The Plat of Vacation is required in order to vacate a portion of an existing easement #1 with the Village (this easement grants the Village access to a creek) along the east property line. The Plat of Vacation would also fully vacate a second easement that runs through the center of the subject property. Both vacations are required to accommodate: 1) the construction of a future silo that will conflict with the Village's ability to access the creek and 2) a recent building addition that currently conflicts with the second easement's location. The Plat of Easement re-establishes the portion of easement #1 that is to be vacated, and simultaneously provides a new 20 -foot wide access easement that would jog around the future silo and connect to the creek along the northeast corner of the subject property. Attached are the Plat of Vacation and Plat of Easement. Both plats include the appropriate signature blocks. Staff has reviewed the plats and found it to be prepared according to all Village codes and requirements. Discussion Alternatives 1. Approve the resolution approving a plat of vacation and a plat of easement grant for the property located at 902 Feehanville Drive. 2. Action at the discretion of the Village Board. Staff Recommendation Approve the subject resolution as presented. A RESOLUTION APPROVING A PLAT OF VACATION AND PLAT OF EASEMENT GRANT FOR PROPERTY LOCATED AT 902 Feehanville Drive, Mount Prospect, IL 60056 WHEREAS, the Petitioner, Avery Dennison Corporation, has requested approval of a Plat of Vacation dated 12/29/2022 and a Plat of Easement Grant dated 12/16/2022 for property located at 902 Feehanville Drive and legally described as the following: Lot 307 in Kensington Center -Resubdivision VIII, being a Resubdivision of Lots 303, 305 and 307 in Kensington Center -Phase Three -A, in part of the Northwest 1/4 of Section 35, Township 42 North Range 11, East of the Third Principal Meridian; as per Plat recorded June 22, 1982, as document number 26268098, in Cook County, Illinois. Property Index Number: 03-35-104-029-0000 WHEREAS, the Corporate Authorities of the Village of Mount Prospect ("Village"), after due consideration, have determined it is in its best interests to approve a plat, vacating a portion of one of two (2) separate, 20 -foot easements and vacating the second separate, 20 -foot easement in its entirety to the Village of Mount Prospect; namely: (i) solely the northwesterly 48 -foot portion of easement #1 that runs along the east side of the existing building; and (ii) the entire easement #2 located almost in the center of the parcel and runs underneath the existing building as both are reflected on the Plat of Vacation and simultaneously dedicating a new portion to the already existing easement #1 as reflected on the Plat of Easement Grant. NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, A HOME RULE MUNICIPALITY: SECTION ONE: That the Plat of Vacation and Plat of Easement Grant for the property located at 902 Feehanville Drive are hereby approved for appropriate execution and simultaneous recording together with this Resolution. SECTION TWO: That this Resolution shall be in full force and effect from and after its passage and approval in the manner provided by law.
