RESOLUTION APPROVING FINDINGS OF FACT
RESOLUTION NO. R-28-07
WHEREAS, David P. Mulcrone & Helena Pelletier filed an application for a Variation with respect to
property commonly known as 1030 Linneman Road, the Village of Mount Prospect, Illinois.
WHEREAS, the subject property is described as follows:
Lot 1, except the south 10 feet thereof, in Steil's Subdivision of that part of the Northeast'/4 of Section 14,
Township 41 North, Range 11 East of the Third Principal Meridian, described as follows: commencing at a
point 237.22 feet North of the South line of said Northeast'/4 on a line parallel with and 8.10 chains west of the
east line of the West'/z of said Northeast'/4, thence North along said line a distance of 30 feet thence West and
parallel with the South line of said Northeast'/4, a distance of 172.23 feet, thence South and parallel with the
line which is parallel and 8.10 chains West of the East line of the West''/z of the Northwest'/4 of Section 14, a
distance of 30 feet, thence East and parallel with said South line of said Northeast'/4, a distance of 172.23 feet
to the point of beginning, in Cook County, Illinois.... And ... the South 237.22 feet of that part of the West
of the Northeast '/4 of Section 14, lying South of the center line of Seeger Road and West of the East 8.10
chains thereof, together with that part of the Northwest'/4 of said Section 14, lying South of the center line of
Seeger Road and East of a parallel line with and 38.08 chains and 9 feet East of the West line of said Section
14, Township 41 North, Range 11 East of the Third Principal Meridian (except therefrom that part thereof
taken for Golf Road) in Cook County, Illinois.... Except .... (The West 605.19 feet of the South 237.22 feet of
the Northeast'/4 of Section 14 and the South 237.22 feet of that part of the Northwest'/4 of Section 14 lying
East of a line 38.08 chains and 9 feet East of and parallel to the West line of said Section 14, Township 41
North, Range 11 East of the Third Principal Meridian, in Cook County, Illinois. PIN# 08-14-202-021-0000
WHEREAS, the Petitioner seeks the following Variation from Section 14.306.13.La of the Village Code of
Mount Prospect, Illinois to allow an 840 sq. ft. detached garage, as shown on the attached Exhibit; and
WHEREAS, a public hearing was held on the variation request (designated as CASE NO. PZ-28-07) before
the Planning & Zoning Commission in the Village of Mount Prospect, Illinois on July 26, 2007 pursuant to
due and proper notice thereof published in the Journal Newspaper on July 11, 2007.
NOW, THEREFORE, the Planning & Zoning Commission does hereby grant the requested Variation as
described above because the Subject Property measures over 17, 000 sq. ft. and the Petitioner will not have
another accessory structure (shed), subject to the Petitioner obtaining a permit from the Community
Development Department. Except for the Variation granted herein, all other applicable Village of Mount
Prospect, Illinois ordinances and regulations shall remain in full force and effect as to the Subject Property.
PASSED AND APPROVED the 26th day of July, 2007 and effective five (5) days after this date, as provided
for by Section 5.504.E of the Mount Prospect Code.
