A RESOLUTION GRANTING A CONDITIONAL USE FOR A
REAR YARD SETBACK REDUCTION FOR PROPERTY LOCATED AT
WHEREAS, Roseann Schumacher ("Petitioner") filed an application for a
conditional use permit to reduce the rear yard setback for the property
commonly known as 206 Prairie Avenue ("Subject Property") in the Village of
Mount Prospect, Illinois and legally described as:
LOT 3 IN THE PRAIRIE AVENUE SUBDIVISION BEING A SUBDIVISION OF THE
EAST'/2 OF THE NORTH 1/20F THE WEST'/2 OF THE NORTHEAST 1/40F THE
SOUTHEAST '/a OF THE NORTHWEST '/a OF SECTION 10, TOWNSHIP 41
NORTH, RANGE 11 EAST OF THE THIRD PRINCIPAL MERIDIAN, ACCORDING
TO THE PLAT THEREOF RECORDED NOVEMBER 9, 2018 PER DOCUMENT NO.
1831334062, IN COOK COUNTY, ILLINOIS;
PROPERTY INDEX NUMBER: 08-10-114-152-0000; and
WHEREAS, the Petitioner seeks a conditional use permit to reduce the rear
yard setback from 25 feet to 20 feet for the construction of a detached single-
family residence; and
WHEREAS, a public hearing was held on the request for a conditional use
permit being the subject of PZZ24-000008 before the Planning and Zoning
Commission of the Village of Mount Prospect on the 23rd day of May, 2024,
pursuant to proper legal notice having been published in the_QwnajTgpc
newspaper on the 8th day of May, 2024; and
NOW, THEREFORE, the Planning & Zoning Commission does hereby grant
conditional use approval to allow a twenty -foot (20') rear yard setback at the
property known as 206 Prairie Avenue, subject to the following conditions:
PZZ24-000008
a. The improvements shall be in general conformance with the plans and
drawings prepared by Reibel & Associates PC, bearing the latest
revision date of 3/29/2024 as shown on the site plan as Exhibit A, and
meet all code requirements;
b. Any future accessory structures or permitted obstruction to be located
on the subject property shall satisfy all applicable bulk requirements;
c. The conditional use for the reduced rear yard setback shall only apply to
the corner of the proposed single-family residence as shown on Exhibit
A.
Except for the conditional use approval granted herein, all other applicable
Village of Mount Prospect, Illinois ordinances and regulations shall remain in
full force and effect as to the subject property.
PASSED AND APPROVED the 23rd day of May, 2024 and effective five (5)
days after this date, as provided for by Section 5.504.0 of the Mount Prospect
Village Code.
