RESOLUTION NO. 19-94
A RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT BETVVEEN
THE PROSPECT HEIGHTS FIRE PROTECTION DISTRICT AND
THE VILLAGE OF MOUNT PROSPECT
WHEREAS, the Illinois Compiled statues provides for government agencies to enter into
Intergovernmental Agreements; and
WHEREAS, the it has been determined that it would be in the best interest of the Village
of Mount Prospect to enter into an Intergovernmental Agreement with the Prospect
Heights Fire Protection District in order to provide automatic aid for the benefit of each
governmental agency.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The Board of Trustees of the Village of Mount Prospect do hereby
authorize the Mayor to sign and the Clerk to attest his signature on the Intergovernmental
Agreement between the Prospect Heights Fire Protection District and the Village of Mount
Prospect, a copy of which is attached hereto and hereby made a part hereof as Exhibit
SECTION TWO: That this Resolution shall be in full force and effect from and after its
passage and approval in the manner provided by law.

In accordance with 65 ILC$ 5/11-6-1 of the Illinois Compiled
statues, which empowers Municipalities and Fire Protection
Districts to enter into "Mutual Aid agreements", and in
accordance with the MABAS agreement entered into by the
Village of Mount Prospect and the Prospect Heights Fire
Protection District in 1973, renewed in 1989, the Village of
Mount Prospect and the Prospect Heights Fire Protection
District agreed to provide automatic aid to each other on
structural fire alarms as follows:
~ENEI~.~ CONDITIONS
1. Equipment responding on an automatic mutual aid response
to the jurisdiction shall have a minimum of three (3)
fire department personnel; except for a tanker vehicle
which shall have a minimum of two (2).
2. Only one (1) unit from the fire department providing aid
shall be required to respond at any one time, unless the
manpower on the one apparatus needs additional manpower
to meet the minimum requirements. In the event that the
unit due is unavailable (i.e, out of service, committed
to another call), no back-up or alternate unit shall be
required to respond.
3. At all times, the jurisdiction within which the emergency
exists will be in charge and responsible for the
operations at the emergency scene, the company officer
shall exercise his/her discretion as to the appropriate
action to be taken. Upon arrival of a company officer
from the department having jurisdiction, command of the
emergency scene shall be transferred in a smooth and
efficient manner to the fire department whose
jurisdiction in which the emergency exists.
4. Each fire department shall be responsible for providing a
communication system which allows the immediate
dispatching of all units due to respond from the
assisting department, as well as apparatus to apparatus
communications; while enroute to and while on the
emergency scene.

5. Each department agrees to
provide and participate in quarterly training between the two
(2) fire department.
6. Each jurisdiction agrees that the general provisions of
the "MABAS MUTUAL AID AGREEMENT" apply to this agreement,
except as modified by this agreement.
7. The Prospect Heights Rural Fire Protection District shall
hold harmless and indemnify the Village of Mount Prospect
for any claims, actions, cause of actions, or suits
arising out of the action of the Prospect Heights Rural
Fire Protection District under the terms of this
agreement including any award, settlement, or judgment
and including reasonable attorney fees and costs.
8. The Village of Mount Prospect shall hold harmless and
indemnify the Prospect Heights Rural Fire Protection
District for any claims, actions, cause of action, or
suits arising out of the action of the Village of Mount
Prospect under the terms of this agreement including any
awards, settlement, or judgements and including reasonable
attorney fees and costs.
9. Each jurisdiction agrees to waive all claims against the
other party for compensation for any loss, damage,
personal injury or death as a result of the performance in
conjunction with this agreement. General liability
insurance, personal injury insurance, and property/vehicle
insurance shall be the responsibility of each individual
jurisdiction/department.
RESPONSE AREA
I. The Village of Mount Prospect Fire Department agrees to
provide the Prospect Heights Fire Protections District:
subject to the provisions of paragraph two (2) of the
general agreement:
A. One (1) Engine company to the following areas:
Rob Roy Country Club Village (Grid 991)
Fairway Estates: Golf View Circle, Fairway Drive,
Fairway Court. (Grid 991)
B. One (1) Engine company to the Bonnie Brook subdivision
referred to as Prospect Heights Grid # 983
C. One (1) Ambulance company to the following areas, for
code #4, (structure Fires only).
The entire area known as Grid #980, 981, 982, 983
990, 991 and 993. Palatine Road (North), Wolf Road
(East) Windsor Drive (West), and Euclid Ave.
(South).
(Exception of the Schools located on the MacArthur
campus).
II. The Prospect Heights Fire Protection District agrees to
provide the Village of Mount Prospect Fire Department;
subject to the provisions of paragraph two (2) of the
general agreement:
A. One Tanker to the following areas:
The entire area bounded by River Road (East),
Gregory Street (South), Rail Road Tracks (West),
and Kensington Road (North).

B. One Engine or One Truck or One Tanker (your choice)
to the following areas:
The entire area bounded by Old Willow Road (North),
Mandel Lane (East), Wolf Road (West), and the Ascot
shopping center (South).
C. One Engine or One Truck (your choice) to the
following areas:
The entire area bounded by Euclid (South), Elmhurst
Road (East), Rand Road (West), And Camp McDonald Road
(North).
Minor modification to the above response area(s), as well as
the vehicles assigned, may be made without further
modification to this agreement. However, said modifications
must be mutually agreed upon, in writing, by the two (2)
respective fire departments.
TERMINATION OF AGREEMENT
Either the Village of Mount Prospect or the Prospect Heights
Fire Protection District may terminate this agreement by
notifying the Fire Chief of the other fire department, in
writing, sixty (60) days from the date of written notice.
TERM OF AGREEMENT
This agreement shall be effective as of the 1st day of May
1994 and shall continue in full force until terminated, in
writing, by either party.
