CAF 4/8/92 ORDINANCE NO. 4418 AN ORDINANCE GRANTING A VARIATION FOR PROPERTY LOCATED AT 2320 WEST WHITE OAK WHEREAS, Edward R. and Gale A. Egle (hereinafter referred to as Petitioners) have filed an application for a variation from Chapter 14 of the Village Code of Mount Prospect, Illinois, for property commonly known as 2320 West White Oak (hereinafter referred to as Subject Property), legally described as: Lot 15 in Callero and Catino's Cypress Gardens, being a subdivision of the West 1/2 of the Northwest 1/4 of the Southeast 1/4 of the Northwest 1/4 of Section 10, Township 41 North, Range 11, East of the Third Principal Meridian in Cook County, Illinois and WHEREAS, Petitioners seeks a variation from Section 14.1002 to allow a side yard setback of 23.3 feet for a room addition; and WHEREAS, a public hearing was held on the variation requested being the subject of ZBA Case No. 14-V-92 before the Zoning Board of Appeals of the Village of Mount Prospect on the 26th day of March, 1992, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 20th day of March, 1992; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect and the President and Board of Trustees of the Village have given further consideration to the variation being the subject of ZBA 14-V-92 and have determined that the best interests of the Village of Mount Prospect would be served by granting said variation. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property a variation from Section 14.1002 to allow a 28.3 foot side yard setback for a room addition. SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and regulations shall remain in full force and effect as to the Subject Property. SECTION FIVE: In accordance with the provisions of Section 14.604 of Chapter 14 of the Village Code, the variations granted herein shall be null and void unless permits are issued and construction BA 14-V-92 Page 2 of 2 begins within one (1) year from the date of passage of this Ordinance. SECTION SIX: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
