AN ORDINANCE GRANTING A VARIATION FROM
THE VILLAGE OF MOUNT PROSPECT ZONING
ORDINANCE AS A~mNDED
1f.HEREAS, a Notice of Public Hearing on the question
of granting a variation from the minimum side yard require-
ments, Section 13, Village of Mount Prospect Zoning Ordinance
as amended, with respect to the property hereinafter legally
described as follows:
Lot 6 in Block 4 in Central wood, being a sub-
division of the following described land: Be-
ginnin~ at the Southeast corner of the wt of
the SE~ of Section 33, Township 42 North,
Range 11 East of the 3rd Principal Meridian;
thence West along the South line of said Sec-
tion 33 a distance of 14.82 chains (978.12
feet); thence North along a line ~arallel to
the East line of the wt of the SE~ of said
Section 33 to the Southerly line Qf the right
of way of the Chicago and North Western Rail-
way; thence Southeasterly along said right of
way to the East line of the wt of the SEt of
said Section 33; thence South along said. last
mentioned line to the place of beginning, in
Cook County, Illinois.
was duly published in the Mount Prospect Herald, a newspaper
of general circulation in the Village of Mount Prospect; and
vlliEREAS, a Public Hearing was held by the Board of
Appeals of the Village of Mount Prospect in the Village Hall
in the Village of Mount Prospect on the 25th day of July,
1958, at the hour of 8:00 P.M. pursuant to the provisions of
the aforesaid public notice, and all persons who desired to
be heard were heard and an opportunity given to all persons
who desired to make remonstrances and objections with refer-
ence thereto; and
if-KEREAS, the Board of Appeals of the Village of Mount
Prospect, pursuant to Section 16(B)(2) of said zoning ordinance,'
subsequent to said hearing, recommended that the variation

requested be granted; and
vlliEREAS, the corporate authorities of the Village of
Mount Prospect, after considering the matter as aforesaid, do
hereby find as follows:
1. That the application of Section 13, Minimum
Side Yard Requirements, to the above-described property would
involve practical difficulties to the property owner in the
proposed use of such property based on the facts presented to
the Board of Appeals at the aforesaid public hearing;
2. That the application of Section 13, Minimum Side
Yard Requirements, to the above-described property would re-
sult in particular hardship to the owner of the property
hereinabove described in view of the dimensions of the pro-
perty and the particular conditions that exist on and sur-
rounding said property and the size and type of structure pro-
posed to be built on said property;
3. That the use of the above-described property, as
petitioned, for the erection of an attached garage no larger
than 16 feet wide by 22 feet deep with its North line running
parallel to the North line of the existing residence on said
lot and no closer at its Northwest corner than 16 feet to the
North lot line of said lot and no closer at its Northeast cor-
ner than 3 feet to the said North lot line satisfies the re-
quirements for variation in harmony with the general purpose
and intent of the zoning ordinance; and
vlliEREAS, the corporate authorities of the Village of
Mount Prospect do desire to grant a variation as hereinafter
set forth, which said variation is specifically limited as
herein provided,

NOvI" THEREFORE" BE IT ORDAINED BY THE PRESIDENT AND
BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT" COOK COUNTY"
ILLINOIS:
Section 1: That the following described property
be exempt from the application of Section 13" Minimum Side
Yard Requirements, of the Village of Mount Prospect Zoning
Ordinance as amended:
Lot 6 in Block L~ in Centrahmod, being a sub-
division of the following described land:
Beginning at the Southeast corner of the wt
of the SEt of Section 33, Township 42 North,
Range 11 East of the 3rd Principal Meridian;
thence West along the South line of said Sec-
tion 33 a distance of 14.82 chains (978.12
feet); thence North along a line ~arallel to
the East line of the wt of the SE~ of said
Section 33 to the Southerly line Gf the right
of way of the Chicago and North Western Rail-
way; thence Southeasterly along said right of
way to the East line of the wi of the SEt of
said Section 33; thence South along said. last
mentioned line to the place of beginning, in
Cook County, Illinois.
for the sole purpose of permitting the erection of an attached
garage no larger than 10 feet wide by 22 feet deep with its
North line running parallel to the North line of the existing
residence on said lot and no closer at its Northv-rest corner
-Gllan 16 feet to the North lot line of said lot and no closer
at its Northeast corner than 3 feet to the said North lot line.
Section 2: That the variation granted hereby apply
only towards any building permits for the purpose hereinabove
specified.
Section 3: That the zoning plan of the Village of
Mount Prospect, as amended, be and the same is hereby modified
to conform to the above variation.
Section 4: That this ordinance shall be in full
force and effect from and after its passage and approval ac-
cording to lavJ.

Section 5: That all ordinances or parts of ordi-
nances in conflict herewith be and the same are hereby
repealed, reserving however, to the Village of Mount Prospect
any rights which have accrued to it against any person, firm
or corporation under any ordinances or sections of the zoning
ordinance wlich may be and are hereby repealed.
