WHEREAS, Joe Hanafee ("Petitioner"), filed an application for a conditional
use to reduce the interior (south) side yard setback for the property located at
631 South Albert Street ("Subject Property") in the Village of Mount Prospect,
Illinois and legally described as follows:
LOT 131 IN SURETY'S BONNIE PARK, A SUBDIVISION OF LOT 2 IN
OEHLERKINGS DIVISION OF PART OF SECTION 12, TOWNSHIP 41 NORTH,
RANGE 11, EAST OF THE THIRD PRINCIPAL MERIDIAN, IN THE VILLAGE OF
MOUNT PROSPECT ACCORDING TO PLAT THEREOF REGISTERED IN THE
OFFICE OF THE REGISTRAR OF TITLES OF COOK COUNTY, ILLINOIS ON MAY
11,1956 AS DOCUMENT NUMBER 1669522, IN COOK COUNTY, ILLINOIS;
PROPERTY INDEX NUMBER: 08-12-427-016-0000; and
WHEREAS, the Petitioner seeks a conditional use permit to reduce the interior
(south) side yard setback from 7 feet to zero feet for the construction of a patio;
and
WHEREAS, a public hearing was held on the request for a conditional use
permit being the subject of PZ-17-25 before the Planning and Zoning
Commission of the Village of Mount Prospect on the 14th day of August, 2025,
pursuant to proper legal notice having been published in the Daily Herald
Nempper: on the 30th day of July, 2025; and
WHEREAS, the Planning and Zoning Commission has submitted its findings
and recommendations of approval, with specific conditions, to the President
and Board of Trustees in support of the request being the subject of PZ-17-25;
and
WHEREAS, the President and Board of Trustees of the Village of Mount
Prospect have given consideration to the request herein and have determined
that the same meets the standards of the Village and that the granting of the
proposed conditional use permit would be in the best interest of the Village.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY,
ILLINOIS ACTING IN THE EXERCISE OF THEIR HOME RULE POWERS:
SECTION ON.,E.; That the recitals set forth hereinabove are incorporated herein
as findings of fact bythe President and Board of Trustees of the Village of Mount
Prospect.
S-ECTION TWO.;, The President and Board of Trustees of the Village of Mount
Prospect do hereby approve grant a conditional use permit to reduce the
interior (south) side yard from 7 feet to zero feet for the construction of a patio
at the property located at 631 South Albert Street, Case No. PZ-17-25, subject
to the following conditions:
1. The conditional use for the reduced interior side yard setback shall
apply only to the patio and shall not apply to any other principal or
accessory structure;
2. The improvements shall be in strict conformance with the plat of
survey attached as Exhibit "A";
3. If at any time in the future it is determined that the patio obstructs
the flow of water or somehow causes a drainage problem either on
site or on the neighboring property, corrective measures shall be
required;
4. A 4-foot-tall fence shall be installed adjacent to the patio for the
Lifetime of the patio; and
5. The Petitioner shall revise the existing building permit plans and
reconstruct the patio, stoop and walkway in full compliance with the
Village's current codes.
SECTION THREE: Except for the conditional use granted herein, all other
applicable Village of Mount Prospect, Illinois ordinances and regulations shall
remain in full force and effect as to the Subject Property.
SECTION FOUR: The Village Clerk is hereby authorized and directed to record
a certified copy of this Ordinance and Exhibit "A" with the Recorder of Deeds of
Cook County.
SECTION FIVE: This Ordinance shall be in full force and effect from and after
its passage, approval and publication in pamphletform in the manner provided
by law.
