AN ORDINANCE GRANTING A CONDITIONAL
USE TO OPERATE A TOBACCO RETAIL ESTABLISHMENT AT THE
PROPERTY 1703 WEST ALGONQUIN ROAD
MOUNT PROSPECT, ILLINOIS
WHEREAS, Quality Retail Solutions Inc (“Petitioner”), is seeking a conditional
use to operate a tobacco retail establishment for property located at 1703
West Algonquin Road and legally described as:
PARCEL 1: LOT 2 IN MARCO POLO'S SUBDIVISION, BEING A SUBDIVISION
OF THE EAST HALF OF THE NORTHEAST QUARTER OF SECTION 22,
TOWNSHIP 41 NORTH, RANGE 11, EAST OF THE THIRD PRINCIPAL MERIDIAN
IN COOK COUNTY, ILLINOIS.
PARCEL 2: EASEMENT FOR THE BENEFIT OF PARCEL 1 AS CREATED BY GRANT
MADE BY AND BETWEEN THE CRYSTAL TOWERS HOMEOWNERS
ASSOCIATION AND AMERICAN NATIONAL BANK AND TRUST COMPANY OF
CHICAGO AS TRUSTEE UNDER TRUST AGREEMENT DATED APRIL 12, 1984,
AND KNOWN AS TRUST NUMBER 60753 RECORDED AS DOCUMENT 27193862
FOR STORM AND SANITARY SEWERS.
PROPERTY INDEX NUMBER: 08-22-203-041-0000; and
WHEREAS, the “Petitioner” seeks a Conditional Use to allow a tobacco retail
establishment; and
WHEREAS, a Public Hearing was held on the request for a Conditional Use
being the subject of PZ-05-25 before the Planning and Zoning Commission of
the Village of Mount Prospect on the 22nd day of May 2025 pursuant to proper
legal notice having been published in the Daily Herald Newspaper on the 7th
day of May 2025; and
WHEREAS, the Mayor and Board of Trustees of the Village of Mount Prospect
have given consideration to the request herein and have determined that the
request meets the standards of the Village and that the granting of the
Conditional Use to allow a tobacco retail establishment would be in the best
interest of the Village.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY,
ILLINOIS ACTING IN THE EXERCISE OF THEIR HOME RULE POWERS:
SECTION ONE: That the recitals set forth hereinabove are incorporated
herein as findings of fact by the Mayor and Board of Trustees of the Village of
Mount Prospect.
SECTION TWO: The Mayor and Board of Trustees of the Village of Mount
Prospect do hereby grant a Conditional Use to operate a tobacco retail
establishment for property located at 1703 West Algonquin Road, Mount
Prospect subject to the following conditions:
1. The business shall hold a valid Mount Prospect business license;
2. Consumption of tobacco products on site is prohibited;
3. Compliance with all applicable local, state, and federal laws regarding
the sale and distribution of tobacco and related products;
4. Compliance with all applicable development, fire, building, and other
Village Codes and regulations; and
5. A new conditional use approval shall be required for:
a. A change of ownership involving 50% or more of the officers or
partners;
b. A change in legal entity; or
c. A change in location.
SECTION THREE: This Ordinance shall be in full force and effect from and
after its passage, approval and publication in pamphlet form in the manner
provided by law.
