2)
inche s below the surface of the completed pavement.
An asphalt prime coat as hereinafter specified shall be applied with a
pressure distributor and shall be what is known as MC -0, a medium curing
cut-back asphalt consisting of a petroleum residuum with a suitable distillate.
It shall be free from water, show no separation on standing, and shall conform
to the following requirements:

The waterbound macadam base cour se shall then be opened to traffic
for a period of time sufficient to permit additional settlement and compaction,
if any, of the sub-base and base as directed by the Engineer.
After the above waiting period has terminated, if deemed necessary by
the Engineer, and just prior to the construction of the bituminous concrete
surface course, the waterbound macadam base course shall, be reshaped

and waterbound. Sufficient stone shall be added to the waterbound macadam
base to bring it up to the proper grade and section. The additional stone
so utilized shall be crushed stone that will conform to the following gradation:

All potholes, deep depressions, or ruts in the surface of the base
shall be repaired by lightly scarifying or removing any foreign material and
filling with the above aggregate. The repaired areas shall be compacted
thoroughly by means of a pneumatic tired roller. Water shall be added, if it
is necessary, to obtain the desired compaction.
After the repairs have been made the base course shall be brought to
the proper grade and crown by repeatedly wetting with water applied by means
of a sprinkler, blading with a road grader or multiple-blade maintainer,
adding additional aggregate and rolling with a pneumatic tired roller.
After the surface of the base course has been brought to the proper
grade and crown, it shall be compacted by repeated wetting and rolling with a
pneumatic tired roller.
The butuminious concrete surface course, including a prime coat, of
liquid asphalt herinbefore described shall be constructed upon the settled and
reconditioned waterbound macadam base course, betweenthe concrete gutters,
by spreading, rolling, and compacting thereon to a compacted thickness of
two (2) inches a combination of crushedstone, stone screenings, mineral
filler and hot asphalt cement.

The prime coat shall be composed of the materials and applied with
the methods hereinbefore stated, and said prime coat shall be applied at the
rate of thirty-five hundredths (0.35) gallon per square yard.
After applying the prime coat, a one (1) inch binder course of
bituminous pavement mixture shall be laid, which shall leave the top surface
thereof, after compacting, parallel with and one (1) inch below the surface
of the completed pavement. To the binder course shall be applied a surface
course which, after compaction, shall have a thickness of one (1) inch.
The aggregate to be used in the tinder and surface course shall be
heated to a temperature of 2500 to 3500 F. The heated aggregates shall be
mixed in the plug mill mixer for a period of not less than 5 seconds. The
asphalt cement shall then be added and the mixing continued. The time re --
quired to add the asphalt cement shall be not more than 15 seconds. The
total time required for adding the asphalt cement and completing the wet
mixing period shall not be less than 30 seconds, or longer if necessary to
provide a homogeneous mixture in which all particles of aggregate are coated
uniformly.
The ingredients of the binder course shall be combined in such pro-
portions as to produce a mixture conforming to the following specification
limits by weight:

Bitumen
The binder course mixture shall be delivered at atemperature of 2500
to 3250F. and the surface course mixture at a temperature of 2500 to 3500F.
The bituminous mixtures shall be placed true to crown and grade with a
spreading and finishing machine. Bituminous mixtures may be spread and
finished by hand methods only where machine methods are impracticable.
Placing of the bituminous mixtures shall be as continuous as possible.
No more binder course mixture shall be placed in advance of the laying of the
surface course than can be covered by two (2) days run of the paving plant.
The binder course shall be kept clean until covered with the surface course.
Any foreign material on the surface of the binder course shall be removed
before the surface course is placed.
The machine shall spread the bituminous mixtures without tearing the
surface and shall strike a finish that is smooth, true to cross section, uniform
in density and texture, and free from hollows, transverse corrugations, and
other irregularities.
In areas not accessible for machine spreading, hand spreading shall
be used and shall comply with the following:

Upon arrival at the work, the binder and surface course mixtures shall
be dumped upon approved steel dump pans outside of the area on which they
are to be spread. Immediately thereafter, they shall be distributed in place
with shovels and spread with rakes in loose layers of uniform density and
correct depth.
Immediately after the binder COUlS e mixture or surface course mixture
is place9., it shall be compacted thoroughly and uniformly with a three -wheel
roller. Where initial rolling causes undue displacement, haLt-cracking or
checking in either the binder course or the surface course, the time of rolling
shall be adjusted to correct these conditions.
Rollers shall be operated at a speed of not more than 150 feet per minute
and shall weigh from 8 to 12 tons and have a unit compression of not less than
250 nor more than 400 pounds per inch of roller width.
After final compression, the finished surface course shall at no point
have a density less than 95% of the maximum possible density of a voIdless
pavement composed of the same materials in like proportions. If the density
of the finished pavement is less than 95%, additional rolling will be required.
Rolling of the binder and surface courses shall start longitudinally at
the sides of the pavement overlapping uniformly on successive trips by at
least one -half (112) width of the rear wheels. Succeeding trips of the role
roller shall be terminated at least three (3) feet from the preceding stop.
Each stop shall be regulated to prevent trapping of water on the rolled surface.
The roller shall not pass over an unprotected edge of the freshly laid
bituminous mixture, except when the laying of this course is to be discon-
tinued for an extended length of time.
The speed of the roller at all times shall be slow enoughto avoid
displacement of the bituminous mixture; if displacement occur s, it shall

be corrected at once by raking ana applying fresh bituminous mixture where
required. To prevent adhesion of the bituminous mixture to the roller, the
wheels shall be kept properly moistened, but an excess of water will not be
permitted.
Immediately after the initial rolling of the surface course, atest shall
be made for smoothness, with a ten (10) foot straightedge to locate high and
low spots so that they may be altered while the mixture isstill fresh. Binder
course shall also be straighedged in the manner described for the surface
course. Rolling of the binder and surface courses shall be continued until all
roller marks are eliminated and the bituminous mixture is thoroughly compacted.
In all places inaccessible to the rollers, such as locations adjacent to
curbs, gutters, headers, manholes, and similar structures, the required
compression shall be secured with hot tampers.
Any bituminous mixture that becomes loose, broken, mixed with foreign
material, or which is defective in finish or density, or which does not comply
in all other respects with the requirements, shall be removed, replaced with
suilable material, and finished in accordance with these specifications.
The mineral aggregates in such binder and surface course mixtures shall
be clean, tough, durable fragments of crushed stone, consisting of angular
fragments resulting from crushing by mechanical means the following types
of rocks quarried from undisturbed, consolidated deposits; granite and similar
phanerocrystalline igneous rocks; calcareous or dolomitic limestone; or
massive metamorphic quartzite or similar rocks.
The existing catch basins manhole s, inlets, valve vaults J and
handholes within the limits of the improvements shall be adjusted to the
proposed pavement or parkway grades, These structures shall be adjusted
with Portland cement mortar and brick (Grade SW building brick, made from

clay or shale, or Grade A. concrete building brick).
Existing concrete curb walks and crosswalks conflicting with the con-
struction of the proposes pavement shall be removed.
Existing concrete, gravel, and bituminous driveways shall be removed
as necessary to insure the proper slope to the new curb and gutter grade and
to facilitate the construction of the new curb and gutter. The driveways So
removed shall be replaced with materials equivalent to the original materials
and to the same width and thickness.
The portland cement concrete crosswalks shall be five (5) feet in width
and five (5) inches thick and shall be constructed at the locations shown on the
drawings attached hereto.
The forms for the crosswalks shall be so set that the slab will have a
fall of one (1) inch vertical to four (4) feet horizontal from the edge nearest
the property line toward the edge farthest from the property line.
A subgrade shall be prepared by excavating or filling, as the case may
be, so that the top surface of the crosswalk to be constructed at the edge
nearest the property line will be at the established grade.
Upon said subgrade there shall be placed Portland cement concrete of
a mixture of one (1) part Portland cement, two (2) parts of fine aggregate, and
three and one-half (3 1/2) part s of coarse aggregate mixed as hereinbefore
specified for concrete for' curb and gutter. Saidfine and coarse aggregate
are to be the same as hereinbefore specified for curb and gutter.
The concrete shall be placed in successive batches for the entire width
of the slab, struck off one-half (1/2) inch higher than the finished slab, tamped
until all voids are removed and free mortar appears on the surface, thoroughly
spaded along the edges, slruck off to the true grade, and floated and troweled

to a true and even surface. After tamping, floating and trowelling, the depth
of the mixture shall be five (5) inches.
Joint filler shall be premoulded strips of asphaltic felt one-half (1/2)
inch thick, as wide as the thickness of the concrete slab and at least
two (2) feet long. It shall have such a consistency that it will not run in
summer or chip out in winter.
Forms shall be of lumber two (2) inches thick or of steel of equal
strength.
They shall be held rigidly in place by stakes or braces with top edges
at true line and grade. Ends of adjoining forms shall be flush.
A template, resting upon the side forms and having the lower edge of
the exact elevation of the subgrade, shall be drawn along the forms before any
concrete is laid. Any high place in the subgrade shall be removed so that the
template will pass over without being raised off the side forms or being tipped
at an angle to the crosswalk surface.
The subgrade shall be damp, but not muddy, when concrete is placed
upon it.
The walk shall be divided into separate rectangular slabs by marking
with edging tools. No plain concrete slab shall be longer than six (6) feet or
less than four (4) feet on anyone side.
The surface edges and side edges of each slab shall be rounded to a
radius of about one -fourt (1/4) inch.
Expansion joints shall extend from one -quarter (1/4) inch below the
surface of the walk to the subgrade, be truly at rigfht angles to the crosswalk
surface, and be made by putting the specified joint filler in place before placing
the concrete. They shall be placed as follows:

At or near all places where the crosswalk intersects a curb line or
other crosswalk, a one (1) inch expansion joint composed of two (2) thicknesses
of one -half (1/2) inch joint filler shall be made at right angles to the center line
of the walk.
Existing trees in the area of this improvement shall be removed and
disposed of and the stumps and roots removed to a depth of twelve (12) inches
below the surface of the subgrade.
Inlets and catch basins shall be constructed at the locations shown on
the plans.
The floor of said catch basins, and inlets shall be constructed of
Portland cement concrete, composed of one (1) part Portland cement, two (2)
part.s of fine aggregate, and three and one-half (3-1/2) parts of coarse
aggregate, with only enough water added to make a workable mixture. The
concrete floors or bases for the catch basins and inlets shall be eight (8)
inches, and four (4) inches thick respectively. The walls shall be concrete
masonry units five (5) inches in thickness, which shall be composed of a
good quality Portland cement concrete and laid in cement mortar. The mortar
shall consist of one (1) part cement to ihree (3) parts sand, by volume, based
on dry materials. The concrete masonry units shall be constructed in horizontal
courses, with vertical joints broken.
Cast iron frames shall be set in full mortar beds on top of the concrete
masonry walls. The castings shall be set accurately to the finished elevations
of pavement or parkway, so that no subsequent adjustment will be necessary.
In order to permit the joints to be mortared properly and also to permit
proper compaction of the backfill material, the excavation shall be made to a
diameter of at least six (6) inches greater than the diameter of the structure.

The space between the sidesof the excavation and the outer surfaces
of the manholes, catch basins and inlets shall be backfilled with sand or stone
screenings. The backfill shall be compacted as herein specified.
The concrete pipe placed in the masonry walls for outlet or inlet con-
nections shall extend through the walls and beyond the outside surfaces of the
walls a sufficient distance to allow for connections., and the masonry shall be
carefully constructed around them so as to prevent leakage along the outer
surfaces.
After the masonry work is completed, it shall be kept moist and pro-
tected from the elements in a satisfactory manner for a period of hot less than
48 hours.
Said catch basins shall be seven (7) feet deep, measured from the top
of the masonry to the top of the floor. The catch basins shall be circular in
form of an internal diameter of four (4) feet. The upper two (2) feet eight (8)
inches of the walls of the catch basin shall be drawn in from forty-eight (48)
inches to twenty-four (24) inches in diameter.
Storm water inlets shall be sixteen (16) inches deep, measured:fo m
the top of the floor. The inlets shall be circular in form and shall.have an
internal diameter of two (2) feet.
The catch basins and inlets, unless otherwise noted on the plans, shall
be equipped with Type "B" frame and style lIB" grates, as detailed on the
drawings. The combined weight of the frame and grate shall be not less than
five hundred ten (510) pounds.
The frames and covers shall be fabricated of close grained gray iron
having a tensile strength of 20,000 pounds per square inch. Castings shall
be smooth, true to pattern and free from projections, sand holes, or blow holes.

The pipe used for inlet and catch basin connections shall be eight (8)
inches in diameter. The pipe shall be reinforced concrete culvert pipe
having a minimum strength of 2,350 pounds per lineal foot and shall be laid
at a pitch of 1/8 inch per lineal foot.
Joints shall be made of the best quality tarred manilla yarn (jute) and
Portland cement mortar composed of one (1) part Portland cement and two (2)
parts of clean graded torpedo sand, as hereinbefore specified.
The material used in backfilling shall consist of either sand of a fine
granular material resulting from the natural disintegration of rock, or stone
screenings produced from crushing rock quarried from undisturbed, con-
solidated deposits. The aggregate shall be material less than 0.187 inch in
size. The backfill material shall be placed to a height of twelve (12) inches
above the pipe in layers not to exceed four (4) inches thick and each layer
shall be firmly compacted by ramming or tamping. The remainder of the trench
shall be backfilled with loose aggregate to the subbase of the proposed pavement
improvements and settlement secured by introducing water through holes jetted
into the trench to a point approximately two (2) feet above the top of the pipe.
The backfill around catch basins and inlets shall be compacted with jetting
also.
Corrugated metal pipe shall be installed at the locations shown on the
plans. Corrugated metal pipe shall be ten (10) inch internal diameter and
shall be fabricated of twelve (12) gage metal. All corrugated metal pipe shall
be galvanized.
Village Datum for the purposes of this improvement is hereby established
as a level plane ninety-six and 34/100 (96.34) feet below the top of the south-
west head bolt on the water hydrant located on the northeast corner of the

intersection of Russel Street with Memory Lane in the Village of Mount
Pr os pe ct, Illinoi s.
The elevations of the various parts of the improvement herein specified
to be constructed shall be as shown on the drawings attached hereto.
From each elevation point shown on the drawing for the street center
line the top surface of the finished pavement shall be a straight line to the
next elevation point in each direction. The gutters of the paverment shall be
uniformly four (4) inches below the center line at all points.
All materials shall be of the best quality and suitable for the purpose
for which they are used.
All work shall be done in a workmanlike manner under the super-
intendence of the Board of Local Improvements of the Village of Mount
Prospect, Cook County, Illinois.
SECm N 2. That the recommendation of the Board of Local
Improvements of said Village of Mount Prospect, providing for said improve-
ments' together with the estimate of the cost thereof as prepared by the
Village Engineers and made by the President of the Board of Local Improve-
ments and submitted to the President and Board of Trustees, both hereto
attached, be and the same are hereby approve.
SECTION 3. That said improvement shall be made and the whole cost
thereof, including the sum of Three Thousand Five Hundred Eighteen Dollars
and thirty cents ($3518.30), being the amount included in the said estimate
of said President of the Board of Local Improvements hereto attached, to
apply on the cost of making, levying and collecting the assessment herein
as provided by law, to be paid for by a special assessment, in accordance
with an Act of the General Assembly of the State of Illinois entitled: !IAn

Act Concerning Cities and Villages and Incorporated Towns and to repeal
Certain Acts herein Named, Approved August 15, 1941 and effective
January 1, 1942", together with all amendatory acts thereof (except
Sections 84. 1 to 84. 1-49).
SECTION 4. That the aggregate amount herein ordered to be
assessed and also the assessment on each lot and parcel of land and any
assessment that may be made for public benefit shall be divided into ten
(10) annual installments, in the manner provided by the Statute in such
case made and provided, and each of said installments shall bear interest
at the rate of six per cent (6%) per annum, according to law, until paid.
SECTION 5. For the purpose of anticipating the collection of the
second and subsequent installments of said assessment for said improve-
ments, bonds shall be issued payable out of said installments, bearing
interest at the rate of six per cent (6%) per annum, payable annually,
signed by the President and attested by the Clerk of said Village of Mount
Prospect under the corporate seal thereof, said bonds shall be issued in
accordance with, and shall in all respects conform to, the provisions of
the Act of the General Assembly of the State of Illinois, entitled: I1An Act
Concerning Cities and Villages and Incorporated Towns and to Repeal
Certain Acts herein Named, Approved August 15, 1941, and effective
January 1. 1942", together with all amendatory acts thereof (except
Sections 84. 1-1 to 84. 1- 39).
SECTION 6. That upon the passage and approval of this Ordinance,
the Village Attorney of said Village, be and he is hereby directed to file
a petition in the County Court of Cook County, Illinois, in the name of the
Village of Mount Prospect, praying that steps may be taken to levy a special

assessment for said improvements, in accordance with1he provisions of
this Ordinance and in the manner provided by law.
SECTION 7. That all Ordinances and parts of Ordinances
conflicting with this Ordinance be and the same are hereby repealed
insofar as they conflict herewith.
SECTION 8. This Ordinance shall be in full force and effect from
and after its passage and approval by the President of said Village.
PASSED by the Board of Trustees of the Village of Mount
