ORDINANCE NO. 10 0 3'
AN ORDINANCE AMENDING THE VILLAGE OF MOUNT
PROSPECT ZONING ORDINANCE AS AMENDED
vffiEREAS, a Notice of Public Hearing with respect
to the question of rezoning the following-described property
from R-l (Single Family Residence) to B-3 (Business-Retail
and Service) District:
Lot 31 in Maplewood Heights, being a subdivi-
sion in the East 15.00 chains of that part
lying North of Railroad of the Southeast quar-
ter of Section 12, (except the Southerly 66 ft.
for road) also of Block 26 in Busse's Eastern
Addition to Mount Prospect in the East half of
Section 12, all in Township 41 North, Range 11,
East of the Third Principal Meridian
was duly published in the Mount Prospect Herald, a newspaper
of general circulation in the Village of Mount Prospect; and
\fHEREAS, a public hearing was held by the Board of
Appeals of the Village of Mount Prospect in the Village Hall
of the Village of Mount Prospect on the 28th day of February,
1958 at the hour of 8:00 P. M. pursuant to the provisions of
the aforesaid public notice, and all persons who desired to
be heard were heard and an opportunity given to all persons
who desired to make remonstrances and objections with refer-
ence thereto; and
\ffiEREAS, the Board of Appeals of the Village of
Mount Prospect, subsequent to said pUblic hearing, have recom-
mended that the aforesaid property be rezoned in accordance
with the petition from Residential to Business-Retail and Ser-
vice District,
NOVl, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND
BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK
COUNTY, ILLINOIS:
Section 1: That an Ordinance entitled, \IAn Ordi-
nance classifying, regulating and restricting the location of
trades and industries and the location of buildings designed

for specified uses; regulating and limiting the height and
bulk of buildings hereafter erected or altered, regulating
and limiting the intensity of the use of lot areas and regu-
lating and determining the area of yards, courts and other
open spaces within and surrounding such buildings; establish-
ing the boundaries of districts for said purposes, and pre-
scribing penalties for the violation of its provisionsll passed
and approved December 4, 1953, and amendments thereto (and
knovm as Ordinance No. 52) as amended, be further amended by
reclassifying the following described real estate from R-l
(Single Family Residence) District to B-3 (Business-Retail and
Service) District:
Lot 31 in Maplewood Heights, being a subdivi-
sion in the East 15.00 chains of that part
lying North of Railroad of the Southeast quar-
ter of Section 12, (Except the Southerly 66 ft.
for road) and also of Block 26 in Busse's Eas-
tern Addition to Mount Prospect in the East half
of Section 12, all in Township 41 North, Range
11, East of the Third Principal Meridian.
Section 2: That the Zoning Plan of the Village of
Mount Prospect as amended, is hereby amended to conform to the
above change.
Section 3: That this Ordinance shall be in full force
and effect from and after its passage, approval and publication
according to law.
Section 4: That all ordinances or parts of ordinances
in conflict herewith be and the same are hereby repealed, reser-
ving however, to the Village of Mount Prospect any rights which
have accrued to it against any person, firm or cor~oration under
any ordinance or sections of said Zoning Ordinance which may be
and are hereby repealed.
