R-04-25 A RESOLUTION GRANTING CONDITIONAL USE APPROVAL FOR A REAR YARD SETBACK REDUCTION AND A PATIO SETBACK REDUCTION FOR PROPERTY LOCATED AT F"RAI E.A" E UE _MQNT —P.R .1LU ""I WHEREAS, Jereme Smith ("Petitioner") filed an application for conditional use approval to reduce the rear yard setback and patio setback for the property commonly known as 224 Prairie Avenue ("Subject Property") in the Village of Mount Prospect, Illinois and legally described as: Lot 1 in the Prairie Avenue, being a subdivision of the East half (1/2) of the North half (1/2) of the Northeast half (1/2) of the Northeast quarter (1/4) of the Southeast quarter (1 /4) of the Northwest quarter (1 /4) of Section 10, Township 41 North, Range 11 East of the third principal meridian. In Cook County, Illinois, according to EL the Plat thereof recorded November 9, 2018 as Document 1831334082; PROPERTY INDEX NUMBER: 08-10-114-150-0000; and WHEREAS, the Petitioner seeks conditional use approval to reduce the minimum rear yard setback from 25 feet to 18.9 feet for the construction of an addition and a conditional use to reduce the minimum patio setback from 15 feet to 11.53 feet for the construction of a patio at 224 Prairie Avenue; and WHEREAS, a public hearing was held on the request for a conditional use permit being the subject of PZ-04-25 before the Planning and Zoning Commission of the Village of Mount Prospect on the 22nd day of May, 2025, pursuant to proper legal notice having been published in the dQro__T -i. newspaper on the 7th day of May, 2025; and NOW, THEREFORE, the Planning & Zoning Commission does hereby grant conditional use approval to reduce the minimum rear yard setback from 25 PZ-04-25 feet to 18.9 feet for the construction of an addition and a conditional use to reduce the minimum patio setback from 15 feet to 11.53 feet for the construction of a patio at the property known as 224 Prairie Avenue, subject to the following conditions: a. The improvements shall be in strict conformance with the site plan prepared by DII Architecture, bearing the latest revision date of 04.12.25; b. No fill will be permitted within the drainage easement; the existing flow path from south to north along the easement must be preserved; and c. The building permit submittal shall show any sump pump or downspouts to be extended under the patio on the plan, and the points of discharge shall extend no farther than two feet (2') beyond the patio. Except for the conditional use approvals granted herein, all other applicable Village of Mount Prospect, Illinois ordinances and regulations shall remain in full force and effect as to the subject property. PASSED AND APPROVED the 22rd day of May, 2025 and effective five (5) days after this date, as provided for by Section 5.504.0 of the Mount Prospect Village Code.
