Water will often pond in yards and remain there for a considerable length of time. On May 13, 2008, the Village Board authorized staff to proceed with the Backyard Drainage Program to assist residents in reducing backyard flooding. Since then, Village staff has received requests for assistance through the Backyard Drainage Program from over 400 residential properties. Recognizing that the requests greatly surpassed the Village's ability to provide financial assistance, the program was modified at the February 10, 2015, Committee of the Whole Meeting as the Village Board directed staff to prioritize sites that experience flooding reaching home foundations. The Village Board also established a requirement of cost sharing by the property owners. The Board committed to paying most of the cost of the improvements, a minimum of 75% of the total cost. Property owners are required to pay 25% of the cost up to a maximum of $5,000. Village staff have, to date, identified seventy-two properties that have experienced ponding severe enough that floodwaters reach the house foundation. Fifty-nine properties have benefited from this program thus far. A typical design includes an inlet in the backyard draining through a pipe connecting to the existing sewer system in the public right-of-way. Designs typically include a restrictor that controls and slows the discharge into the receiving sewer to protect the receiving system from being overwhelmed. A restrictor, while serving to protect the Village sewer system, may cause water to pond in the backyard during heavy rain events for a short duration. A rain garden is typically installed around the inlet to accommodate ponding water. Rain gardens provide a place for any ponding water to accumulate and provide a mechanism for the water to infiltrate into the ground quickly. Following construction, the property owners are responsible for maintenance of the storm sewer and rain gardens on private property; however, it is the Village's responsibility to maintain the new storm sewer in the public right-of-way. Each design is contained on a single property, avoiding the need for easements or agreements between property owners. Two sites were selected for this year's program. Staff estimated the average total cost for the improvements to each property to be over $40,000, the homeowner's cost is estimated to be $5,000. Both property owners participating in the 2024 Backyard Drainage Program have submitted checks covering their participation in the program. Bid Results A Notice to Bidders was posted on the Demandstar website. The bid opening for the 2024 Backyard Drainage 1:00 p.m. Six contractors submitted bids for this of $58,461.00 by Kloepfer Construction, Inc. to Inc. The as -read bids ranged from a low high of $120,930.00 by Bolder Contractors, Discussion All bidders submitted a bid bond in the amount of 10% of the total bid as required in the bid proposal packet. All bidders correctly signed their bids and bid bonds. The bid for Kloepfer Construction Inc. contained minor rounding errors made in determining the cost of certain line items. The result is that the bid amount listed, $58,461.00, is $1.02 higher than the summation of the actual calculated line -item costs, $58,459.98. It is staff's opinion that this difference is minor and does not change the low bidder. The calculated amount of $58,459.98 is accepted as the true bid amount for Kloepfer Construction, Inc. The low bid of $58,459.98 by Kloepfer Construction, Inc. is approximately 28% below the Engineer's Estimate of Cost. The low bidder, Kloepfer Construction, Inc., meets the requirements of the contract documents and is qualified to complete the work involved with this project. Staff has checked references provided by Kloepfer Construction, Inc., and has confirmed that they have successfully completed many similar improvements for other agencies including the Village of Willowbrook and Mission Brook Sanitary District. Village staff recommends including a 10% contingency in the project award to allow for quantity variances and unanticipated construction conflicts which would result in a total recommended award of $64,300.00 ($58,459.98 + $5,840.02 = $64,300.00). Alternatives 1. Accept the lowest cost, responsive bid for the 2024 Backyard Drainage Program. 2. Action at the discretion of the Village Board. Staff Recommendation Staff recommends that the lowest cost, responsive bidder, Kloepfer Construction, Inc. of Northbrook, Illinois be awarded the contract for the 2024 Backyard Drainage Program in the amount not to exceed $64,300. If written notice of award of this bid is mailed, emailed or otherwise delivered to the Bidder at any time before this bid is withdrawn, the Bidder agrees to execute and deliver the contract in the prescribed form and furnish payment and performance bonds, or letter of credit, and the insurance certificates required by the Bid Documents to the Village within ten (10) days after receipt.
