MINUTES OF THE REGULAR MEETING OF THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT OCTOBER 15t 1991 CALL TO ORDER CALL TO ORDER Mayor Farley called the meeting to order at 7:30 P.M. F~%YOR~S REPORT RALPH STADLER Mayor Farley presented a Resolution acknowledging Ralph RETIREMENT Stadler, who is retiring following 26 years of service with the Mount Prospect Volunteer Fire Department. RES.NO. 35-91 Trustee Busse, seconded by Trustee Corcoran, moved for -- passage of Resolution No. 35-91. A RESOLUTION ACKNOWLEDGING THE CONTRIBUTIONS OF RALPH L. MERITORIOUS The following members of the Fire Department were acknowledged for outstanding service as members of the Fire Department: Inspector Tristan, Sue Peyton, Firefighter/Paramedics John Malcolm, Peter Morris, Mike Kle~s, Mark Ceisel, Jeff Hunt, Matt Canning, Kevin Wilson, and Lt. Robert Clark and Lt. Henry Dawson ROGER NEITZKE Ralph Stadler, retired Deputy Fire Chief of the Mount MEMORIAL PLAQUE Prospect Volunteer Fire Department, presented a memorial plaque to the widow of former Deputy Fire Chief Roger Neitzke, who passed away last year. PRESENTATION Fire Chief Cavello announced that the Mount Prospect -- RECEIPT OF Fire Department was awarded First Place in the AWARDS Annual Scrap Book Contest for the State of illinois. POSTER CONTEST Mayor Farley, Chief Cavello and Inspector Mario Tristan AWARDS presented the winners of the annual Fire Prevention Week Poster Contest, which includes students from schools within the Village. Page 2 - October 15, 1991 Mayor Farley proudly noted the birth of his 6th MAYOR grandchild, Christopher Gerald, born to his son FARLEY'S earlier in the day.' NEWEST GRANDSON OLD BUSINESS None. NEW BUSINESS ZBA 33-V-91, 1623 Cedar Lane. ZBA 33-V-91 The Petitioner is requesting variations to 1623 CEDAR LN allow a sideyard setback of ? feet, rather than the required 10 feet; a rear yard setback of 7 feet, rather than the required 15 feet; and, a zero foot separation between a pool deck and a house deck in order to permit an existing above ground swimming pool. The Zoning Board of Appeals recommended denying these requests by a vote of 2-4. It was noted that this case had been before the Zoning Board of Appeals on two occasions. At the first hearing, neighbors expressed their desire to have a 6 foot fence, which would screen the pool. The Petitioner then filed a petition for a variation to permit the 6 foot fence. It was the opinion of the Zoning Board of Appeals that the requested variations should not be granted since the Petitioner installed the pool and built the deck for the pool without benefit of a permit. Trustees expressed the fact that they agreed with the Zoning Board of Appeals and noted that if the Petitioner had requested a building permit, they would have known about the required setbacks. The neighbors expressed their feelings that they had no objections to the pool as long as the fence was installed. Inasmuch as a 2/3 majority vote would be necessary to override the denial of the Zoning Board of Appeals, and the fact that 2 Trustees were absent, the Petitioner requested that this case be continued to the November 5th meeting of the Village Board. This case will be presented November 5th for Village Board action. ZBA 57-A-91 and ZBA 58-SU-91, 1028 S. Elmhurst Road ZBA 57-A-91 The Petitioner, Walgreen Company, is requesting a ZBA 58-SU-91 text amendment to Chapter 14 to allow a non-ground 1028 S.~ mounted satellite antenna as a Special Use in a B-1 Shopping Center District. Also request is a Special Uss to permit a non-ground (roof) mounted satellite antenna at the subject property. The Zoning Board of Appeals recommended granting these requests by votes of 6-0. Trustee Clowes, seconded by Trustee Busse, moved to concur with the recommendation of the Zoning Board of Appeals and grant the text amendment being the subject of ZBA 57-A-91. Page 3 - October 15, 1991 Trustee Corcoran, seconded by Trustee Busse, moved to concur with the recommendation of the Zoning Board of Appeals and grant the Special Use being the subject of ZBA 58-SU-91. Upon roll call: Ayes: Busse, Corcoran, Clowes, Hoefert Nays: None Motion carried. Ordinances will be presented for first readings at the next meeting of the Village Board on November 5, 1991. ZBA 60-V-91 ZBA 60-V-91, 219 South Leonard Lane 219 S. LEONARD The Petitioner is requesting a variation to allow a 2- 1/2 foot side yard setback, in order to permit the location of an existing shed. The Zoning Board of Appeals recommended denying this request by a vote of 3-3. It was noted that the neighbors objected to the sight of this shed, however, it was noted that if the Petitioner was required to move the shed to a permitted area, the neighbor would still see it. There was a recommendation from the Board that the Petitioner plant shrubs in an effort to reduce the visual impact on the neighbors. This was acceptable to the neighbors. Trustee Corcoran, seconded by Trustee Hoefert, moved to grant the variation requested in ZBA 60-V-91. Upon roll call: Ayes: Busse, Corcoran, Clowes, Hoefert Nays: None -- Motion carried. An Ordinance wi%l be presented November 5th for first reading. ZBA 61-V-91 ZBA 61-V-91, 1631 Greenwood Avenue 1631 GREENWOOD The Petitioner is requesting variations to accommodate a circular driveway and to allow a front yard lot coverage of 45.7%. The request for lot coverage was reduced by the Petitioner to 42% at the Zoning Board of Appeals meeting. The Zoning Board of Appeals recommended granting the request by a vote of 6-0. Trustee Busse, seconded by Trustee Hoefert, moved to concur with the recommendation of the Zoning Board of Appeals and grant the variations requested in ZBA 61- V-91, as amended. Upon roll call: Ayes: Busse, Corcoran, Clowes, Hoefert Nays: None Motion carried. An Ordinance will be presented November 5th for first __ reading. ZBA 62-V-91 ZBA 62-V-91, 108 North Main Street 108 N. MAIN ST The Petitioner is requesting variations to accommodate a circular driveway and to allow a 45.7% front yard lot coverage. The Zoning Board of Appeals recommended granting these requests by a vote of 6-0. Page 4 - October 15, 1991 Trustee Busse, seconded by Trustee Clowes, moved to concur with the recommendation of the Zoning Board of Appeals and grant the variations requested in ZBA 62-V-91. ZBA 63-V-91, 8 South Busse Road ZBA 63-V-91 The Petitioner is requesting a variation to allow 8 S. BUSSE RD a 484 square foot accessory structure, a shed, rather than the permitted 120 square feet. The Zoning Board of Appeals recommended granting the variation requested. Trustee Busse, seconded by Trustee Clowes, moved to concur with the recommendation of the Zoning Board of Appeals and grant the variations requeste~ in ZBA 63-V-91. ZBA 64-SU-91, 501 West Algonquin Road ZBA 64-SU-91 The Petitioner, Rogers Corporate Industrial Park, ROGERS CORP. is requesting an amendment to the existing Planned Unit Development by incorporating the property commonly known as 501 West Algonquin Road, into the PUD, which property was recently acquired by the Rogers Corporation. The Zoning Board of Appeals recommended granting the Special Use requested to amend the PUD. Trustee Busse, seconded by Trustee Clowes, moved to concur with the recommendation of the Zoning Board of Appeals and grant the Special Use requested in ZBA 64-SU-91. Upon roll call: Ayes: Busse, Corcoran, Clowes, Hoefert Nays: None Motion carried. An Ordinance will be presented November 5th for first reading. ZBA 65-SU-91, 500 East Blue Jay Court ZBA 65-SU-91 The Petitioner is requesting an amendment to 500 BLUE JAY the existing Orchard Field Townhome Planned Unit to allow patios on some of the townhomes within the development to encroach by 10 feet into the required 20 foot perimeter yard. The Zoning Board, of Appeals recommended granting this request by a vote of 6-0. It was noted that the Petitioner would like to modify the floor plan on some of the townhomes to enclose the proposed patio and convert it into an eating area or sun room, which would result on a new location for the patio encroaching into the perimeter yard. Page 5 - October 15, 1991 Residents to the west of this development expressed their concern relative to the condition of the area during construction and requested a 6 foot high fence be installed as a screen, which was acceptable to the Petitioner. Trustee Clowes, seconded by Trustee Corcoran, moved to concur with the recommendation of the Zoning Board of Appeals and grant the Special Use requested in ZBA 65-SU-91. -- Upon roll call: Ayes: Busse, Corcoran, Clowes, Hoefert Nays: None Motion carried. An Ordinance will be presented November 5th for first reading. AMEND ORD. An Ordinance was presented for first reading that NO. 4257 would amend Ordinance No. 4257 by deleting Section 1002 PROSPECT Four, which states the variation would be null and void MANOR after one year if a permit is not obtained prior to that time. Since the request granted in Ordinance No. 4257 was for a Special Use, the one year validity clause was placed in the Ordinance in error. ORD.NO. 4358 Trustee Clowes, seconded by Trustee Corcoran, moved ~or passage of Ordinance No. 4358 AN ORDINANCE AMENDING ORDINANCE NO. 4257 GRANTING A SPECIAL USE FOR PROPERTY LOCATED AT 1002 PROSPECT MANOR Upon roll call: Ayes: Busse, Cor¢oran, Clowes, Hoefert Nays: None Motion carried. CDBG FUNDS A Resolution was presented that would authorize specified Community Development Block Grant (CDBG) Funds to be transferred into the~Single Family Housing Rehabilitation Program, due to the anticipated requests for participation in this program. RES.NO. 36-91 Trustee Clowes, seconded by Trustee Hoefert, moved for passage of Resolution NO. 36-91. A RESOLUTION AUTHORIZING THE TRANSFER OF COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS 'Upon roll call: Ayes: Busse, Corcoran, Clowes, Hoefert Nays: None Motion carried. 9-1-1 An Ordinance was presented for first reading that would reduce the surcharge for Enhanced 9-1-1 from $.75 per line to $.30. A Resolution was presented that would authorize TIF: the Village to enter into an Agreement with BROADACRE Broadacre Development Company to serve as consultant and developer of the downtown business district. There was discussion among members of the Village Board relative t© the proposed agreement, who asked that the Agreement be amended to require periodical updates, at monthly intervals, as to expenses; as well as a summary of activities undertaken by Broadacre. Trustee Hoefert, seconded by Trustee Corcoran, RES.NO. 37-91 moved for passage of Resolution No. 37-91, as amended. Upon roll call: Ayes: Busse, Corcoran, Clowes, Hoefert Nays: None Motion carried. A Resolution was presented that would adopt a COMPREHENSIVE Comprehensive Housing Affordability Strategy HOUSING for the Village. AFFORDABILITY S~AT~Y Trustee Hoefert, seconded by Trustee Corcoran, moved for passage of Resolution Nol 38-91 RES.NO.38-91 A RESOLUTION ADOPTING THE COMPREHENSIVE HOUSING AFFORDABILITY STRATEGY FOR THE VILLAGE OF MOUNT PROSPECT Upon roll call: Ayes: Busse, Corcoran, Clowes, Hoefert Nays: None Motion carried. VILLAGE 14~%NAGER~S REPORT Village Manager, John Fulton Dixon, stated that a FIRE & gas and/or oil tank that was buried under the old POLICE Public Safety Building had leaked and soil tests STATION have been submitted to determine if the soil has been contaminated. When the test results are received and evaluated, construction will begin on the new building. Mr. Dixon stated that administration is looking MAPLE ST: into the possibility of reconfiguring Maple Street RECONFIGURE in order to widen the roadway for emergency vehicles, in conjunction with the construction of the new Fire and Police Station. Page 7 - October 15, 1991 ANY OTHER BUSINESS COMMITTEE OF It was noted that due to the fact that at least THE WHOLE 2 Trustees would be out of town next week, the MEETING regular Committee of the Whole meeting scheduled CANCELLED for October 22 was cancelled. EXECUTIVE EXECUTIVE SESSION SESSION Mayor Farley stated that the .Board would go into Executive Session for thepurpose of reviewing minutes of previous Executive Sessions to determine if any of those minutes could be released from confidentiality, as well as discussing litigation and land acquisition. Trustee Hoefert, seconded by Trustee Clowes, moved to go into Executive Session to review minutes of executive sessions, discuss litigation and land acquisition. Upon roll call: Ayes: Busse, Corcoran, Clowes, Hoefert Nays: None Motion carried. The Board went into Execution Session at 10:58 P.M. RECONVENE Mayor Farley reconvened the meeting at 11:46 P.M.
