RESOLUTION NO. 9-98
AN RESOLUTION AUTHORIZING EXECUTION OF A
DEVELOPMENT AGREEMENT WITH
RESPECT TO THE DEVELOPMENT OF 1621 AND 1641 WEST ALGONQUIN ROAD
WHEREAS, David R. Wolf, Terry and Cad Hart (hereinafter referred to as Petitioners), will develop
and/or improve the property being the subject of this Resolution in the Community Shopping Zoning
District; and
WHEREAS, the property being the subject of this Resolution (hereinafter referred to as Subject
Property) is legally described as follows:
1621 W. Algonquin Road
That part of the West ~ of the Northwest 1/4 of Section 23, Township 41 North,
Range 11 East of the 3rd Principal Meddian lying South of the center line of
Algonquin Rood bounded by a line described as follows: Beginning at a point on said
center line of Algonquin Road, 432.0 feet Southeasterly, as measured along said
center line of its intersection with the West line of the Northwest 1/4 of said Section
23; thence continuing Southeasterly along said center line 100.0 feet; thence
Southwesterly along a line drawn at dght angles to said center line, 234.58 feet to a
point on the center line of an easement for drainage ditch; thence Northwesterly
along said center line, 102.31 feet to a point on a line drawn at dght angles to the
center line of Algonquin Road through the place of beginning, thence Northeasterly
along said line, 212.99 feet to the place of beginning, excepting therefrom that part
thereof heretofore dedicated for public road, in Cook County, Illinois.
1641 W. Algonquin Road
That part of the West ~ of the Northwest 1/4 of Section 23, Township 41 North,
Range 11, East of the 3rd Principal Meridian, bounded and described as follows:
Beginning at a point on a line 50.00 feet South of and parallel with the center line of
Algonquin Road as now located, distant 231.22 feet Southeasterly of the East line
of the Northwest 1/4 of said Section 23, (as measured on said Right-of-Way line of
Algonquin Road); thence S. 27-16'-15" E. on said Right-of-Way line for a distance of
175.00 feet to a point; thence S. 27-16'-15" W. on a line perpendicular to said Right-
of-Way line for a distance of 162.99 feet to a point; thence N. 50-32'-48" W. for a
distance of 47.13 feet to a point; thence S. 90-00'-00" W. for a distance of 200.00
feet to a point on the East line of Busse Road as established by Plat of dedication
recorded July 24 1967 as Document # 16967007; thence N. 00.00'-00" E. on the last
described line for a distance of 67.50 feet to a point; thence S 90-00'-00" W. on the
North line of said dedication, for a distance of 25.00 feet to a point on the East line
of Busse Road as established by Township dedication dated November 3, 1902;
thence N. 00.00'-00"E. on the last described line for a distance of 32.81 feet to a
point; thence N. 90-00'-00" E. on a line perpendicular to the last described course for
a distance of 131.66 feet to a point; thence N. 27-16'-15" E, For a distance of 106.66
to the point of beginning, all in Cook County, Illinois; and.
WHEREAS, it has been determined that the best interest of the Village to enter into a Development
Agreement, a copy of which is attached hereto and hereby made a part hereof as Exhibit "A"; and

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: In order to ensure the Subject Property is developed in accordance with specific
requirements of the Village, the Petitioners have entered into a Development Agreement, a copy of
which is attached hereto and hereby made a part hereof as Exhibit "A".
SECTION TWO: That the Mayor and Board of Trustees of the Village of Mount Prospect do
hereby authorize execution of a Development Agreement governing the Subject Property.
SECTION THREE: That the Village Clerk is hereby authorized and directed to record a certified
copy of this Resolution and attachment with the Recorder of Deeds of Cook County.
SECTION FOUR: This Resolution shall be in full force and effect from and after its passage,
approval and publication in pamphlet form in the manner provided by law.

DEVELOPMENT AGREEMENT

We, the undersigned, DAVID R. WOLF, TERRY HART and CARL HART are the developers
of property commonly known as 1621 West Algonquin Road and 1641 West Algonquin Road, Mount
Prospect, Illinois (hereinafter referred to as Subject Property) and legally described as follows:
1621 W. Algonquin Road
That part of the West ~ of the Northwest 1/4 of Section 23, Township 41 North,
Range 11 East of the 3rd Principal Meddian lying South of the center line of
Algonquin Road bounded by a line described as follows: Beginning at a point on said
center line of Algonquin Road, 432.0 feet Southeasterly, as measured along said
center line of its intersection with the West line of the Northwest 1/4 of said Section
23; thence continuing Southeasterly along said center line 100.0 feet; thence
Southwesterly along a line drawn at right angles to said center line, 234.58 feet to a
point on the center line of an easement for drainage ditch; thence Northwesterly
along said center line, 102.31 feet to a point on a line drawn at right angles to the
center line of Algonquin Road through the place of beginning, thence Northeasterly
along said line, 21Z99 feet to the place of beginning, excepting therefrom that part
thereof heretofore dedicated for public road, in Cook County, Illinois.
1641 W. Algonquin Road
That part of the West ~ of the Northwest 1/4 of Section 23, Township 41 North,
Range 11, East of the 3rd Principal Meridian, bounded and described as follows:
Beginning at a point on a line 50.00 feet South of and parallel with the center line of
Algonquin Road as now located, distant 231.22 feet Southeasterly of the East line
of the Northwest 1/4 of said Section 23, (as measured on said Right-of-Way line of
Algonquin Road); thence S. 27-16'-15" E. on said Right-of-Way line for a distance of
175.00 feet to a point; thence S. 27-16'-15" W. on a line perpendicular to said Right-
of-Way line for a distance of 162.99 feet to a point; thence N. 50-32'-48" W. for a
distance of 47.13 feet to a point; thence S. 90-00'-00" W. for a distance of 200.00
feet to a point on the East line of Busse Road as established by Plat of dedication
recorded July 24 1967 as Document # 16967007; thence N. 00-00'-00" E. on the last
described line for a distance of 67.50 feet to a point; thence S 90-00'-00" W. on the
North line of said dedication, for a distance of 25.00 feet to a point on the East line
of Busse Road as established by Township dedication dated November 3, 1902;
thence N. 00-00'-00"E. on the last described line for a distance of 32.81 feet to a
point; thence N. 90-00'-00" E. on a line peq3endicular to the last described course for
a distance of 131.66 feet to a point; thence N. 27-16'-15" E. For a distance of 106.66
to the point of beginning, all in Cook County, Illinois; and.
In conjunction with the development of the Subject Property we do hereby agree to the following:
1. That the Developers must submit a Plat of Subdivision creating two distinct lots of record
with Plat of Subdivision should also include the dedication of a 25' x 32.81' portion of Busse
Road to complete the full right-of-way of Busse Road.
2. Prior to issuance of a building permit for 1641 West Algonquin Road, the western most
ddveway on Algonquin Road shall be re-designed so that traffic movement shall be limited
to right-in/right-out only.
3. The properties shall be developed in accordance with the Development Code and Zoning
Ordinance standards. The property at that time shall be required to assume all applicable
fees and costs.
4. Prior to obtaining final engineering approval for the development of 1621 West Algonquin
Road, a cash contribution of Four Hundred Fifty Dollars ($450.00) shall be made to the
' ' Village in lieu of installing parkway trees along AlgOnquin Road. This dollar amount is based
upon a total lot frontage of 100 lineal feet at Two Hundred Twenty Five Dollars ($225.00) per
tree spaced at 40' intervals. This contribution will also be required upOn the development
~. of 1641 West Algonquin Road for parkway trees along Algonquin and Busse Road.
5. The site and building plans shall indicate the landscape material types and sizes.
6. The parties to this Development Agreement shall enter into a cross access easement to
enable the shared drive to be utilized by the owners of both properties in perpetuity. The
easement must be submitted to staff for review and approval prior to building permits being
issued for the development of the Subject Property, a copy of said cross access easement
shall be attached hereto and hereby made a part hereof as Exhibit "1".
7. The following plans and correspondence shall be adopted as part of this Development
Agreement and a copy of'which shall be attached hereto as Exhibits "2" and "3" respectively:
a. Site and building plans for 1621 West Algonquin Road prepared by Richard D. Nynam
& Associates, revised January 8, 1998.
b. Matrix from Hart Pool Service dated January 9, 1998, titled HART POOL
INFORMATION, listing types and amounts of chemicals stored on-site.
8. The developers of the Subject Property shall execute a covenant requiring the property
owner(s) to assume financial responsibility for the installation of street lights in the event that
the Illinois Department of Transportation (IDOT) install light poles along AlgOnquin Road, a
copy of which shall be attached to this Agreement as Exhibit "4".
The terms of this Development Agreement are hereby accepted and executed by the
Development of the SubJect Property. J
