HomeMy WebLinkAboutOrd 6805 09/16/2025 Amending Ordinance No. 6755ORDINANCE NO.6805 AN ORDINANCE AMENDING ORDINANCE NO. 6755 WHEREAS, Thomas Szafranski of Kimley-Horn ("Petitioner") did seek a conditional use to amend the Lake Center Plaza Planned Unit Development as a major change, which conditional use was the subject of PZ-10-24 before the Planning and Zoning Commission; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect did on October 1, 2024, adopt Ordinance No. 6755, granting a conditional use to amend the Lake Center Plaza Planned Unit Development as a major change for property located at 1780 Wall Street; and WHEREAS, pursuant to the regulations of the Village Code of Mount Prospect, Section 14.203(F)(11)(a) of the Zoning Code provides thatthe construction of an approved conditional use must be substantially under way, or a use must be established or commenced in the buildingwithin one yearfrom the date of granting thereof, and completed within eighteen (18) months following the passage of said Ordinance; and WHEREAS, while the Petitioner is desirous of constructing building additions totaling approximately 17,400 square feet, being the subject of Ordinance No. 6755, the approved conditional use will not have been substantially underway or established or commenced in the building within one year from the date of granting and the use will not have been completed within eighteen (18) months followingthe passage of said Ordinance as required; and WHEREAS, the Petitioner is requestingthat Ordinance No. 6755 be amended to provide for a one year extension to the effective date of said Ordinance, which one year extension would provide for the conditional use to be effective through and including October 1, 2026. NOW, THEREFORE, BE IT ORDAINED BYTHE PRESIDENTAND BOARD OFTRUSTEES OFTHE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS ACTING IN THE EXERCISE OF THEIR HOME RULE POWERS: TID w1( , : Thatthe recitals setforth hereinabove are incorporated asfindings offact by the President and Board of Trustees of the Village of Mount Prospect. U T110-N..;1~WO: Thatthe Presidentand Board ofTrustees ofthe Village of Mount Prospectdo hereby amend Ordinance No. 6755 by extendingthe effective date for the conditional use to amend the Lake Center Plaza Planned Unit Development as a major change granted therein PZ-10-24 for a period of one year, so that said conditional use shall be valid for a period through and including October 1, 2026. SECTION THREE: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law.
