COMMITTEE OF THE WHOLE MINUTES
January 13, 2009
I. CALL TO ORDER
The meeting was called to order at 7:05 p.m. in the Village Board Room of Village
Hall, 50 South Emerson Street, by Mayor Irvana Wilks. Present at the meeting
were: Trustees Paul Hoefert, Arlene Juracek, John Korn, John Matuszak, Steven
Polit and Michael Zadel. Staff present included Village Manager Michael Janonis,
Assistant Village Manager David Strahl, Village Attorney Everette Hill, Police Chief
John Dahlberg, Administrative Analyst Michael Dallas and Administrative Assistant
to the Village Manager Doreen Jarosz.
II. ACCEPTANCE OF MINUTES
Approval of Minutes of November 11, 2008 motion made by Trustee Korn seconded
by Trustee Hoefert. Minutes were approved.
Approval of Minutes of Special Meeting of December 9, 2008 motion made by
Trustee Juracek seconded by Trustee Polit. Minutes were approved. Trustees
Hoefert and Zadel abstained.

IV. CHAPTER 13 LIQUOR CODE REVISIONS
Mayor Wilks provided an outline of the liquor code review process. She stated
that obtaining a liquor license in the Village is a privilege and not a right and there
are some very specific and necessary regulations that are required in order to
qualify for a liquor license. She stated as Liquor Commissioner she has noticed a
need to modify the code based on current business challenges which includes a
change in the various designations of licenses.
Village Manager Janonis stated there has been substantial work performed by
Doreen Jarosz Administrative Assistant to the Village Manager, Michael Dallas
Administrative Analyst and Village Attorney Everette Hill. While there have been
some minor changes to the Liquor Code over the last decade the last
comprehensive revision was completed in 1994. He stated that many of these
recommended changes will bring clarity to the code for applicants and streamline
enforcement procedures for the Police Department. He would request the code be
approved by early March so that the changes can be communicated to the liquor
licenses holders during the next round of renewals which are effective May 1.
Village Attorney Everette Hill spoke. He stated the Village of Mount Prospect has
been a leader in liquor license regulations and enforcement throughout the State of
Illinois for some time. He added that many of the changes the Village has
undertaken in the past regarding the Liquor Code have eventually been
incorporated in State regulations that consequently impact the rest of the State. He
thoroughly described the changes to the code including the new liquor
classifications and permits. He added that the consolidation of the class types and
definitions now clarify how these designations could be applied to various
businesses or business needs. He highlighted the new regulations which address
catering operations (including off site permits) and the changes to the lounge size
up to 50 % of the total square footage of the establishment. He also mentioned
there is a change to the Banquet facility license which now separates the banquet
and catering operations.
He clarified the service of food as it relates to holding a liquor license. He also
highlighted the fact that a Golf Course liquor license now permits service from golf
carts out on the golf course as well as service in a club house restaurant or lounge.
He reviewed the Specialty License category which includes hotels, bowling alleys,
taverns and a gourmet beverage shop. He also highlighted permits for temporary
civic, library and village events which normally do not have a license as part of their
regular business operations. He added the code also contains provisions for a
business outside Mount Prospect to cater events within the community with a liquor
permit. He also stated the hearing process has been altered to improve the
functioning and will minimize the number of continuances and rescheduling due to
the complexity of getting witnesses and personnel mobilized for a hearing. He
provided a summary of the deletions that are recommended.
Jennifer Martinez business owner of Vino 100 spoke. She thanked the Board for
the changes in the code that she believes her business can benefit from. However,
she also remains concerned about the food options available to her wine shop and
how to comply with the proposed code modifications.
General comments from the Village Board suggested additional discussion was
needed to clarify wine consumption and the food requirements at her establishment
or similar establishments in the community.
Matthew Stankowicz 1716 N. Burning Bush spoke. He questioned the service
limit for glasses or flights of wine at a wine shop which appears to be incompatible
with a sampling limit for an off site sampling event.
Attorney Everette Hill noted this question and stated he will review the proposal to
clarify the limit.

V. VILLAGE MANAGER'S REPORT
Manager Janonis stated the Celestial Celebration is coming up and tickets are
currently available. The date for the Celebration is February 7th.

VII. ADJOURNMENT
Motion made to move into Closed Session by Trustee Hoefert seconded by Trustee
Korn to discuss Land Acquisition and Personnel at 9:40 p.m.
Meeting reconvened into Open Session at 10:55 p.m. and immediately adjourned
due to no other business
