Tobacco establishment licenses are non -transferable; therefore, the petitioner must obtain conditional use approval to purchase the business. The proposed business meets the standards for a conditional use and staff is therefore supportive of the request. Discussion The subject property is a single -story multi -tenant commercial building with a mixture of retail, restaurant, medical and professional office, personal services, and institutional uses. The tobacco establishment, 92 Smoke and Vape, has operated at 1703 West Algonquin Road since 2020. The petitioner, Samantha Savarimuthu of Quality Retail Solutions Inc, proposes to purchase the existing tobacco establishment at the subject property. The petitioner stated in the application that the business will be a full -service tobacco, vape, novelty, and clothing store. According to the business plan, the petitioner intends to 1) expand product offerings by introducing shoes and apparel and enhancing the novelty selection with giftable and collectible items; 2) increase marketing and advertising through social media, digital marketing, local promotions and sponsorships, and a customer loyalty program; and 3) improve operations through updated inventory management systems and expanded store hours. The proposed hours of operation are 10AM - 12AM daily. The petitioner notes in the application that the business will adhere to all local, state, and federal laws regarding the sale of tobacco and vape products, and the store will be operated exclusively by family members over the age of 22. The petitioner proposes to use the existing floor plan with no interior or exterior renovations requiring a building permit. The subject property is zoned B-3 Community Shopping. The shopping center is striped with 162 parking stalls. The proposal does not involve a change in use which warrants additional parking. The petitioner submitted a business license application and a tobacco establishment addendum according to the requirements of Village Code Chapter 11, Article 8 for Sale of Tobacco and Related Products. CONDITIONAL USE STANDARDS, FINDINGS OF FACT AND STAFF'S RECOMMENDATION Staff has reviewed the petitioner's request for a conditional use to operate a tobacco retail establishment and finds that the standards have been met. Staff finds that the proposal will not endanger public health, safety, morals, comfort, or general welfare. The business has operated for five years at this location and no substantial changes are proposed for the uses and services provided. PUBLIC HEARING At the public hearing held on May 22, 2025, the Planning and Zoning Commission unanimously recommended approval of the conditional use request by a vote of 5-0. No members of the public submitted comment ahead of the meeting or were present to discuss this request. FIRST READING AT VILLAGE BOARD - JUNE 3RD, 2025 Per the attached PZ-05-25 Update Memo, several concerns were raised by the Village Board at the first reading of the approving ordinance at the June 3rd, 2025 Village Board Meeting. Namely: 1. Exterior lighting of the business, including window lighting 2. Signage advertising tobacco products, advertisements, decals, or other displays visible to the public 3. The sale of branded or novelty items, apparel, and footwear that could be marketed towards youth or adolescents For context, the previous operator of the space - who has no known affiliation with the current applicant - received a citation for selling to a minor approximately four years ago. No further violations have been recorded since that time. In response to these concerns, the petitioner has submitted additional materials and agreed to business modifications to address these issues. The new owner has agreed to substantially reduce the amount and kind of signage to be placed on the business, only sell generic apparel or footwear items, and only have building -mounted light fixtures, removing the existing window LED fixtures. Based on these findings, staff recommends approval of the conditional use request, subject to the following amended conditions (aimendiirnent in INlue): 1. ALGONQUIN ROAD — AMENDED STAFF RECOMMENDATION Background This memorandum provides an update on staff's revised recommendation to approve the conditional use request authorizing the transfer of a 1,200 square -foot tobacco retail business at 1040 Northwest Highway. In response to concerns raised during the initial presentation to the Village Board, the Petitioner has submitted supplemental documentation and agreed to additional conditions of approval. Based on this new information and staff's review, we are recommending approval with amended conditions. Summary of Information Concerns raised by the Board centered on the nature of the merchandise, marketing practices, and visibility of tobacco or vape-related products. In response, the Petitioner has submitted a letter to the board, initial inventory plan, and a business plan (Exhibit A). They have made the following clarifications and commitments: 1. Merchandise for sale will include only basic apparel items such as plain white t-shirts, sweatpants, and undershirts— none of which are branded ortargeted toward minors. 2. The business will enforce mandatory ID checks for all customers, without exception. 3. There will be no window signage or exterior lighting beyond what is necessary to display the business name and hours of operation on the front door. Additionally, the Petitioner has successfully completed a comprehensive background check, including fingerprinting and three personal reference verifications. All references attested to the Petitioner's character. The owner of the shopping center also submitted a letter of support (Exhibit B). For context, the previous operator of the space — who has no known affiliation with the current applicant — received one citation for selling to a minor approximately four years ago. No further violations have been recorded since that time. The following amended conditions are designed to mitigate the potential impacts identified by the Village Board while still allowing the business to operate. First and foremost, I respectfully remind the Board that our application is for an ownership transfer only. The location in question has operated as a tobacco establishment for years, and we are not seeking to open a new store or introduce new products that have not already been available to the community. Our goal is to continue serving the community while enhancing the store by adding clothing, shoes, and other general merchandise such as scents and perfumes. We have worked diligently to meet every requirement set forth by the Village of Mt. Prospect. Our team has successfully passed all background checks, submitted a comprehensive business plan with detailed financial projections, and clearly outlined our intentions for the business. We are committed to upholding the highest standards of compliance and integrity. We understand and share your concerns regarding the sale of tobacco products to minors and individuals under 21. As members of a family with deep roots in this business, and as lifelong residents of Mt. Prospect, we are acutely aware of the responsibility that comes with this license. We know that there are those in this industry who have not acted in good faith, and we want to assure you that we are not among them. It has been brought to our attention that certain members of the board have expressed concerns about the proximity of the library in the plaza. We would like to respectfully point out that the last two tobacco licenses in the area were issued while the library was already in place, and no issues were raised at that time. Additionally, as part of the approval process from the Community Development Office, we were required to place a large sign in the strip mall, visible to all patrons, announcing that this matter was subject to a public hearing. The Community Development office did not receive any concerns or comments from residents in the area, which we believe demonstrates that the community is comfortable with this transfer. Furthermore, we were required to send certified letters to all property owners within 500 feet. Out of 500 letters sent, not a single person expressed any issue with this transfer. All we are asking for is the same opportunity that has been afforded to other local businesses. If this were a brand-new store, I would understand any hesitation, but this is simply an ownership transfer. We are honest, ethical, and community -minded individuals —the sons and daughters of immigrants from farming communities in India. We deeply value compliance, community growth, and the well-being of our society and youth. There is a saying from back home: "We never sell the cow, because then we lose the milk it gives us." For us, selling tobacco to a minor and risking our license would be the same as selling the cow —we would lose the very foundation and future of our business for a short-term gain. We are investing $50,000—$60,000 into inventory alone —no small sum for me as a 23-year-old entrepreneur. The business is already cash -flow positive without relying on illegal sales, and as we are purchasing it cash without taking on financing nothing would change about this.
