MONTH Mayor Farley proclaimed the week of May 10 - 16, 1992 EMERGENCY MEDICAL Emergency Medical Services Week in Mount Prospect. SERVICES WEEK Mayor Farley also proclaimed the week of May 3 - 9, CHILDREN'S FIRE 1992 as Children's Fire Safety Week in the Village. SAFETY WEEK Clarence Bobikewicz, 1114 Meadow Lane, stated that the new home being built behind his house was at a much higher elevation than his property and expressed concern relative to flooding. A representative of the River Trails Community Association stated that discussions are on-going relative to the proposed Euclid Avenue widening project. M~YOR'S REPORT AMEND CH. 13 An Ordinance was presented for second reading that N. ON-ALCOHOLIC would expand the definition of Alcoholic Liquor to BEVERAGES include near-beer and products advertised as non- alcoholic. Trustee Wilks, seconded by Trustee Busse, moved to amend the proposed Ordinange amending Chapter 13 by adding "...beverages containing anything more than .00% as Alcoholic Liquor" within the definition of near-beer and non-alcoholic beverages. ORD.NO. 4415 Trustee Floros, seconded by Trustee Busse, moved for passage of Ordinance NO. 4415 AN ORDINANCE AMENDING CHAPTER 13 OF. OLD BUSINESS ZBA 9-Z-92 ZBA 9-Z-92, 2320 West Lincoln Street 2320 LINCOLN ST An Ordinance was presented for second reading that would rezone the subject property from R-X, granted upon annexation, to R-1 (Single Family Page 2 - April 21, 1992 Residence District) in order to permit a 3 lot single family home subdivision. The Zoning Board of Appeals recommended granting this request by a vote of 6-0. Trustee Floros, seconded by Trustee Busse, moved ORD.NO. 4416 for passage of Ordinance No. 4416 ANORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE VILLAGE OF MOUNT PROSPECT AS IT PERTAINS TO PROPERTY COMMONLY K~OWN AS 2320 WEST LINCOLN STREET Upon roll call: Ayes: Busse, Corcoran, Floros, Hoefert, Wilks Nays: None Motion carried. An Ordinance was also presented for second reading DEVELOPMENT relative to the property commonly known as CODE 2320 West Lincoln. This Ordinance grants MODIFICATIONS modifications from the Development Code by waiving installation of the required storm sewers until a future date; to permit a Restrictive Covenant guaranteeing installation of street lights at such time as the Village determines appropriate; and, to provide a 10 year period during which the residents of these homes would not be assessed for street improvements. Frank Vlazny, 2103 Jody Court, expressed concern relative to the drainage in that area and asked why the Village wasn't requiring the developer to install storm sewers. It was explained that there are no storm sewers in the area for the developer to connect to therefore this improvement will be made at a future date. Trustee Busse, seconded by Trustee Floros, moved ORD.NO. 4417 for passage of Ordinance No. 4417 AN ORDINANCE GRANTING MODIFICATIONS FROM THE DEVELOPMENT CODE FOR THE LINCOLN-HICKORY SUBDIVISION Upon roll call: Ayes: Busse, Corcoran, Floros, Hoefert, Wilks Nays: None Motion carried. The Hickory-Lincoln Plat of Subdivision was presented HICKORY- for approval. This Plat of Subdivision would create LINCOLN 3 lots for single family homes. SUBDIVISION Trustee Floros, seconded by Trustee Busse, moved to authorize the Mayor to sign and Clerk to attest his signature on the Hickory-Lincoln Plat of Subdivision. The Zoning Board of Appeals recommended granting this request by a vote of 7-0. Trustee Busse, seconded by Trustee Hoefert, moved to waive the rule requiring two.readings of an Ordinance. The Zoning Board of Appeals recommended granting these amendments by a vote of 6-1. An Ordinance was presented for second reading that AMEND CH.9 would amend Article I of Chapter 9 of the Village SIDEWALK Code to clarify the area necessary for pedestrian CAFES traffic in conjunction with sidewalk cafes. An Ordinance was presented for second reading that AMEND CH.23 would amend Article I of Chapter 23 of the Village DISORDERLY Code. This amendment establishes the prohibition CONDUCT of drinking alcoholic beverages on public, commercial and multi-family properties. AMEND CH.23 An Ordinance was presented for second reading that LANDLORD TENANT would amend the Landlord Tenant regulations by prohibiting the drinking of alcoholic beverages parking lots and common areas. ORD.NO. 4424 Trustee Busse, seconded by Trustee Hoefert, moved for passage of Ordinance No. 4424 AN ORDINANCEAMENDINGARTICLEXVIII OF CHAPTER 23 ENTITLED "LANDLORD AND TENANT REGULATIONS" OF THE VILLAGE CODE OF MOUNT PROSPECT Upon roll call: Ayes: Busse Corcoran, Floros, Hoefert, Wilks Nays: None Motion carried. Trustee Clowes arrived at this point in the meeting. AMEND CH.22 An Ordinance was presented for second reading that WATER & SEWER would increase the water and sewer rates. The cost of -- RATE INCREASE water would be increased from $2.62 to $2.75 per 1,000 gallons. ORD. NO. 4425 Trustee Hoefert, seconded by Trustee Clowes, moved for passage of Ordinance No. 4425 AN ORDINANCE AMENDING ARTICLE V ENTITLED "METERS AND RATES" OF CHAPTER 22 OF THE VILLAGE CODE OF MOUNT PROSPECT Upon roll call: Ayes: Busse, Clowes, Corcoran, Floros, Hoefert, Wilks Nays: None Motion carried. AMEND CH. 11 An Ordinance was presented for second reading that INSPECTIONS: would amend Article XXXIV of Chapter ll (Business FOOD License) to provide for 4 inspections for food ESTABLISHMENTS establishments, rather than the existing 6 inspections. Additional fees would be charged for establishments requiring more than the 4 inspections. Page 6 - April 21, 1992 PUBLIC HEARING PUBLIC Mayor Farley called the Public Hearing to order HEARING: at 8:20 P.M. 92/93 BUDGET The purpose of the Public Hearing, called pursuant to proper legal notice having been published in the Mount Prospect Herald on April 8, 1992, was to consider adoption of the annual budget for fiscal year 1992/92. Mayor Farley noted that the total amount of the proposed budget was $45,321,300.00. There was discussion relative to the Governor's announcement that the surcharge tax allocated for local governmental bodies will probably be discontinued. This could present a financial hardship on many communities, however, Mount Prospect has developed a contingency plan if the surcharge tax is not received from the State. Frank Vlazny, 2103 Jody Court, asked the Village to limit the levy being requested by the Mount Prospect Public Library to the maximum amount approved by the voters in the last referendum. Mr. Vlazny also expressed concern that the amount of sales tax received by the Village appears to be lower than budgeted. Trustee Corcoran stated that while the original budget included $50,000 for 'new technology', which had been eliminated due to the possible loss of the surcharge tax, the Village Board would be able to authorize funds for this purpose if the need arises. There being no further discussion on the proposed budget, Mayor Farley declared the Public Hearing closed at 8:35 P.M. An Ordinance was presented for second reading that would adopt the annual budget for fiscal year 1992/83. Trustee Busse, seconded by Trustee Hoefert, moved ORD.NO. 4427 for passage of ordinance No. 4427 AN ORDINANCE ADOPTING AN ANNUAL BUDGET FOR THE VILLAGE OF MOUNT PROSPECT FOR FISCAL YEAR COMMENCING MAY 1, 1992 TO APRIL 30, 1993 IN LIEU OF PASSAGE OF AN APPROPRIATION ORDINANCE Upon roll call: Ayes: Busse, Corcoran, Floros, Hoefert, Wilks Nays: Clowes Motion carried. NEW BUSINESB A Resolution was presented that would authorize EXECUTIVE the release of minutes of specific Executive SESSION Sessions. NAME PUBLIC A Resolution was presented that sets forth the PLACES POLICY policy of the Village Board as it relates to naming public places, buildings and/or streets. RES.NO. 13-92 Trustee Wilks, seconded by Trustee Hoefert, moved for passage of Resolution No. 13-92 A RESOLUTION ESTABLISHING A POLICY ON NAMING PUBLIC PLACES Upon roll call: Ayes: Busse, Clowes, Corcoran, Floros, Hoefert, Wilks Nays: None Motion carried. CONSIDER ITEM Trustee Wilks, seconded by Trustee Corcoran, moved to NOT LISTED ON consider an item not listed on the agenda, specifically AGENDA the name of the new Fire and police Station under construction. NEW FIRE & Trustee Wilks noted that during a recent Committee POLICE BLDG. of the Whole meeting, the Village Board had discussed NAME the name for the new Fire and Police Station Building (112 East Northwest Highway) formerly the Public Safety Building. Following discussion, it was the consensus of opinion that the new building be named the "Mount Prospect Police and Fire Headquarters". It was also the decision of the Board that the building be dedicated for Robert Do Teichert, Village Trustee from 1965 through 1969 and Village PreSident from 1969 through 1977 for his many contributions during a period of considerable growth in the Village. A plaque acknowledging the dedication to Robert D. Teichert will be displayed in the building. Also, a plaque acknowledging the Citizens Committee, helpful in supporting a referendum asking residents if they would support construction of a new building, will also be displayed. Trustee Wilks, seconded Trustee Corcoran, moved to adopt the official name of the new Fire and police Station as the "Mount Prospect Police and Fire Headquarters". Page 8 - April 21, 1992 VILLAGE MANAGERmB REPORT Village Manager John Fulton Dixon presented the BIDS: following bid results on various items. The following bids were received for high-service HIGH pump modifications for pumping stations #16 SERVICE and #17: PUMPS Bidder Amount Tri-Con Corporation $65,860 A. J. Lowe & Son, Inc. 74,413 Advance Mechanical Contractors, Inc. 74,600 M. J. Corboy Company 82,100 Trustee Hoefert, seconded by Trustee Corcoran, moved TRI-CON to concur with the recommendation of the administration CORP. and accept the iow qualified bid submitted by Tri-Con Corporation in the amount of $65,860 for modifications to the high-service pumps at pumping stations 16 and 17. The following bids were received for the rehabilitation COMMUTER of the east and center commuter parking lots, including PARKING replacing deteriorated asphalt curb and new concrete LOTS curbs and pavement restoration: Bidder Amount Martam Construction $45,597 Alliance Contractors, Inc. 75,255 Trustee Hoefert, seconded by Trustee Wilks,' moved to MARTAM concur with the recommendation of the administration CONST. and accept the 10w qualified bid submitted by Martam Construction in the amount of $46,057 for the rehabilitation of the commuter parking lots. A request was presented from administration to RESURFACING authorize an increase in the contract with Allied PROJECT - Asphalt Company for the i990 resurfacing project. 1990 It was noted that the original contract, authorized ALLIED May 7, 1990, for $262,174.35. Additional work was ASPHALT required, not included in the.original contract, to make temporary patching on Waverly Avenue and Huntington Commons Road. Taking into consideration the 5% retainage, as specified in the original contract, and with the additional work, the amount over the authorized contract totals $13,492.32. Trustee Corcoran, seconded by Trustee Hoefert, moved to authorize an increase to the contract Page 9 - April 21, 1992 with Allied Asphalt by $13,492.32 for a total contract amount of $269,846.48. EMERGENCY A request was presented from staff to ratifythe action SEWER REPAIRS of the Village Manager to authorize emergency repairs to a 24" combined sewer generally located at 202 South Owen. It was noted that the repairs necessary were beyond the ability of Public Works equipment and therefore a proposal was requested from a local contractor, Rossetti. Not knowing the exact amount of work involved, Rossetti submitted a cost of approximately $15,000. ROSSETTI Trustee Hoefert, seconded by Trustee Corcoran, moved to ratify the action of the Village Manager in authorizing the emergency repairs to the sewer generally located at 202 South Owen Street. HYDRANT Village Manager Dixon informed the Board that hydrant FLUSHING flushing will be taking place during the week. SOLICITATION Mr. Dixon stated that there is a telephone solicitation program being conducted within the Village by the North Suburban Professional Firefighters Association. Mr. Dixon stated that the soliciting organization is a union and does not represent the Village Fire Department. NTN SIGNS Trustee Floros asked for clarification of a legal opinion the Board received from Pedersen & Houpt relative to the NTN signs installed on Kensington Road. These signs were the subject of a recent discussion by the Village Board as to whether a field change should be granted allowing the signs to remain on the berms. Mayor Farley stated that the legal opinion, which expresses the opinion of legal counsel, is that the NTN signs are permitted and can remain as installed. BROADACRE Trustee Clowes asked the status of the proposal for the DOWNTOWN downtown redevelopment. Mayor Farley stated that DEVELOPMENT discussion on this subject is scheduled to take place PLAN at the Committee of the Whole meeting on May 12th. WELLER CREEK Trustee Clowes also asked that Board consider the EROSION erosion of Weller Creek as a possible future project for the Village. SOLID WASTE Trustee Clowes stated that a recent Galliton report indicates that the private sector could provide solid waste disposal at a lower cost than SWANCC.
