AN ORDINANCE GRANTING A VARIATION FOR PROPERTY
LOCATED AT 1007 WEST PENDLETON PLACE
WHEREAS, Dennis J. Hohol (hereinafter referred to as Petitioner)
has filed an application for a variation from Chapter 14 of the
Village Code of Mount Prospect, Illinois, for property commonly
known as 1007 Pendleton Place (hereinafter referred to as Subject
Property), legally described as:
Lot 77 in Alfini's Second Addition to Mount Prospect,
being a subdivision of part of the South 990 feet of the
East half (1/2) of the Northwest Quarter (1/4) of section
11, Township 41 North, Range 11, East of the Third
Principal Meridian, according to plat thereof registered
in the office of the Registrar of Titles of Cook County,
Illinois, on January 20, 1955, as Document Number
1571480;
and
WHEREAS, Petitioner seeks a variation from Section 14.1102.B to
allow a two foot 6 inches (2' 6") sideyard setback, rather than 6'
6" as required, to accommodate a 6 foot addition to an existing
garage; and
WHEREAS, a public hearing was held on the variations requested
being ~he subject of ZBA Case No. 26-V-91 before the Zoning Board
of Appeals of the Village of Mount Prospect on the 23rd day of May,
1991, pursuant to due and proper notice thereof published in the
Mount Prospect Herald on the 7th day of May, 1991; and
WHEREAS, the Zoning Board of Appeals has submitted its findings
and recommendation to the President and Board of Trustees of the
Village of Mount Prospect and the President and Board of Trustees
of the Village have given further consideration to the variations
being the subject of ZBA 26-V-91 and have determined that the best
interests of the Village of Mount Prospect would be served by
granting said variations.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are incorporated
herein as findings of fact by the President and Board of Trustees
of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village
of Mount Prospect hereby grant to the Subject Property a variation
from Section 14.1102.B to allow a two foot 6 inches (2' 6")
sideyard setback in order to construct an addition to an existing
garage as shown on the Site Plan attached hereto and hereby made
a part hereof as Exhibit "A".
SECTION THREE: Except for the variation granted herein, all other
applicable Village of Mount Prospect Ordinances and regulations

shall remain in full force and effect as to the Subject Property.
SECTION FOUR: In accordance with the provisions of Section 14.604
of Chapter 14 of the Village Code, the variations granted herein
shall be null and void unless permits are issued and construction
begins within one (1) year from the date of passage of this
Ordinance.
SECTION FIVE: This Ordinance shall be in full force and effect
from and after its passage, approval and publication in pamphlet
form in the manner provided by law.
