RESOLUTION NO. 10-97
A RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT
FOR TRAFFIC SIGNAL MAINTENANCE FOR THE TRAFFIC SIGNAL
AT WOLF ROAD AND FEEHANVILLE DRIVE/DURSEY LANE
WITH THE CITY OF DES PLAINES
WHEREAS, Article VII, Section 10, of the 1970 Illinois Constitution authorizes the Village
to contract with individuals, associations and corporations, in any manner; and
WHEREAS, the Village of Mount Prospect wishes to enter into a traffic signal
maintenance agreement for the traffic signal at Wolf Road and Feehanville Drive/Dursey
Lane with the City of Des Plaines; and
WHEREAS, the actual signal maintenance will be performed by the Village of Mount
Prospect; and
WHEREAS, the Village of Mount Prospect will be responsible for 75% of the traffic signal
maintenance costs and 100% of the Electrical Energy and Emergency Pre-Emption System
costs, and the City of Des Plaines will be responsible for 25% of the traffic signal
maintenance costs;
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the Mayor of the Village of Mount Prospect is hereby authorized and
directed to execute a traffic signal maintenance agreement for the traffic signal at Wolf
Road and Feehanville Drive/Dursey Lane with the City of Des Plaines, attested to by the
Village Clerk, a copy of which is attached hereto and made a part hereof.
SECTION TWO: That this Resolution shall be in full force an effect from and after its
passage and approval according to law.

Traffic Signal Maintenance Agreement for
the Traffic Signal
at Wolf Road and Feehanville Drive/Dursey Lane
This agreement entered into this ~, day of ~, by the
City of Des Plaines, hereinafter called the City, and the Village of Mount Prospect,
hereinafter call the Village.
Upon acceptance by the Village of the traffic signal installatior~ at Wolf Road and
Feehanville Drive/Dursey Lane, the financial responsibility of the maintenance and
electrical charges for the operation of the signal shall be proportioned as follows:
Maintenance Electrical Energy :
Emergency Pre-Emption System
the Village Share 75% 100%
the City Share 25% 0%
It is agreed that the actual signal maintenance will be performed by the Village
either with its own forces or through an ongoing contractual agreement.
It is further agreed that the signal will be maintained to Maintenance Level II of
the Illinois Manual on Uniform Traffic Control Devices for Streets and Highways.
The Village agrees to send the City an itemized invoice every three (3) months
for its proportional share of the actual coStS for the maintenance of the traffic signal
during the preceding period. Upon receipt of said invoice, the City will pay said costs
by ~.c;'t.:,,~cd check made payable to the Finance Director of the Village and send it to
the Department of Finance, the Village of Mount Prospect, 100 South Emerson Street,
Mount Prospect, Illinois 60056.
The parties hereto agree that the traffic signal maintenance agreement shall
remain in effect as long as the traffic signals covered by the terms of this agreement or
any amendment hereto remain in place and operational either in their current or
modified configuration. These terms shall apply unless otherwise agreed in writing by
the parties hereto.
The Village retains the right to control the sequence and timing of the traffic
signals. No modifications of the signals or their sequencing and timing shall be made
without the approval of the Public Works Director of the Village.
This agreement shall be binding upon and inure to the benefit of the parties
hereto, their successors and assigns.
