These amendments aim to clarify procedures and promote efficient, respectful, and meaningful public participation. In addition, a minor amendment to Article XII, "Power and Duties" of the Special Events Commission relating to annual reporting is also proposed. Background: The Village Code currently provides general guidance on public comment during meetings. However, a need for specific procedures regarding time limits, conduct, and the scope of comments during board and commission meetings has been identified. The following are amendments to Chapter 5 of the Village Code as outlined in the proposed ordinance: Time Limits: Public comment opportunities are vital to local governance, offering residents a chance to share opinions and concerns. However, many municipalities place reasonable time limits on individual comments to ensure orderly and efficient meetings. A review of practices from comparable municipalities revealed the following approaches: Arlington Heights, Schaumburg, and Palatine enforce a three (3) minute time limit for public comment. The City of Des Plaines and Wheeling impose a five (5) minute limit and place a limit on visits to the podium. Rolling Meadows limits public comment to twenty (20) minutes, and Schaumburg, in addition to individual time limits, restricts its public comment period to 30 minutes. To ensure equitable opportunities for all to be heard, staff propose a standard time limit of three (3) minutes per speaker. Each speaker will be allowed one (1) opportunity to address the Board during Citizens to be Heard. Multiple visits to the podium during Citizen to be Heard will not be permitted. Each speaker will also be allowed one visit to the podium for public comment related to an agenda item. Speakers will not be allowed to make a public comment, speak or respond to another speaker from the audience. The meeting's chair will enforce the time and visit limits and decorum. Please note that this time restriction does not apply to public hearings. Speaker Registration: Several municipalities also require speakers to sign up before the meeting, sometimes with topic disclosures. The proposed ordinance requires individuals wishing to speak to sign in before the start of the meeting. A form will be provided at the entrance to the meeting and submitted to the chair before the meeting begins. The chair will be responsible for calling the speakers to the podium in an orderly fashion. Other Guidelines: The proposed ordinance includes language that any member of the board or commission is not required to immediately respond to public comment and discourages debate and discussion during the public comment period. Saecial Events Commission, Article XII "Powers and Duties" Staff recommends amending item D in section 5.1202 of the Village Code. It currently states, "the commission shall prepare a calendar of events for the village. Said calendar shall be presented to the mayor and board of trustees of the village on a quarterly basis". The proposed amendment to Chapter 5 dictates that the calendar shall be presented to the Village Board annually. Discussion Alternatives 1. Waive the rules requiring two readings of an amendment and approve the attached ordinance amending Chapter 5 of the Village Code 2. Action at the discretion of the Village Board. Staff Recommendation Staff recommends waiving the rules requiring two readings of and ordinance and approve the attached ordinance amending Chapter 5 of the Village Code Attachments 1. AN ORDINANCE AMENDING CHAPTER 5 "BOARDS AND COMMISSIONS," ARTICLE II "GENERAL REQUIREMENTS," AND ARTICLE XII, POWERS AND DUTIES" OF THE VILLAGE CODE OF MOUNT PROSPECT, ILLINOIS WHEREAS, the Village of Mount Prospect is a home rule municipality as defined by Article VII, § 6 of the Illinois Constitution of 1970; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect desire to make certain amendments to the Village Code of Mount Prospect as set forth below; and WHEREAS, pursuant to the authority granted under the Illinois Municipal Code and in accordance with home rule authority granted to home rule municipalities, the Mayor and Board of Trustees of the Village of Mount Prospect approve the amendments as set forth below. BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: Section 5.207 "Citizens to be Heard; Participation Guidelines at Public Meetings," of Article II, "General Requirements," to Chapter 5, "Boards and Commissions" to the Mount Prospect Village Code shall be amended to read as follows: 5.207: CITIZENS TO BE HEARD; PARTICIPATION GUIDELINES AT PUBLIC MEETINGS: In accordance with the requirements of section 2.06(g) of the Illinois open meetings act, 5 Illinois Compiled Statutes 120/2.06(g), any person attending a public meeting of any board or commission shall be permitted to address the public officials on any subject germane to that board, committee, subcommittee or commission during the public comment period. A. Speakers shall sign up on the public comment form prior to the meeting. B. Each ef&Gn speaker shall state his or her name and address at the start of his or her public comment. C. Each-pef&GR speaker may provide pre -prepared copies of his or her public comments prior to, during or after the public comment session. D. Abusive, foul or other inappropriate language or conduct and/or personal attacks are not permitted. Ch. 5 amendments 1/2 E. Each speaker shall approach the podium for public comment. No person shall be allowed to make a public statement or comment from the audience. Accommodation will be provided for those with physical or medical restrictions. F. Each speaker shall be allotted three (3) minutes to address the Corporate Authorities during Citizens to be Heard. No person shall be allowed to return again to the podium to address the Corporate Authorities under "Citizens to be Heard" G. Public comment related to an agenda item may be reserved for discussion on the specific item and speakers will be allowed one visit to the podium and allotted three (3) minutes to speak per agenda item. H. Speaker shall make every attempt not to be redundant or repetitive of points that have been made by others. to An immediate response, discussion or debate on public comments shall not be required of the Board or any member of the Board. J. The village president or chair has the authority to terminate the public comments of any person who fails to adhere to these guidelines. SECTION TWO: Section 5.1202, "Powers and Duties," of Article XII, "Special Events Commission" to Chapter 5, "Boards and Commissions" to the Mount Prospect Village Code shall be amended to read as follows: D. "the commission shall prepare a calendar of events for the village. Said calendar shall be presented to the mayor and board of trustees of the village on- an annual basis, accompanied by an events recap and update." SECTION THREE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
