HomeMy WebLinkAboutOrd 5131 08/01/2000 ORDINANCE NO. 5131 AN ORDINANCE GRANTING A VARIATION FOR PROPERTY COMMONLY KNOWN AS 1104 SOUTH CHURCH ROAD Passed and approved by the President and Board of Trustees the 1st day of August, 2000 Published in pamphlet form by authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 2nd day of August, 2000 ORDINANCE NO. 5131 AN ORDINANCE GRANTING A VARIATION FOR PROPERTY COMMONLY KNOWN AS 1104 SOUTH CHURCH ROAD WHEREAS, Bob and Kathy Grippo (hereinafter referred to as Petitioners) have filed an application for a Variation from Chapter 14 of the Village Code of Mount Prospect, Illinois, for property commonly known as 1104 S. Church Road (hereinafter referred to as Subject Property), legally described as: Lot 42, Windsor Estates, being a subdivision of the W ~ of Section 14, Township 41 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois; and WHEREAS, the Petitioners seek a Variation from Sections 14.905.B.1 of the Zoning Code to allow the construction of an in-ground swimming pool, with an encroachment of three feet (3') into the required twenty foot (20') exterior side yard setback, and eight feet (8') into the required fifteen foot (15') rear yard setback; and WHEREAS, a Public Hearing was held on the Variation requested being the subject of ZBA Case No. ZBA 16-00 before the Zoning Board of Appeals of the Village of Mount Prospect on the 25th day of May, 2000, and the 22"d day of June, 2000, pursuant to due and proper notice thereof published in the Mount Prospect Daily Herald on the 9th day of May, 2000; and WHEREAS, the Zoning Board of Appeals has submitted its findings and positive recommendations to the President and Board of Trustees in support of the request being the subject of ZBA 16-00; and WHEREAS, the President and Board of Trustees of the Village have considered the request herein and have determined that the best interests of the Village of Mount Prospect would be served by granting said Variation. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property a Variation from Section 14.905.B1 to allow the construction of an in-ground swimming pool, with an encroachment of three feet (3') into the required twenty foot (20') exterior side yard setback, and eight feet (8') into the required fifteen foot (15') rear yard setback. age 2/2 ZBA 16-2000 1104 S.
