Discussion The subject property is currently owned by 555 Business Center Drive LLC, and serves as a distribution center for Novak & Parker Home appliances. Novak & Parker Home Appliances have a local showroom on Northwest Highway and have been in Mount Prospect since 1963 with over 100 years of family ownership. On September 5, 2023, the Village Board approved a variation via Ordinance No. 6691 to reduce the south parking lot setback from ten feet (10'-0") to two feet (2'-0") in order to widen the curb cut and driveway, improve truck access over paved surfaces, and reduce potential conflicts with the existing building. The petitioner notes that the purchase of their building at 555 Business Center Drive was a significant capital investment and that financial considerations, including cashflow management, interest rate fluctuations, and changing customer demand, delayed the planned parking lot improvements. As the variation expired on September 5, 2024, without a building permit issued, the petitioner requests that the Village Board grant an extension to allow additional time to complete the project. Alternatives 1. Adopt an Ordinance amending Ordinance No. 6691 to extend the effective date of said Ordinance, by extending the time period for a variation to reduce the parking lot setback from ten feet (10'-0") to two feet (2'-0") for the property located at 555 Business Center Drive for an additional two-year period to be effective through and including September 5, 2026. 2. Action at the discretion of the Village Board. Staff Recommendation Staff recommends that the Village Board approve the Ordinance extending the effective date of the variation granted for the property located at 555 Business Center Drive for an additional two-year period to be effective through and including September 5, 2026. Shallcross, Director of Community Development I am writing to explain the circumstances that led to the expiration of the zoning approval and to respectfully request the extension of the variation through September 5, 2026. Foremost, the purchase of 555 E Business Center Dr building was a substantial capital investment for our company. While having every intention on the parking lot improvement was needed, it was not a top priority. We were still grasping how the initial purchase and how it was going to affect our cashflow and financial performance. Interest rate instability and changing customer demand during the end of 2023 through 2024 were also concerning for our financial stability. Being a small business, our top priority is always making sure we are going to be financially sound first and foremost. Having owned the property for a few years, I feel comfortable with absorbing the additional cost of this improvement. It is needed and will increase the properties aesthetics and probably more importantly the functionality. I hope you can appreciate our hesitation and ask that you extend the variation expiration date of September 5, 2024 for another 2 years to be effective through and including September 5, 2026. AN ORDINANCE AMENDING ORDINANCE NO. 6691 WHEREAS, Aaron Bruder of CAGE Engineering, on behalf of Dan Novak of Novak & Parker, ("Petitioner"), did seek a variation to permit a parking lot setback reduction from ten feet (10'-0") to two feet (2'-0") along the south lot line, which variation was the subject of PZ-11-23 before the Planning and Zoning Commission; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect did on September 5, 2023, adopt Ordinance No. 6691, granting a variation for a parking lot setback for property located at 555 Business Center Drive; and WHEREAS, pursuant to the regulations of the Village Code of Mount Prospect, Section 14.203(C)(13) of the Zoning Code requires that a building permit be issued, and work be substantially underwaywithin twelve (12) monthsfollowing the approval of the variation, unless extended by the Planning and Zoning Commission; and WHEREAS, the Director of Community Development has determined it to be expedientforthe extension ofthevariationto beconsidered bytheVillage Board rather than the Planning and Zoning Commission, as referenced by code; and WHEREAS, although the Petitioner intended to complete the parking lot improvements authorized by Ordinance No. 6691, no building permitwas issued within the required time frame, and the variation therefore expired on September 5, 2024; a n d WHEREAS, the Petitioner is requestingthat Ordinance No. 6691 be amended to provide for atwo-year extension to the effective date of said Ordinance, which would provide for the variation to be effective through and including September 5, 2026.
