Action Item
This memorandum transmits the bid results for the Central Gateway Plaza Demolition and
Restoration Project. This project has been identified as a high -priority management action in
the 2025 Village of Mount Prospect Strategic Plan.
The Central Gateway Plaza site is located at 310 West Northwest Highway. The Village
purchased this property in June 2024 and took possession of the property on November 30,
2024. The property hosts a one-story, masonry, commercial building with no basement. Most
recently, the building and property were the site of an automotive repair facility. The property
had previously been the site of a commercial gas station. The building is currently vacant and
ready for demolition.
The restoration plan for this site primarily features permeable surfaces including various
plantings, trees, shrubs, turf, and seasonal flowers. The site will also host a clocktower as the
main architectural centerpiece at the heart of the plaza. A small amount of brick sidewalk will
be installed within the plaza to access the clocktower and six new public parking spaces will be
installed along the eastern edge of the property. A new garbage enclosure, some nominal
pedestrian -level lighting, curb -cut removal, and brick replacement in the adjacent Central
Road and Northwest Highway rights -of -way will also be included in the project scope.
A copy of the proposed restoration plan is enclosed for reference.
Staff has prepared a detailed bid document to solicit bids for demolition and initial site
restoration work. The scope of the proposed work includes the complete removal of the
existing building, including floors, foundations, and footings. All asphalt in driveways or
parking areas is to be removed, as well as any stone or earth subgrade for a uniform depth of
24" across the entire site as measured from the original site surface elevation. Upon
completion of demolition, including all paved areas, all excavations are to be filled to the
original grade with clean, pulverized, and compacted black topsoil.
Demolition and site restoration work is expected to commence in June and be completed in
August. Installation of plant materials will take place in September or October. Staff plans to
install the clocktower in November or December.
Bids were let on April 30th, 2025. Invitations to bid were distributed to 10 firms that have
submitted bids on prior demolition projects. A bid notice was posted on the Village website and
the DemandStar bid clearinghouse website.
A non -mandatory Pre -Bid Meeting was held at the site on May 19th, 2025. Bids were received
at 1:00 PM on Friday, May 23rd at Mount Prospect Village Hall, 50 South Emerson Street,
Mount Prospect, Illinois. Seven bids were received. The results are indicated in the table
below:

Discussion
The apparent lowest -cost bid was submitted by Fowler Enterprises of Hampshire, Illinois
(Fowler). Fowler properly submitted and signed all bid documents and provided necessary bid
security. There were no mathematical errors in the firm's bid submittal.
Fowler has not performed work for the Village of Mount Prospect in the past. The firm provided
numerous references for local government agency demolition work, including Kane County, Elk
Grove Village, the Village of South Elgin, the Village of Franklin Park, the Village of Skokie, and
the Arlington Heights Park District. Reference checks with these entities indicated the firm
performed exceptionally well in all cases and completed all work on time and under budget.
Staff also interviewed the firm's principal, Jake Fowler. Mr. Fowler affirmed he can complete all
work at the bid prices indicated.
It is the opinion of staff that Fowler Enterprises has sufficient experience, skill, and resources
to complete the proposed work at the bid prices submitted.
Staff also recommends including a 10% contingency in the contract award for this project to
facilitate payments for variances in quantities and unanticipated conditions. A 10%
contingency would increase the contract award to $186,692.

Location of one (1) Village -owned building and parking lot to be demolished and removed:

Each bidder shall submit the following data with their bid:
1) A statement that the bidder maintains a permanent place of business and an address, therefore.
2) At least four (4) references in the Northwest Suburban Cook County area who can attest to the
contractor's ability to fulfill this contract in a competent and expeditious manner. Include name,
address, phone number, and email address for cash, reference; also include nature and size of each
contract. Specific experience with demolition and site remediation of former gas stations/repair
garages preferred.
Any bidder may be required by the Village to submit additional data to satisfy that the bidder is prepared
to fulfill the contract.
Other Conditions
The right is reserved to reject any or all bids, have predetermined qualifications, and/or to waive any
informality in any bids and to accept any considered advantageous to the Village of Mount Prospect,
Illinois.
No proposal may be withdrawn without the consent of the Village of Mount Prospect, Illinois, for a period
of one hundred (100) days after the tinge for opening the bids has passed.
Any contractor whose bid is in serious contention for possible award must, upon request, furnish the Village
with a financial statement, duly sworn to, oil 'forms approved by the Village, age, listing assets and I iabi I ities.
A cashier's check, certified check, bank draft, or bid bond in an amount not less than ten percent (10%) of
the amount bid must accompany each proposal. Any deposit accompanying a proposal, except those of the
two low bidders, will be returned Promptly alter the Village Board makes the award of the work.
The deposit of the successful bidder and that of the second lowest bidder will be returned upon the execration
and delivery of a contract and performance bond. If all bids are rejected, all deposits will be returned
promptly. If the successful bidder withdraws his proposal after tile closing time for receipt of proposal,
or if the bidder fails or refuses to execute contract or to provide the required performance bond within ten
(10) days from the date of receipt of written notice to do so, tile deposit accompanying his proposal may
be forfeited and retained by the Village of Mount Prospect as liquidated damages and not as a penalty.
Bidders are advised to visit the site of the proposed work and to inforril and ttIilliljarize thernselves as to
the location, condition, topography, and any obstacles which may be encountered, or other relevant inatter
concerning the work to be performed. No extra compensation will be allowed for the successful contractor
for failure to inform or familiarize themselves with the site prior to the bidding. Bidders may inspect the

All bids, must be, delivered to the office of the Village Manager, 3r(l floor, 50 South Enicrsoii Street, on or
before 1:00 I'M CST on May 23, 2025. Bids arriving after the specified time will not be accepted. Mailed
bids that are delivered to the Village Manager's office after the specified time will not be accepted
regardless of the postmarked time on the envelope.
All bids shall be submitted in scaled envelopes showing the following informatiow Bidder's name, address,
stwbject matter of proposal, and designated date and tinge of bid opening. Be sure to mark the outside of
tile sealed envelope, "Central Gateway I-Iroject Demolition & Restoration Bid."
Faxed bids will not be accepted. E-mailed bids will not be accepted.

The successful bidder shall furnish a performance bond in the full amount of the contract within ten (10)
calendar days after notification of the contract award. Failure to furnish the required bond within the time
specified may be cause for rejection of the bid, and any bid deposit may be retained by the Village as
liquidated damages and not as a penalty.
Notice of Starting Wor
The contractor shall notify the Village Public Works, Police, and Fire Departments thirty- six (36) hours
before beginning any work on the contract.
Assignment
No part of the work herein specified shall be assigned without the consent of the owner.
Work Prosecution
The work undertaken in this contract shall be carried out regularly, without interruption, and with SLICII
force as to conform to the rate of progress given and to secure its completion in full oil or before the dates
hereinafter mentioned. The rate of progress and the time specified for completion of tile work are essentials
of the contract. All work is to be completed within 60 days of contract award and notice to proceed.
Sus erasion of Work
Should the contractor, with the approval of the Village, stop work, or should the weather conditions, in the
opinion of the Village, be such that tile work could not be performed properly and safety, the Village may
suspeii(I the work until such time as conditions shall permit proper completion. in case of stoppage of work,
the contractor shall, at his (),wn expense, store and be responsible for material, restore streets, protect the
work, and be responsible for all accidents as if the work were in progress.
Work on Holida
The work under these specifications shall not be performed at night, on Sundays, or on legal holidays

without the approval of the Vi I lage. It is tile intention or these specifications that all labor and operation Of
equipment, connected with the work shall be performed during the hours between 7:00 AN, and 7:00 P.M.,

7:00 PM) provided sufficient prior notification is given to the Village.
Payment
It is expressly understood that the Village reserves the right to direct that no payment be made to the
contractor should the Village have reason to believe that said contractor has fai led, for any reason, to make
just payment to any workman or employee, or has failed to make payment for any materials used in the
work, until the Village is satisfied that full and proper settlement has been made.
The contractor shall secure and file with the owner waivers of lien for all materials used, for disposal
charges, and for labor employed on the work before final payments are disbursed.
Upon total completion, including restoration, the contractor shall, upon submittal of his invoice, be paid in
full for that portion of the work.

authorized representative, but such inspection shall not relieve the contractor frorri any obligation to

Any work not done strictly in accordance with the specifications shall be corrected and made good by the
contractor whenever ordered by the Village, without reference to any previous oversight or error in
inspection and at no extra cost to the Village.
The contractor upon receipt, of instructions from the Director Of Public Works or his authorized
representative to discontinue such practice shall immediately discontinue any practice, obviously
hazardous.
The contractor shall abide by all EPA and OSHA safety standards and hazardous material regulations and
shall obtain any permit and make the proper disposal of same as required by them.

The contractor shall, at all times, have a competent foreman or superintendent on the job who shall have
full authority to act for the contractor an(] to receive and execute orders from the Director of'Public Works
or his designated representative, and any instructions given to such Superintendent or person executing
work for the contractor shall be binding on the contractor as though given to him personally. The
contractor's represerwitive must be proficient in the use and interpretation of the English language.
The contractor shall always maintain good public relations.
Accident Prevention
The contractor shall always take every precaution for the protection of people and properties. The safety
provisions olr all applicable laws and ordinances shall be strictly observed, including those of the EPA,
OSU A,, IDOL, and the Village of Mount Prospect.

Everything pertaining to this project shall be at the sole cost and risk of the contractor from the initial start
until final acceptance by the Village. The contractor shall provide and maintain all necessary barricades
and protective devices for the safety, convenience and protection of the public in the vicinity ortlie project.
The method of demolition or removal shall comply with all provisions of the ordinances, rules, and
regulations of the Village.
To minimize the amount of dust during demolition, the contractor must wet down the masonry. Use of
water from the fire liydrant is permissible, but the contractor InUSt Supply the hose. This water IIILIst be
metered, and the Village, upon request, will furnish the hydrant meter and backflow prevention assembly.
There will be no charge for the use of water.
Repair or all damage done to sidewalks, curbs, streets, buffalo boxes, light standards, or other strLICtureS,
including adjacent private property, during the operations of this contract shall be at the contractor's
expense, Repairs or replacement shall be accomplished as soon as possible after the damage has occurred.

OBSERVANCE OF LAWS, ORDINANCES, AND REGULATIONS
The contractor shall observe all ordinances in relation to obstructing streets, driveways, or alleys, keeping
open passageways and protecting same where exposed, and shall generally observe all laws, and ordinances
controlling or limiting those engaged in public work, which ordinances and laws are inade a part ofthese
specifications.
The contractor shall, always during the life of this contract, observe and abide by all federal, state, and local
laws which, in any way, affect the conduct of the work and with all decrees and orders of courts of
competent jurisdiction. The contractor must also secure all demolition and/or highway obstruction permits
from municipal, county, state, and federal governments.
All bidders are expected to cornply fully and completely with all applicable state and federal statutes, rules,
and regulations as they relate to hiring, wages, and any other applicable condition of employment..

In the event of the contractor's non-compliance with the provisions of this Equal Employment Opportunity
Clause, the Illinois Human Rights Act or the Rules and Regulations of the Illinois Department of I luman
Rights ("Department"), the contractor may be declared ineligible for future contracts Or subcontracts with
the State of Illinois or any of its political subdivisions or municipal corporations, and the contract may be
cancelled or voided in whole or in part, and such other sanctions or penalties may he imposed or remedies
invoked as provided by statute or regulation. During the performance of this contract, the contractor agrees
as follows:
1) That it will not discriminate against any employee or applicant for employment because or race,

Prevailinf! Wages
Al I wages paid by the Contractor and each subcontractor shall be in compliance with 'File Prevailing, Wage
Act (820 ILCS 130), as amended, except where a prevailing wage violates it federal law, order, or ruling,
the rate conforming to the federal, law,, order, or ruling shall goverri.The Contractor shall be responsible to
notify each subcontractor of the wages set forth in this contract and any revisions thereto. Ifthe Department
of Labor revises the wage rates, the revised rate as provided by the public body shall apply to this contract
and the Contractor will not be allowed additional compensation on account of said revisions.

The Contractor and each subcontractor shall submit monthly, in parson,
certified payroll to the public body in charge of the project.Thecertified payroll shall consist of a complete
copy ofthe records, ne certified payroll shall be
accompanied by a statement signed by the contractor or subcontractor which avers that:
(i) such records are true and accurate.
(ii) the hourly rate paid to each worker is not less than the general prevailing rate of hourly wages
required; and
(iii) the contractor or subcontractor is aware that filing a certified payroll that he or she knows to
be false is a Class B misdemeanor.
Upon 2 business days' notice, the contractor and each subcontractor shall make available for inspection the
records to the public body in charge of the project, its officers and agents, and to the Department ofLabor
and his deputies and agents at all reasonable hours at a location within this State. The Contractor and each
subcontractor shall permit his/her employees to be interviewed on the job, during working hours, by
compliance investigators of the Department of Labor.
Toxic Substances Disclosure
All bidders must comply with the requirements of the Toxic Substances Disclosure to Employees Act for
any materials supplied and covered by the said Act.

Contractor's -Insurance
The contractor shall not commence work under this contract until he has obtained all insurance required
under this paragraph and such insurance has been approved by the Village attorney, nor
shall the contractor allow any subcontractor to commence work on this contract until all similar insurance
required of the subcontractor has been so obtained and approved. (Date of coverage to be Of Such duration
as to include date of removal.) The contractor shall provide a certificate of insurance or other suitable
evidence that the following insurance coverage is provided on the work performed Under tile contract, and
the Village of Mount Prospect shall be named as an additional insured on all insurance policies:
Comprehensive General Liability Insurance, including, contractual liability insurance covering the
indemnification clause described herein, Products (completed operations insurance) and Contractor's
Protective Insurance. General Liability coverage shall be primary and non-contributory for the Village.
"I'lle minimum limits of liability must be $5,000,000 General Aggregate, per project, $5,000,000
Products/Completed Operations Aggregate, $5,000,000 Personal and Advertising Injury, and $5,000,000
each occurrence. Exclusions of property in contractor's care, custody, or control shall NOT be eliminated.
Worker's Compensation and Employer's Liability, as per statute, with Employer's Liability limit of
$1,000,000.
Owner's, Contractor's and Protective Liability Insurance in the name of the Village of Mount Prospect,
with limits of $1,000,000 each person, $1,000,000 each occurrence for bodily injury, and $1,000,000 each
occurrence for property damage.
The contractor shall indemnify and save harmless the Village of Mount Prospect against any and all
damages to property or injury to or death of any person or persons, including property and employees,
agents or invitees of tile Village of Mount Prospect, and shall defiend, indemnify and safe harrilless the
Village of Mount Prospect from any and all claims, demands, suits, actions or proceedings of any kind or
nature, including Worker's Compensation claims, or by anyone whosoever, ill any way resulting rrorn or
arising out of the operations in connection herewith, including operations of subcontractors and actions or

or of ernployces or agents of the contractor or his subcontractors, Insurance coverage specific
herein and in the Special Conditions constitutes the minimurn requirements, and said requirements shall in
no way lessen or firnit the liability, of the contractor under the terrils of this contract. The contractor shall
procure and maintain, at his own cost and expense, any additional kinds an(] amounts of insurance which,
in his Own judgment, may be necessary for his proper protection in the prosecution of the work.
The contractor agrees that he will well and truly save and indemnify and keep harmless the Village of
Mount Prospect against all liability, judgments, costs and expenses that may, in any way, result from
carelessness or lack of the contractor or his agents, employees, or workers in any respect whatsoever.
,FORFEITURE CLAUSE
If, in the judgment of the Director of Public Works, the rate at which tile work, is performed is not such as
to insure its progress and completion in the time and nianncr herein specified, or if at anytime the contractor
refuses or neglects to prosecute the work with the: force sull'icient for its completion within the specified
time, or if in any event the contractor fails to proceed with the work in accordance with the requirements
and conditions of the specifications, the Village shall have full right and authority, after giving three (3)
days written notice to the contractor of its intention to do so, to take the work out of the hands of the

contractor and/or to relet the same to other contractors.
The cost of fully completing all the work and all expenses of every kind incurred by the Village, in
connection therewith shall be charged to the contractor and shall be deducted and paid by the Village out
of such monies as may be due or may at any time thereafter become due to said contractor under this
contract or any part thereof, so far as the same shall suffice therefor, and any deficiency shall be paid to the
Village by the contractor forthwith, and the bondsmen will be held liable for any such deficiency.
Should it become necessary for the Village to declare the work forfeited, such forfeiture shall in no case
relieve the contractor or his bondsmen of any of the conditions of the contract.
In case the contractor shall abandon or in any manner fail to complete the work, the Village shall have the
full right and authority to pay to any laborer or laborers who may have been employed by the contractor
upon the work Out of any fund due Or unpaid the contractor, at the time the Village shall declare said
contractor in default, any and all sums of nioncy which may be found to be due and owing to said contractor
under this contract and upon giving five (5) days written notice by mail to said contractor of the intention
to do so. And, in every such case, the Village shall have the full right and authority to ascertain the amount
or amounts so due and owing to such laborer or laborers from the contractor and in such manner and upon
such proof as it may deem SUfficient, and the amount or amounts so found by it to be due and owing to
such laborer or laborers shall be conclusive as against said contractor and may thereafter be paid over to
the said laborer or laborers by said Village.

TECHNICAL SPECI-FICATION'S
The intent of these specifications is to define the conditions and obligations under which the contractor will
be working and ensure that the demolition and removal of the structures described above is done ill a SAIC
and workmanlike manner.
General 1_nforniation
,1,11c Village ol'Mount prospect owns the property included ill this bid. 310 West Northwest I lighway is a
one-story, masonry, commercial building with no basement. Most recently, the building and property were
the Site of' all automotive: repair facility. In the more distant past, the property was also the site of a
commercial gas station. The building is vacant and ready for demolition.
This demolition contract includes the complete removal of the existing building, including floors,
foundations, and footings. All asphalt in driveways or parking areas is to be removed, as well as any stone
or earth subgrade for a uniform depth of 24" across the entire site as measured frorn the original site stirface
elevation. Upon completion of demolition, including all paved areas, all excavations are to be filled to the
original grade with clean, pulverized, all(,] compacted black topsoil.
Special Conditions
The former automobile repair garage at 310 West Northwest Highway has been surveyed for the presence
of asbestos by all environmental consultant. A Hazardous & Other Regulated Material Survey was
performed oil this, structure by file Village's environmental consultant True North. All hazardous or
regulated materials found have been removed and properly disposed by Village staff. A copy of True
North's report can be found in the appendices.
Scope of Work
I , The work performed under these speci ii cations shall include the furnishing of all materials, labor,
cqLdprnent, and tools to demolish and completely remove the building, floor slabs, foundations,
footings, pavements, as well as requisite fill and soil.
2. The Village, shall affallgO for' the disconnection of the gas, electric, COITIMUnications, water and
sewer utilities, Gas, electricity, and communications will be disconnected at Ille utility trunk line
in the public right-of-way or easernent. The water will be disconnected at the Village -owned water
main. The sewer service will be abandoned in place with the connection to the Village, sewer n1aill
sealed by means of cured -in -place -pipe (CIPP) lining by the Owner.
3. The contractor shall provide temporary 6-foot chain link security fencing around the perimeters of
sites as well as any necessary signage or barricades. If the sites are not properly secured, the Village
of Mount Prospect may stop work.
4. All material and contents in the buildings at the start of demolition will become the property of the
successful bidder and may be used as salvage. The contractor shall include in his bid the entire cost
of removal and proper disposal and/or recycling of all demolition debris pursuant to the State of
Illinois and Cook County requirements.
5. Unstained asphalt and concrete pavement shall be recycled pursuant to the State of Illinois and
Cook County requirements.
6. Clean, unstained stone pavement base shall be recycled pursuant to the State of Illinois and Cook
County requirements.
7. Soils requiring off -site management should be designated as non -hazardous waste and disposed of
at a Subtitle D landfill. The Village of Mount Prospect's environmental consultant (True Nortli)
will perform waste characterization testing and establish a waste profile with the successful

bidder's landfill. There is no cost to the contractor for waste characterization of soil to be removed
from the site. For general reference, attached are soil analytical summary tables from Site
Remediation Program reporting submitted to IEPA.
3. Restoration of the site will require a minimum of"24" of imported„ placed, and compacted topsoil.
All placed topsoil shall be clean, black,„ pulverized topsoil mechanically compacted to 75%-85%
of its niaxinwin dry density in lifts no greater than 6" at a time. Placed, compacted topsoil shall.
restore the site to its original topography.
9. All imported topsoil utilized at the site shall also be from a virgin source with supporting
documentation or tested for target compound list (TCL) parameters to confirm Tiered Approach to
Corrective action Objectives (TACO) Residential Tier 1 Site Remediation Objectives compliance
at a frequency of one, (1) sample per :500 cubic yards of topsoil. The contractor shall include the
cost of sourcing, transporting, testing, and p�la&ng imported topsoil in the bid price.
10. There are Tier 1 residential clean-up objectives exceedances in some of the existing soil on the site.
a. Due to the ,presence of contaminants at the site, the contractor shall develop and implement
a safety plan to address possible worker exposure if excavation activities occur within the
contaminated soil. Any excavation within tite contaminated soil will require
implementation of a safety plan consistent with NIOSH Occupational Safety and Health
Guidance Manual for Hazardous Waste Site Activities, OSHA regulations (particularly in
29 CFR 1910 and 1926), state and local regulations, and other USEPA guidance. Soil
excavated below ground surface must be returned to the same depth from which it was
excavated or properly managed or disposed of in accordance with applicable state and
federal regulations.
11. The contractor shall make all necessary provisions to safeguard surrounding properties. Public
sidewalks adjacent to the site can be closed to pedestrian traffic provided Village -approved
barricade, signage, and pedestrian detour routes are utilized. The contractor's equipment must not
interfere with vehicular traffic.
12. No explosives or burning are permitted.
13. The contractors shall take appropriate measures to keep dust down to a minimum in accordance
with Village building codes. The Village will supply a hydrant meter and backflow preventer.
Water utilized for dust control will not be billed but all water use must be metered.
14. The contractor shall completely remove all foundations, footings, floor slabs, concrete floors,
basement walls, private walks, and/or miscellaneous concrete structures to the satisfaction of the
Director of Public Works or his designated representative.
15. The contractor must secure necessary permits from the Village of Mount Prospect Building
Division located on the second floor at 50 S. Emerson Street. The contractor shall abide by all
rules and regulations governing that permit. Fees for the Village permits shall be waived. The
contractor ntust have a Village of Mount. Prospect business license for which the fee will not be
waived. A State of Illinois hermit may be required; il'so, it is the contractor's responsibility to
obtain same. Any ,permits which May be required by 111,PA, US11,13A, or Coop County will be the
responsibility of the contractor, Any or all barricades for lance closures shall be the responsibility
of the contractor.
16. To the best of the owner's knowledge, all underground storage tanks have been removed from the
site.
17. It is the responsibility of the contractor to obtain all lane closure pennitMs (if needed) for Northwest
Highway, or for Central Road, (if needed) frorn the State of Illinois Department of Transportation.
18. It is the contraetor's responsibility to not encroach upon adjoining private property and to seep
cooperation Irortt appropriate individuals ifthere is a need to temporarily relocate their automobiles
during removal of the buildings.
19. The tentative timetable is to have all properties cleared and backfilled by August 30, 2025. The
contractor will have a n°taximum of 60 days from the order to proceed to the tentative deadline.
20. Alterations or modifications of this work shall be made only by written agreement between the

Village and the contractor before the alterations or inodifications are started, No claim for extra
work or materials will be allowed, unless it is covered by the agreement.
21. The Village requires the abandonment and sealing Of the nille, (9)� existing groundwater wells in
accordance with 77 IAC 920.120. The attached Site Area Features map from Leaking tJnderground
Storage Tank (LUST) program reporting identifies the locations of monitoring wells.

applicable) in accordance with applicable regulatory requirements, including the Illinois
Departrnent of Public Health and Cook County Department of Public Health, Prior to
initiation, any applicable pennit(s) shall be secured ror well abandonmentThe wells shall
be filled and sealed with neat cement grout or any bentonite product manufactured for well
sealing from the bottom up to where the casing is removed. The well casings shall be
removed to a minimum of two feet below ground surtlice. The associated surfacing
materials, inclusive of a well box and concrete pad and/or protective riser casing shall be
removed and transported off -Site by the contractor. Any applicable water well -sealing
forms must be completed and provided to the Owner and any governing regulatory agency
following abandonment activities.

WHEREAS, the Village has solicited competitive bids for the performance of the work specified in the

A. Within fifteen (15) days after the date of award of the Contract, the Contractor shall furnish and
deliver to the Village an executed original of this Agreement, a performance bond, and the
insurance certificates and policies required by the Contract Documents.
B. The Contractor shall commence performance of the Work and complete performance of the
Work, in accordance with the schedule set forth in the Contract Documents, but in no event shall

any Work be performed prior to the Village's receipt of this Agreernent, executed by Contractor,
and the Village's acceptance and approval of the perforniance bond, letter of credit and insurance

ARTICLE V - SUCCESSORS AND ASSIGNS
The terms of this Agreement shall be binding upon and inure to the benefit of the parties and the partners
and officials, successors in interest, executors, administrators, assigns and representatives and their
respective successors and assigns, provided, however, that the Contractor shall not assign, sublet or
transfer any rights or interest in this Agreement in whole or in part without the prior written approval of
the Village, except to the extent that the Contract Documents provide otherwise.
ARTICLE VI -VENUE
The parties hereto agree that for purposes of any lawsuit(s) between them concerning this Agreement, its
enforcement, or the subject matter thereof, venue shall be in Cook County, Illinois, and the laws of the
State of Illinois shall govern the cause of action.

True North Consultants, Inc. (True North) was retained by the Village of Mount Prospect (Client) to conduct
sampling and analysis of suspect asbestos -containing materials (ACM) and suspect lead -based paint (LBP)
that may potentially be impacted by planned demolition activities within the Formula Auto Repair Shop located
at 310 Northwest Highway in Mount Prospect, Illinois (Site). Testing services were provided by a licensed
Illinois Department of Public Health (IDPH) Asbestos Building Inspector (Todd Huffer) and Lead Risk Assessor
(Ms. Roxana Ordonez) on August 30, 2024.
The purpose of the sampling was to determine the asbestos -content of building materials and lead -content of
painted surfaces likely to be impacted by planned renovation activities at the Site. A total of nineteen (19) bulk
material samples and three (3) paint chip samples were collected during the sampling event. Asbestos bulk
samples were submitted to a National Institute of Standards and Technology (NIST), National Voluntary
Laboratory Accreditation Program (NVLAP) accredited laboratory, for analysis (EMSL). Paint chip samples
were submitted to an American Industrial Hygiene Association (AIHA) National Lead Laboratory Accreditation
Program (NLLAP) accredited laboratory, for analysis (iATL Laboratories - Accreditation No. LAP-100188).
Suspect Asbestos -Containing Material Sampling
Bulk samples of the homogeneous materials were analyzed for asbestos content in accordance with the
procedures for Polarized Light Microscopy (PLM) with dispersion staining, contained in the Environmental
Protection Agency (EPA) Method for the Determination of Asbestos in Bulk Building Materials (EPA/600/R-
93/116). Results of sample analysis were reported as a percent composition. The following table is a summary
of analytical results for sampled materials:

The Environmental Protection Agency (EPA) defines asbestos -containing materials as those materials that
contain greater than 1 % asbestos. Based upon the results of analysis,
asbestos was not detected within
materials sampled at the Site.
Due to the health effects associated with asbestos exposure, various federal, state, and local agencies have
promulgated standards and regulations for the performance of asbestos -related activities. Specifically, ACMs
at the Site may be regulated by the Occupational Safety and Health Administration (OSHA), Environmental
Protection Agency (EPA), Illinois Department of Public Health (IDPH), and other local agencies. In that
asbestos was not identified within the sampled materials, the aforementioned asbestos regulations do not
apply to the disturbance or removal of said materials.
Suspect Lead -Based Paint Sampling
Three (3s) paint chip sampes was analyzed for lead content utilizing Flame Atomic Absorption
Spectrophotometry (AAS) in accordance with American Society for Testing and Materials (ASTM) Method
D335-85a. Results of sample analysis were reported in parts per million. The following table is a summary of

The USEPA / HUD Guidelines for the Evaluation and Control of Lead -Based Paint Hazards in Housing defines
LBP as paint that contains greater than 0.5% lead by weight (5,000 parts per million) or 1.0 mg/cm2 by X-ray
fluorescence. Based upon the results of analysis, concentrations of lead remained below the analytical
detection limit and the USEPA LBP Standard of 5,000 ppm for the three (3) collected sample.
Work activities that may result in occupational exposure to lead are regulated by OSHA regardless of the
concentrations present in material subject to renovation and/or demolition. In the event that work activities are
performed that could result in occupational exposure to contaminants of concern, appropriate control measures
should be implemented to protect workers, pedestrians, and the environment.
