RESOLUTION NO. 40-94
A RESOLUTION TO EXERCISE THE POWER OF
EMINENT DOMAIN IN ORDER TO ACQUIRE CERTAIN PROPERTY
FOR RIGHT-OF-WAY IMPROVEMENTS (1206 Linneman Roa~ .......
WHEREAS, the Mayor and Board of Trustees of the Village of Mount Prospect have
determined that it is in the best interests of the health, safety and welfare of the Village of
Mount Prospect to acquire a certain property for appropriate municipal purposes within the
Village; and
WHEREAS, the owner of the private property and the Village have not reached an
agreement with regard to just compensation for the taking of the property for right-of-way
improvements by the Village.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS
SECTION ONE: That the Mayor and Board of Trustees of the Village of Mount Prospect
do hereby exercise their home rule power.
SECTION TWO: That the Village Manager of the Village of Mount Prospect is hereby
authorized to institute, in the name of the Village of Mount Prospect, eminent domain
proceedings in the Circuit Court of Cook County for the purpose of acquiring property for
appropriate municipal purposes at 1206 Linneman Road, Mount Prospect, Illinois, legally
described as follows:
The East 33.00 feet of the North 100 feet of the South 316 feet of the South 15 acres of
the North 30 acres of the Northeast Quarter of the Southwest Quarter of Section 14,
Township 41 North, Range 11 East of the Third Principal Meridian, Cook County, Illinois.

SECTION THREE: That this Resolution shall acknowledge that upon submission of this
matter to the Court's jurisdiction that the Court will determine the value of the property to
be acquired and the value of damage, if any, to the remainder.
SECTION FOUR: That this Resolution shall be in full force and effect from and after its
passage and approval in the manner provided by law.
