AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY
COMMONLY KNOWN AS 519 SOUTH EDWARD STREET
WHEREAS, Eugene J. Koziol (hereinafter referred to as Petitioner)
has filed an application for variations from Chapter 14 of the
Village Code of Mount Prospect, Illinois, for property commonly
known as 519 South Edward Street (hereinafter referred to as
Subject Property), legally described as:
Lot 11 in Surety's Bonnie Park, a subdivision of Lot 2 in
Oehlerking's division of part of Section 12, Township 41
North, Range 11, East of the Third Principal Meridian in
the Village of Mount Prospect, according to plat thereof
registered in the Office of the Registrar of Titles of
Cook County, Illinois on May 11, 1956 as Document Number
1669522
and
WHEREAS, Petitioner seeks variations from Section 14.3016.A.3 to
permit a driveway seventeen feet (17') instead of the required 15';
a variation from Section 14.1102.B to permit a side yard setback
of six inch (6"); and, a variation from 14.1102.A to permit a zero
foot front yard; and
WHEREAS, a public hearing was held on the variations requested
being the subject of ZBA Case No. 45-V-90 before the Zoning Board
of Appeals of the Village of Mount Prospect on the 12th day of
July, 1990, pursuant to due and proper notice thereof published in
the Mount Prospect Herald on the 26th day of June, 1990; and
WHEREAS, the Zoning Board of Appeals has submitted its findings
and recommendation to the President and Board of Trustees of the
Village of Mount Prospect and the President and Board of Trustees
of the Village have given further consideration to the variations
being the subject of ZBA 45-V-90 and have determined that the best
interests of the Village of Mount Prospect would be served by
granting said variations.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are incorporated
herein as findings of fact by the President and Board of Trustees
of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village
of Mount Prospect hereby grant to the Subject Property a variation
from Section 14.3016.A.3 to permit a driveway width of seventeen
feet (17'), a variation from Section 14.1102.B to permit a side
yard setback of six inches (6"); and to permit a zero foot (0')
front yard setback in order to provide for a parking pad.
SECTION THREE: Except for the variations granted herein all other
applicable Village of Mount Prospect Ordinances and regulations
shall remain in full force and effect as to the Subject Property.
SECTION FOUR: In accordance with the provisions of Section 14.604
of Chapter 14 of the Village Code, the variations granted herein

shall be null and void unless permits are issued and construction
begins within one (1) year from the date of passage of this
Ordinance.
SECTION FIVE: This Ordinance shall b~ in full force and effect
from and after its passage, approval and publication in pamphlet
form in the manner provided by law,
