RESOLUTION NO. 39-94
A RESOLUTION TO EXERCISE THE POWER OF EMINENT DOMAIN IN ORDER
TO ACQUIRE CERTAIN PROPERTY FOR RIGHT-OF-WAY IMPROVEMENTS
(1020 Linneman Road)
WHEREAS, the Mayor and Board of Trustees of the Village of Mount Prospect have
determined that it is in the best interests of the health, safety and welfare of the Village of
Mount Prospect to acquire a cedain property within the Village for appropriate municipal
purposes; and
WHEREAS, the owner of the private property and the Village have not reached an
agreement with regard to just compensation for the taking of the property for right-of-way
improvements by the Village.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS
SECTION ONE: That the Mayor and Board of Trustees of the Village of Mount Prospect
do hereby exercise their home rule power.
SECTION TVVO: That the Village Manager of the Village of Mount Prospect is hereby
authorized to institute, in the name of the Village of Mount Prospect, eminent domain
proceedings in the Circuit Court of Cook County for the purpose of acquiring property for
appropriate municipal purposes at 1020 Linneman Road, Mount Prospect, Illinois, legally
described as follows:
The East 12.00 feet of the following described tract of land: That part of the Northeast
Quarter of Section 14, Township 41 North, Range II East of the Third Principal Meridian
described as follows: Beginning at a point in the West line of Linneman Road 520.14 feet
North of South line of said Northeast Quarter, thence running West parallel with the South
line of said Northeast Quarter 172.23 feet, to the East line of Lots 5, 6 and 7 in Kaplan-
Braun's Fourth Addition to Mount Prospect Unit No. 1, being a subdivision of Part of the
North 1/2 of Section 14, Township 41 North, range II, East of the Third Principal Meridian;
thence North parallel with the West line of said road and along the East line of Lots 5, 6
and 7 126.46 feet to a corner of said lot 5, thence East parallel with the South line of said
Northeast Quarter 172.23 feet, thence South 126.48 feet to the point of beginning, all
being in Cook County, Illinois.

SECTION THREE: That this Resolution shall acknowledge that upon submission of this
matter to the Court's jurisdiction that the Court will determine the value of the property to
be acquired and the value of damage, if any, to the remainder.
SECTION FOUR: That this Resolution shall be in full force and effect from and after its
passage and approval in the manner provided by law.
