ORDINANCE NO. 4315
AN ORDINANCE AUTHORIZING THE PURCHASE OP
PROPERTY FOR THE VILLAGE OF MOUNT PROSPECT TAX
INCREMENT REDEVELOPMENT PROJECT AND PLAN
WHEREAS, the Board of Trustees of the Village of Mount
Prospect, Cook County, Illinois, have heretofore adopted
Ordinance no. 3554 entitled AN ORDINANCE APPROVING THE TAX
INCREMENT REDEVELOPMENT PLAN AND REDEVELOPMENT PROJECT POR THE
DISTRICT NO. i REDEVELOPMENT IN THE VILLAGE OF MOUNT PROSPECT,
ILLINOIS and Ordinance no. 3555 entitled AN ORDINANCE DESIGNATING
DISTRICT NO. 1 TAX INCREMENT REDEVELOPMENT PROJECT ARRA IN THE
VILLAGE OF MOUNT PROSPECT, ILLINOIS, both of which having been
amended from time to time and all of which, including all
amendments, are incorporated herein in their entirety, =he
Redevelopment Plan and Redevelopment Project adopted pursuant to
said Ordinance no. 3554 and all amendments thereto being
collectively referred to herein as "the Plan" and the
Redevelopment Project Area designated pursuant to said Ordinance
no. 3555 and all amendments thereto being collectively referred
to as "the Area;' and
WHEREAS, the Board of Trustees of the village of Mount
Prospect has determined that the Plan, which was the subject
matter of public hearings, is in %he best interests of the
residents of the Village of Mount Prospect and is a public
purpose; and
WHEREAS, the Village of Mount Prospect is empowered,
pursuant to the Tax Increment Allocation Redevelopment Ac~,
Iii.ney. Stat., Ch. 24, ~11-74.4-1 et seq., as amended, to acquire
by purchase, real property within the Area; and
WHEREAS, the implementation of the Plan would attract to the
Village o~ Mount Prospect additional commercial yen=urea,
increase business for commercial ventures currently established
within the Village, strengthen the property and non-property tax
and income base~ and provide jobs for Village residents.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND EOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS,
as follows:
SECTION 1~ That it is hereby determined that the Plan
previously adopted, be established, maintained, controll~,
managed and operated within the corporate limits of the Village
of Mount Prospect, within the Area, and that said Area be
occupied, improved, used and developed in a manner necessary and
convenient for public use and in accordance with the Plan.
SECTION 2: That under the author4ty vested in the corporate
authorities of the Village of Mount Pro,peet through the statutes
of the state of Illinois, it is hereby det~rmtne~ that pursuant
to ~he Plan, it is necessary and desirable that the Villag. ~hall
purchase the real propcrty legally described in Exh{bit A which
is aKtached hereto and made a part hereof and hereinaft~r
referred to as the "Subject Proper~y," which Subject Property is
within the Area, and which ~ubjecK Property {s necessary,
required and needed to achieve the objectives of the Plan and
which Subject Property lles wholly within the limits of the
Village of Mount Prospect.
SE~ON 3: That the law offices of Barry A. Springer ~ and
it is hereby authorized, empowered and directed to negotiate
personally or through its representatives for and on behalf o{
said Village with the owner or owners of the Subject Property for
the purchase thereof by said Village.
SECTION4= That =his ordinance shall be in full force and
effect from and after its passage, approval and publication in
pamphlet form as provided by law.
