AN ORDINANCE GRANTING A CONDITIONAL USE FOR A
SIDE YARD SETBACK REDUCTION FOR PROPERTY LOCATED AT
504 HI LUSI AVENUE. MOUNT PROSPECT, ILLINOIS
WHEREAS, Andrew Venamore ("Petitioner") filed an application fora conditional
use to reduce the interior (north) side yard setback for the property commonly
known as 504 Hi Lusi Avenue ("Subject Property") in the Village of Mount
Prospect, Illinois and legally described as:
LOT 3IN BLOCK 11 IN PROSPECT PARKCOUNTRY CLUB SUBDIVISION, BEINGA
SUBDIVISION OFTHE SOUTHEAST QUARTER OF SECTION 11 AND THE SOUTH
15ACRES OFTHE EAST HALF OFTHE NORTHEAST QUARTER OF SAID SECTION
11, ALL IN TOWNSHIP 41 NORTH, RANGE 11, EAST OF THE THIRD PRINCIPAL
MERIDIAN, IN COOK COUNTY, ILLINOIS;
PROPERTY INDEX NUMBER: 08-11-418-012-0000; and
WHEREAS, the Petitioner seeks a conditional use permit to reduce the interior
(north) side yard setback from 5 feet to 3.04 feet and 3.19 feet for the
construction of an attached single -car garage along the north side of the
dwelling; and
WHEREAS, a Public Hearing was held on the request for a Conditional Use
permit being the subject of PZ -02-24 before the Planning and Zoning
Commission of the Village of Mount Prospect on the 281h day of March, 2024,
pursuant to proper legal notice having been published in the Journal�ToToPJw m
newspaper on the 13th day of March, 2024; and
WHEREAS, the Planning and Zoning Commission has submitted its findings and
recommendations of approval, with specific conditions, to the President and
Board of Trustees in support of the request being the subject of PZ -02-24; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
have given consideration to the request herein and have determined that the
same meets the standards of the Village and that the granting of the proposed
Conditional Use permit would be in the best interest of the Village.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS
ACTING IN THE EXERCISE OF THEIR HOME RULE POWERS:
SECTION ONE: The recitals setforth hereinabove are incorporated as findings of
fact by the President and Board of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village of Mount
Prospect do hereby grant a Conditional Use permit to reduce the interior (north)
side yard setback from 5feet to 3.04feet and 3.19feet for the construction of an
attached single -car garage at the property known as 504 Hi Lusi Ave, subject to
the following conditions:
1. The improvements shall be in general conformance with the site plan
prepared by Heartland Garage Builders, bearingthe latest revision date of
January 17, 2024, and the plat of survey/site plan prepared by Heartland
Garage Builders, bearing the latest revision date of April 18, 2023, while
also meeting all code requirements; and
2. A grading plan be included in the submittal for the building permit
confirming adequate drainage along the side yard.
Except for the conditional use granted herein, all other applicable Village of
Mount Prospect, Illinois ordinances and regulations shall remain in fullforce and
effect as to the subject property.
SECDO THREE: The Village Clerk is hereby authorized and directed to record a
certified copy of this Ordinance and Exhibit "A" with the Recorder of Deeds of
Cook County.
SECTION FOUR: This Ordinance shall be in full force and effect from and after its
passage, approval in the manner provided by law.
