HomeMy WebLinkAboutOrd 4195 06/05/1990 ORDINANCE NO. 4195 AN ORDINANCE GRANTING A VARIATION FOR PROPERTY COMMONLY KNOWN AS 2234 WEST LINCOLN STREET PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES the 5th day of June , 1990 Published in pamphlet form by authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 6th day of June , 1990. / CAF 5/24/90 ORDINANCE NO. 4195 AN ORDINANCE GRANTING A VARIATION FOR PROPERTY COMMONLY KNOWN AS 2234 WEST LINCOLN STREET WHEREAS, Elizabeth Magnone (hereinafter referred to as Petitioner) has filed an application for a variation from a provision of Chapter 14 of the Village Code of Mount Prospect, Illinois, for property commonly known as 2234 West Lincoln Street (hereinafter referred to as Subject Property), legally described as: That part of the East Half (1/2) of the Southwest Quarter (1/4) of the Southeast Quarter (1/4) of the Northwest Quarter (1/4) of Section 10, Township 41 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois, beginning at the Southwest corner of said East Half (1/2) running thence east along the south line of said East Half (1/2) one hundred sixty-five feet (165'), thence north parallel with the West line of said East Half (1/2) two hundred sixty-four (264') thence west parallel with the south line of said East Half (1/2) one hundred sixty-five feet (165') to the West line of said East Half (1/2) thence South along the West line of said East Half (1/2) two hundred sixty-four feet (264') to the point of beginning. and WHEREAS, the Petitioner seeks a variation from Section 14.3016.A.1 to allow a circular driveway, being the second driveway on the lot, and a variation from Section 14.3016.A.3 to allow a driveway width of thirty-two feet (32'); and WHEREAS, a public hearing was held on the variations requested being the subject of ZBA Case No. 26-V-90 before the Zoning Board of Appeals of the Village of Mount Prospect on the 26th day of April, 1990, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 10th day of April, 1990; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect and the President and Board of Trustees of the Village have given further consideration to the variations requested and have determined that the same satisfies the standards set forth in Section 14.605 of Article VI of Chapter 14 of the Village Code and the Board of Trustees further find that it would be in the best interests of the Village to grant the variations as specified herein. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the following variations: 1. A variation from Section 14.3016.A.1 to allow a circular driveway, being the second driveway on the subject property. 2. A variation from Section 14.3016.A.3 to allow a driveway width of thirty two feet (32'). SECTION THREE: Except for the variations granted herein, all other BA 26-V-90 Page 2 of 2 applicable Village of Mount Prospect Ordinances and regulations shall remain in full force and effect as to the Stlbject Property. SECTION FOUR: In accordance with the provisions of Section 14.604 of Chapter 14 of the Village Code, the variations granted herein shall be null and void unless permits are issued and construction begins within one (1) year from the date of passage of this Ordinance. SECTION FIVE: This Ordinance shall be null and void unless a Plat of Subdivision placing the subject property into one lot of record shall be filed for approval and recorder with the Recorder of Deeds or Registrar of Titles, whichever is applicable. SECTION SIX: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
