AN ORDINANCE GRANTING A VARIATION FOR PROPERTIES
COMMONLY KNOWN AS 228 & 230 SOUTH PRAIRIE AVENUE
WHEREAS, James W. Malapanes, Sr. (hereinafter referred to as
Petitioner) has filed an application for a variation from Chapter
14 of the Village Code of Mount Prospect, Illinois, for property
commonly known as 228 and 230 South Prairie Avenue (hereinafter
referred to as Subject Property), legally described as:
Lots 1 and 2 in Malapanes Subdivision of the North 151
feet of the East Half of the South Half of the West Half
of the Northeast Quarter of the Southeast Quarter of the
Northwest Quarter of Section 10, Township 41 North, Range
11, East of the Third Principal Meridian, in Cook County,
Illinois
and
WHEREAS, Petitioner seeks a variation from Section 14.115.C to
allow the driveways thirty one feet (31') wide and a special use,
as provided in Section 14.1101.C.8, to allow three-car garages on
the Subject Property; and
WHEREAS, a public hearing was held on the variation and special use
req]/ested, being the subject of ZBA Case No. 19-V-92 and ZBA 20-
SU-92, before the Zoning Board of Appeals of the Village of Mount
Prospect on the 23rd day of April, 1992, pursuant to due and proper
notice thereof published in the Mount Prospect Herald on the 7th
day of April, 1992; and
WHEREAS, the Zoning Board of Appeals has submitted its findings
and recommendations to the President and Board of Trustees of the
Village of Mount Prospect and the President and Board of Trustees
of the Village have given further consideration to the variation
being the subject of ZBA 19-V-92 and the special use permit being
the subject of ZBA 20-SU-92, and have determined that the best
interests of the Village of Mount Prospect would be served by
granting said requests.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are incorporated
herein as findings of fact by the President and Board of Trustees
of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village
of Mount Prospect hereby grant to the Subject Property a variation
from Section 14.115.C to allow driveway widths of thirty one feet
(31') and a special use to allow 3-car garages on the Subject
Property, subject to the following conditions:
1. That the driveways be twenty-one feet (21') at the property
line; and
2. That the garages face the interior of the lots, as indicate~
on the site plan, a copy of which is attached hereto and
hereby made a part hereof as Exhibit "A".

herein, all other applicable Village of Mount Prospect Ordinances
and regulations shall remain in full force and effect as to the
Subject Property.
SECTION FIVE: In accordance with the provisions of Section 14.60~
of Chapter 14 of the Village Code, the variations granted herein
shall be null and void unless permits are issued and construction
begins within one (1) year from the date of passage of this
Ordinance.
SECTION SIX: This Ordinance shall be in full force and effect from
and after its passage, approval and publication in pamphlet form
in the manner provided by law.
