Information
A series of new federal and state regulations contain provisions that will require the Village to
replace all the lead water service lines in its potable water distribution system. These
regulations also contain substantive public notification requirements, water service line
material type inventories, and stricter protocols for testing for lead content in drinking water.
These regulations include the Lead and Copper Rule Revisions Act (federal), the Lead and
Copper Rule Improvements Act (federal), the Illinois Lead Service Line Replacement and
Notification Act (state), and several Illinois Department of Public Health directives.
The collective effect of these rules is to compel water purveyors to proactively arrange for the
complete removal of lead service lines over the course of 15-20 years. This compliance time
frame could be reduced to 10 years pending final rulemaking for the federal Lead and Copper
Rule Improvements Act.
None of this legislation includes funding mechanisms to do the required work.
One poignant topic of discussion is the assignment of fiscal responsibility for compliance work.
Every water service line is partially owned by the Village and partially privately owned.
However, these new regulations require the entire service line to be replaced all at once. The
elephant in the room for municipalities and local water purveyors is: Who pays and how
much?
At the February 13, 2024, Committee of the Whole meeting, staff and representatives from
the Village's engineering consultants, Baxter & Woodman, will explain these new regulations
and discuss their impact on the Village -owned potable water distribution system.
In addition, staff will present a plan to fund replacement of an estimated 750-800 lead service
lines in the Mount Prospect water system with the Village serving as the primary payer. Staff
is seeking Village Board endorsement of this plan.
