AN ORDINANCE;:fl tJ '
PROVIDING FOR THE MAKING OF A LOCAL
IMPROVEMENT IN AND FOR THE VILLAGE
OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS
BE IT ORDAINED BY the President and Board of Trustees of the
Village of MoUnt Prospect, Cook County, Illinois:
SECTION 1: That a local improvement shall be made in
the Village of Mount Prospect, Cook County, Illinois,
the nature, character, locality and description of which improvement
is as follows:
SECTION 2: That the recommendation of the Board of Local
Improvements of the Village of Mount Prospect,
providing for the improvement, and the estimate of the cost thereof
made by the President of the Board of Local Improvements, both hereto
attached and made part hereof, be, and the same are hereby approved.
SECTION 3: That said improvement shall be made and the
whole cost thereof, together with an amount
not exceeding six per cent (6%) of the estimated cost, to-wit:
TWO HUNDRED THIRTEEN THOUSAND FIVE HUNDRED FIFTY-FIVE AND 00/100 DOLLARS,
($213,550.00) which is hereby provided for to apply towards the cost
and expense of making, levying and collecting said special assessment
and all other expenses allowed by law, being the amount included in
the estimate therefor, shall be paid by special assessment, in accordance
with the revised Cities and Villages Act, approved August 15, 1941 and
effective July 1, 1942, and amendments thereto, not including Sections
8~, 1-1 to 84, 1-49 of said Act.
SECTION 4: That the aggregate amount herein ordered to be
assessed against the property and against the
municipality, if any, and also the assessment on each lot and parcel
of land herein assessed shall be divided as follows:
The said assessment to pay the cost of construction of said
improvement and the cost of levying, making and collecting said
assessment and all expenses allowed by law, shall be divided into
five (5) installments, in the manner provided by the statute in
such case made and provided.
So much of the aggregate amount of the assessment as repre-
sents the cost of levying, making and collecting the special assess-
ment and all expenses allowed by law, together with all fractional
amounts so as to leave the remaining installments of the aggregate
assessment equal in amount and each in multiples of $100.00 shall be
apportioned to the first installment of the said special assessment.
The first installment shall be due and payable on the 2nd day of
January next after the filing of the first voucher issued on account
of work done on the said improvement. The second installment of
said assessment shall be due and payable one year thereafter, and
so on annually until all assessments have been paid.
IT IS HEREBY made the duty of the Board of Local Improve-
ments of the Village of Mount Prospect to file in the office of the
Clerk of the Court in which such assessment was confirmed, a cer-
tificate signed by the Secretary of the Board of Local Improvements
of the Village of Mount Prospect of the date of the first voucher
and the amount of the said voucher, within thirty (30) days after the
issuance of the said first voucher. All installments shall bear
interest until paid at the rate of six per cent (6%) per annum.
Interest on all installments shall begin to run from the date of the
first voucher issued on account of work done. Interest on such first
installment shall be due and payable and shall be collected at the
same time as the first installment. Interest on the second and
succeeding installments shall be due and payable and shall be collected
with the installments respectively as in said Act relating to special
assessment provided.
SECTION 5: That for the purpose of anticipating the col-
lection of the second and succeeding install-
ments of said assessment for the cost of said improvements, the Village
of Mount Prospect shall issue bonds payable out of said installment,
bearing interest at the rate of six per cent (6%) per annum, payable
annually, signed by the President of the Board of Trustees of the
Village of Mount Prospect, and attested by the Village Clerk of said
Village. Said bonds shall be issued in accordance with and shall in all
respects conform to the provisions of the revised Cities and Villages
Act, approved August 15, 1941 and effective July 1, 1942, and amendments
thereto, not including Sections 84, 1-1 to 84, 1-49 of said Act.
SECTION 6: That the owner of any lot, block, tract or
parcel of land fronting on the sidewalk, herein-
above provided for, shall and there is hereby allowed him, forty (40)
days after this Ordinance takes effect to build said sidewalk opposite
his land to conform in all respects to the requirements of this ordinance
and an allowance shall be made in spreading of the assessment against
that lot, block, tract or parcel of land of an amount equal to the
estimated cost of that sidewalk based on the cost per unit of the
sidewalk, as shown in the engineer1s estimate.
SECTION 7: That the President of the Board of Trustees
of the Village of Mount Prospect, be, and he is
hereby directed to file a petition in the Circuit, Superior, or
County Court of Cook County, Illinois, in the name of the people
of the Village of Mount Prospect praying that steps may be taken to
levy a special assessment for the purpose of defraying the expense
of said improvement so far as the same may lawfully be done and to
ascertain what property will be benefited, in accordance with the
provisions of this ordinance, and in the manner prescribed by law.
SECTION 8: That all ordinances, or parts of ordinances,
in conflict with this ordinance, be, and the
same are hereby repealed.
SECTION 9: That this ordinance shall be in full force
and effect from and after its passage and
approval thereof, according to law.

WHEREAS, on the __day of , 1958, a Resolution
was adopted by the Board of Local Improvements of the Village of
Mount Prospect originating a local improvement in the Village of
Mount Prospect, by providing for the following:
Construction of Portland Cement Concrete sidewalks and
sidewalk aprons, together with all necessary adjustments
and appurtenances. Said sidewalks are to be installed
in the following streets:
Foundry Road, Highland Street, Memory Lane, Gregory Street,
Isabella Street, Thayer Street, Henry Street, Walnut Street,
Central Road, Northwest Highway, Evergreen Avenue, Lincoln
Street, Go-Wando Avenue, Sha-Bonee Trail, Council Trail,
Berkshire Lane, Lonnquist Boulevard, Golf Road, Kenilworth
Avenue, We-Go Trail, See-Gwun Avenue, Na-Wa-Ta Trail,
Can-Data Avenue, Wa-Pella Avenue, Hi-Lusi Avenue,
I-Oka Avenue, Forest Avenue, Fairview Avenue, Eastwood
Avenue, Ridge Avenue, Elmhurst.Road, Russell Street,
Pine Street, Wille Street, Main Street, Maple Street,
Elm Street, School Street, Owen Street, William Street,
Louis Street, Edward Street, George Street, Mount Prospect

WHEREAS, notice of the time and place of the public hearing
on said improvement was given in the manner provided by law, and
WHEREAS, the public hearing has been held in accordance
with the provisions of the statute in such case made and provided.
NOW, THEREFORE, BE IT AND IT IS HEREBY RESOLVED BY THE
BOARD OF LOCAL IMPROVEMENTS OF THE VILLAGE OF MOUNT PROSPECT, COOK
COUNTY, ILLINOIS:

SECTION 1: That the said local improvement described in
the original resolution adopted on the __day
, 1958, and as shown on the plans attached to the
original resolution, and the estimate of the cost of said improvement
be adhered to.
SECTION 2: That the ordinance now before this Board of
Local Improvements and prepared at the request
of the Board, be, and the same is hereby approved and that each member

of the Board of Local Improvements be requested to sign the Recommendation
attached to the said ordinance, recommending to the President and
Board of Trustees of the Village of Mount Prospect, the passage of
said ordinance.
SECTION 3: That the Secretary of the Board of Local Improve-
ments be, and he is hereby requested to deliver
to the Village Board of the Village of Mount Prospect, the ordinance
for the said improvement, together with the recommendation of this
Board of Local Improvements and the estimate of the President of the
Board of Local Improvements of the Village of Mount Prospect; and that
copies of the said recommendation, estimate and ordinance be placed
on file in the records of the Board of Local Improvements.
SECTION 4: This resolution shall be in full force and

Gentlemen:
We herewith submit an Ordinance for a local improvement
entitled "An Ordinance Providing for the Making of a Local Improvement
in and for the Village of Mount Prospect, Cook County, Illinois",
as follows:
Construction of Portland Cement Concrete sidewalks and sidewalk
aprons, together with all necessary adjustments and appurtenances.
Said sidewalks are to be installed in the following streets:

The existing fire hydrant at the northeast corner of Golf Hoad
and I-Oka A, enuep which interferes with the const1'uction of the proposed
sidewalk, shall be moved to tbe east parkway of I-Oka Avenue.
The sidewalk improve.nents as herein provided shall be constructed
at elevations which il&Ve been determined by a minimum slopep from
the top of existing curbs 0..' edge or existing pavernent (where no such
curb and gutter exists) which. are adjacent to the proposed sidewalk
of one -eighth (1/8) ine h per foot and a maximum of three -quarters
(3/4) inch per foot. The elevation of the proposed walk shall also be
governed by the elevation ot existing walks, driveways and the adjacent
ground.
