AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY
COM]{ONLY KNOWN AS 107 WEST ORCHARD PLACE
WHEREAS, Irene B. Sala (hereinafter referred to as Petitioner) has
filed an application for variations from Chapter 14 of the Village
Code of Mount Prospect, Illinois, for property commonly known as
107 West Orchard Place (hereinafter referred to as Subject
Property), legally described as:
Lot 30 in First Addition to Country Club Terrace, being
a subdivision of part of Lot 18 in Owner's Subdivision of
Section 13, Township 41 North, Range 11, East of the Third
Principal Meridian in Cook County, Illinois
and
WHEREAS, Petitioner seeks variations from Section 14.3016.A.3 to
permit a driveway sixteen feet 6 inches (16' 6") and a variation
from Section 14.1102.B to permit a side yard setback of one foot
six inches (1' 6"); and
WHEREAS, a public hearing was held on the variations requested
being the subject of ZBA Case No. 42-V-90 before the Zoning Board
of Appeals of the Village of Mount Prospect on the 14th day of
June, 1990, pursuant to due and proper notice thereof published in
the Mount Prospect Herald on the 29th day of May, 1990; and
WHEREAS, the Zoning Board of Appeals has submitted its findings
and recommendation to the President and Board of Trustees of the
Village of Mount Prospect and the President and Board of Trustees
of the Village have given further consideration to the variations
being the subject of ZBA 42-V-90 and have determined that the best
interests of the Village of Mount Prospect would be served by
granting said variations.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are incorporated
herein as findings of fact by the President and Board of Trustees
of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village
of Mount Prospect hereby grant to the Subject Property a variation
from Section 14.3016.A.3 to permit a driveway width of sixteen feet
six inches (16' 6") and a variation from Section 14.1102.B to
permit a side yard setback of one foot six inches (1' 6"), to allow
the replacement of a driveway.
SECTION THREE: Except for the variations granted herein all other
applicable Village of Mount Prospect Ordinances and regulations
shall remain in full force and effect as to the Subject Property.
SECTION FOUR: In accordance with the provisions of Section li.604
of Chapter 14 of the Village Code, the variations granted herein

shall be null and void unless permits are issued and construction
begins within one (1) year from the date of passage of this
Ordinance.
SECTION FIVE: This Ordinance shall be in full force and effect
from and after its passage, approval and publication in pamphlet
form in the manner provided by law.
