CAF/ 8/11/92 ORDINANCE NO. 4460 AN ORDINANCE GRANTING A VARIATION FOR PROPERTY LOCATED AT 15 SOUTH WA pE. LLA WHEREAS, Edwin and Susan Boundy (hereinafter referred to as Petitioners) have filed an application for a variation from Chapter 14 of the Village Code of Mount Prospect, Illinois, for property commonly known as 15 South Wa Pella (hereinafter referred to as Subject Property), legally described as: Lot 291 in H. Roy Berry Company's Colonial Manor, being a subdivision of part of the Northeast Quarter of Section ll, and part of the Northwest Quarter of Section 12, all in Township 41 North, Range 11, East of the Third Principal Meridian, Cook County, Illinois and WHEREAS, Petitioners seek a variation from Section 14.102.B.2 to allow a four foot (4') interior side yard setback and a six inch (6") rear yard setback, rather than 5' as required, in order to accommodate a detached accessory building; and WHEREAS, a public hearing was held on the variation requested being the subject of ZBA Case No. 46-V-92 before the Zoning Board of Appeals of the Village of Mount Prospect on the 23rd day of July, 1992, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 7th day of July, 1992; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect and the President and Board of Trustees of the Village have given further consideration to the variation being the subject of ZBA 46-V-92 and have determined that the best interests of the Village of Mount Prospect would be served by granting said variation. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals se~ forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property a variation from Section t4.102.B to allow a 4 foot (4') interior side yard setback and a six inch (6") rear yard setback in order to allow a detached accessory building. SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and regulations age 2 of 2 shall remain in full force and effect as to the Subject Property. SECTION FOUR: In accordance with the provisions of Section 14.604 of Chapter 14 of the Village Code, the variations granted herein shall be null and void unless permits are issued and construction begins within one (1) year from the date of passage of this Ordinance. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
