CAF 6/lo/9 ORDINANCE NO. 4322 ' AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY LOCATED AT 116 SOUTH I-OKA WHEREAS, Mark and Donna Hoffman (hereinafter referred to as Petitioners) have filed an application for variations from Chapter 14 of the Village Code of Mount Prospect, Illinois, for the municipal parking lot generally located at 116 South I-Oka (hereinafter referred to as Subject Property), legally described as: Lot 180 in H. Roy Berry Company's Colonial Manor, being a Subdivision of part of the Northeast Quarter (1/4) of Section 11 and part of the Northwest Quarter (1/4) of Section 12, all in Township 41 North, Range 11, East of the Third Principal Meridian, Cook County, Illinois and WHEREAS, Petitioners seek a variation from Section 14.102.B to allow a two foot ten inch (2' 10") sideyard setback, rather than the required 5', to accommodate a new garage, and a variation from Section 14.1103 to allow a Floor Area Ration (FAR) of 0.45, rather than 0'.35, to accommodate an addition to an existing home; and WHEREAS, a public hearing was held on the variations requested being the subject of ZBA Case No. 27-V-91 before the Zoning Board of Appeals of the Village of Mount Prospect on the 23rd day of May, 1991, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 7th day of May, 1991; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect and the President and Board of T~usteeS of the Village have given further consideration to the varlation~ being the subject of ZBA 27-V-91 and have determined that the best interests of the Village of Mount Prospect would be served by granting said variations. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property variations from Section 14.102.B to allow a two foot ten inch (2' 10") sideyard setback, and from Section 14.1103 to allow a Floor Area Ratio (FAR) of 0.45. The variations granted herein Permit the construction of a garage and an addition to an existing home, as shown on the Site Plan attached hereto and hereby made a part hereof as Exhibit "A". SECTION THREE: In accordance with the provisions of Section 14.604 of Chapter 14 of the Village Code, the variations granted herein shall be null and void unless permits are issued and construction ZBA 27-~-91 Page 2 of 2 begins within one (1) year from the date of passage of this Ordinance. SECTION FOUR: This Ordinance shall be in full force and effect and after its passage, approval and publication in pamphlet form in the manner provided by law.
