AN ORDINANCE GRANTING A VARIATION FOR PROPERTY
COMMONLY KNOWN AS 508 SOUTH OWEN STREET
WHEREAS, John R. and Grace M. Kinsella (hereinafter referred to as
Petitioners) have filed an application for a variation from certain
provisions of Chapter 14 of the Village Code of Mount Prospect,'
Illinois, for property commonly known as 508 South Owen Street
(hereinafter referred to as Subject Property), legally described
as:
Lot 26 in Ellendale East, being a subdivision of the South
30 acres of the West 40 acres of the Southeast 1/4 of
Section 12, Township 41 North, Range 11, East of the Third
Principal Meridian, according to plat thereof registered
in the office of the Registrar of Titles of Cook County,
Illinois on July 21, 1955 as Document No. 1609080;
and
WHEREAS, the Petitioners seek a variation from Section 14.1103 of
Chapter 14 of the Village Code of Mount Prospect to allow a Floor
Area Ratio of .45, rather than the maximum .35 permitted; and
WHEREAS, a public hearing washeld on.the variation requested being
the subject of ZBA Case No. 24-V-92 before the Zoning Board of
Appeals of the Village of Mount Prospect on the 23rd day of Apri!,
1992, pursuant to due and proper notice thereof published in the
Mount Prospect Herald on the 7th day of April, 1992; and
WHEREAS, the Zoning Board of Appeals has submitted its findings
and recommendation to the President and Board of Trustees of the
Village of Mount Prospect and the President and Board of Trustees
of the Village have given further consideration to the variation
requested in ZBA 24-V-92 and have determined that the best
interests of the Village would served by granting the variation
requested herein.
NOW, THEREFORe, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are incorporated
herein as findings of fact by the President and Board of Trustees
of th~ Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village
of Mount Prospect hereby grant to the Subject Property a variation
from Section 14.1103 to allow a Floor Area Ration (FAR) of .45,
rather than the permitted .35, to allow the construction of a
second story addition.
SECTION THREE: Except for the variations granted herein, all other
applicable Village of Mount Prospect Ordinances and regulations
shall remain in full force and effect as to the Subject Property.
SECTION FOUR: In accordance with the provisions of Section 14.604
of ChaPter 14 of the Village Code, the variations granted

herein shall be null and void unless permits are issued and
construction begins within one (1) year from the date of passage
of this Ordinance.
SECTION FI~-E: This Ordinance shall be in full force and effect
from and after its passage, approval and publication in pamphlet
form in the manner provided by law.
