HomeMy WebLinkAboutOrd 590 12/17/1957 ORDINANCE NO.~~ AN ORDINANCE AMENDING THE VILLAGE OF MOUNT PROSPECT ZONING ORDINANCE AS AMENDED vlliEREAS, the corporate authorities of the Village of Mount Prospect on the 17th day of December, 1957, annexed to the Village of Mount Prospect the following-described pro- perty: That part of the South Half of the Southwest Quar- ter of the Southwest Quarter of Section 35, Town- ship 42 North, Range 11, East of the Third Principal Meridian, lying West of Rand Road and East of the West 579.0 feet thereof; Also a strip of land in the East Half of the Southwest Quarter of Section 35, Township 42 North, Range 11, East of the Third Principal Meridian, which lies South of the Sou- therly line of Rand Road and West of a line de- scribed as beginning at a point on the South line of the said Southwest Quarter 1318.91 feet West of the Southeast corner of said Southwest Quarter; thence running North along a line which makes an angle of 900 with the South line of said Southwest Quarter to the Southerly line of Rand Road, all in Cook County, Illinois. ; and WHEREAS, a plat of subdivision for said property has been approved by the Plan Commission of the Village of Mount Prospect and by the Board of Trustees of said Village; and WHEREAS, in connection with the annexation of said property and in the interests of public welfare, safety and health of the residents of the Village of Mount Prospect, the corporate authorities of the said Village deemed it necessary to determine the proper zoning to be applied to said property when so annexed; and WHEREAS, a Notice of Public Hearing with respect to the question of establishing zoning of the aforesaid pro- perty was duly published in the Mount Prospect Herald, a newspaper of general circulation in the Village of Mount Prospect, said Public Notice appearing on October 10, 1957; and - 2 - WHEREAS, pursuant to said Notice a public hearing was held by the Zoning Commission of the Village of Mount Prospect at the Village Hall in the Village of Mount Prospect on October 25, 1957 at the hour of 8:00 P. M. pursuant to the provisions of the aforesaid Public Notice, and all persons who desired to be heard were heard, and an opportunity given to all persons who desired to make remonstrances and objec- tions with reference thereto; and WHEREAS, the Zoning Commission of the Village of Mount Prospect, subsequent to said Public Hearing, recommended by letter dated November 4, 1957 that if said property be annexed to the Village of Mount Prospect the aforesaid pro- perty be zoned in accordance with their recommendation and thereafter upon further consideration of said matter by a proper committee of the Board of Trustees of said Village, the corporate authorities of the Village of Mount Prospect do hereby find that it is in the public interest and will aid and promote the public safety, health and welfare of the residents of the Village of Mount Prospect to zone the pro- perty as hereinafter set forth, NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: Section 1: That an ordinance entitled, \tAn Ordi- nance classifying, regulating and restricting the location of trades and industries and the location of buildings de- signed for specified uses; regulating and limiting the height and bulk of buildings hereafter erected or altered, regulat- ing and limiting the intensity of the use of lot areas and regulating and determining the area of yards, courts and other open spaces within and surrounding such buildings; establishing the boundaries of districts for said purposes; and prescribing penalties for the violation of its provisionsll - 3 - passed and approved December 4, 1923, and amendments thereto (and known as Ordinance No. 52) as amended, be further amended by classifying the following described real estate into the following Districts: Legal Description District In Block 1 of Frank Serafine's Third Addition, a subdivision in the Southwest t of Section 35, Township 42 North, Range II East of the Third Principal Meridian, in Cook County, Ill. Lot 1............................R-3 District Apartment-Residence Lots 2 through 5 inclusive.......R-l District Single-family residence In Block 2 of Frank Serafine's Third Addition, a subdivision in the Southwest k of Section 35, Township 42 North, Range 11 East of the Third Principal Meridian, in Cook County, Ill. La t 1............................ B-3 Di s t ri c t Business-Retail and Service La t 2............................ B-3 Di s t ri c t Business-Retail and Service Lo t 3............................ p - 3 Di s t ri c t Off-street Parking - Unpaved La t 4............................ P - 3 Di s t ri c t Off-street Parking - Unpaved Section 2: That the Zoning Plan of the Village of Mount Prospect as amended, be and the same is hereby amended to conform to the above change. Section 3: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law. Section 4: That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed, reser- ving however, to the Village of Mount Prospect any rights which have accrued to it against any person, firm or corporation under any ordinance or sections of said Zoning Ordinance which may be - 4 - and are hereby repealed.
