SUBJECT: ROADWAY JURISDICTIONAL TRANSFERS
Current and future conditions make it judicious for the Village to establish a policy to
consider the conditions under which a jurisdictional transfer for roadways owned by
Cook County or the State of Illinois would occur.
What is a Jurisdictional Transfer (JT)1
It is the transfer of the authority and obligation to administer, control, maintain and
operate a roadway from one agency to another. It is not the transfer of ownership of
the land, although that could be accomplished through a separate process. A JT is
accomplished by agreement between the Illinois Department of Transportation (lOOT)
or the Cook County Highway Department (CCHO) and a local agency such as the Village
of Mount Prospect.
JT Historv
The Village has previously accepted a JT for portions of two roadways throughout our
history. A JT was accepted for Central Road, from Wolf Road to Rand Road, in 1990,
and also for Wolf Road, from Central Road to Euclid Avenue, in 1992. Requests over
the years for JT's for other roadways, including Mount Prospect Road, Busse Road and
Camp McDonald Road have been declined by the Village.
Positive Aspects of a JT
The benefits of a JT include:
[] Substantial Roadway Improvements. lOOT and CCHO have indicated on occasion
that they will be make substantial improvements to a roadway unless there is a JT.
Typical improvements include reconstructed pavement, curb and gutter, drainage,
lighting and lane additions.
[] Upgraded Improvements. The Village can negotiate for improvements that currently
do not exist, beyond the roadway such as sidewalk, streetlights, traffic signal
improvements, drainage improvements and intersection improvements.
[] Regulatory Authority. The Village will have the authority to regulate various matters
such as speed limits, parking restrictions, driveway (curb opening) permits, weight
limits and road closures for parades.

Negative Aspects of a JT
There are negative aspects of a JT including:
c] The Village would assume long term maintenance costs for all of the facilities included
in the transfer.
c] The Village would be responsible for the annual maintenance costs of street sweeping,
snow and ice removal, pavement marking, crack filling. pothole patching and traffic
signal maintenance.
c] Land Ownership. The ownership of the land remains with the original agency, lOOT
or CCHD.
Current Guidelines
Staff is working under current guidelines that were established at a Committee of the
Whole Meeting in January of 2005 when potential JT's specifically with lOOT were
discussed. The elements of those guidelines include:
c] The Village would not consider a JT for any road that has connectivity through
multiple communities. has multiple traffic signals or has a regional significance.
c] The Village would give consideration to accepting a JT of Kensington Road because it
spans only two communities, has an average daily traffic count of less than 10,000
vehicles per day and does not have a regional significance beyond those two
communities.
c] The Village will only consider a JT for roads with new full depth pavement, curb and
gutter, sidewalks, street lights and a properly sized and functioning storm sewer
system.
Eligible Roadways
There are actually very few roadways that could be considered for JT's. Attached is a
map of roadways that traverse the Village that are under the jurisdiction of either the
County or lOOT.
[] lOOT Roadways. lOOT will not relinquish the jurisdiction of any numbered routes so
Routes 12, 14, 45, 58, 62 and 83 will not be considered for JT's. That leaves only
Busse Road (south of Golf Road), Central Road, Kensington Road and the portion of
Wolf Road north of Euclid Avenue.
[] CCHD Roadways. There are five CCHO roadways within the Village. The County
has expressed interest in the past concerning JT's for Busse Road (north of Golf
Road), Camp McDonald Road and Mount Prospect Road. It is unlikely that the
County would be interested in JT's for Euclid Avenue or Dempster Street.
Jr s Currently Under Consideration
The Village Board, at the March 25, 2008 Committee of the Whole Meeting, has already
indicated a willingness to accept a JT for Kensington Road (west of Rand Road) provided
that certain improvements are made. lOOT has indicated a willingness to make those

improvements and Village Staff is in the process of recommending hiring a design
engineering firm to begin Phase I and Phase II Engineering for improvements. The
Village Board also indicated a willingness to consider a JT for the remainder of
Kensington Road in the future if certain improvements are made.
Criteria to Consider
Staff is looking for guidance, in light of potential projects, to be able to discuss possible
JT's with the County and lOOT. Direction concerning which roadways would be
considered by the Village for JT's would aid in discussion of future projects. Factors that
should be considered are the function of the roadway, connectivity of the roadway,
traffic volumes, and any special features that would require unique and burdensome
maintenance, such as bridges and traffic signals.
Staff appreciates the opportunity to bring this before the Village Board at the February
24, 2009 Committee of the Whole Meeting to obtain clarity for future projects.
